Petition of Susan Evilsizer in the matter of the last will and testament of Jefferson Evilsizer, deceased, for Probate of Will and Letters Testa mentary. To the Hon. W M Phillips, Judge of the County Court of County in the state of Illinois. The petition of the undersigned Susan Evilsizer late of the county of Washington aforesaid, departed this life on or about the 15 day of December 1865 leaving a last will and testament duly signed, published and attested as believed by your petitioner and which is he rewith presented to your honor for probate.
I,�b� Jefferson Evilsizer o�/b�f Coloma in the County of Washington, State of Ill inois, do hereby make and declare this my last will and testament in manner and form following towit; First it is my will that my funeral expenses and all my just debts be fully paid. Second, after the payments of such funeral expenses and debts, I give devise and bequeath unto my beloved wife Susan Evilsizer the farm on which we now reside, situated in said county and state and known and described as the North half of the North West quarter and the North West quarter of the south west quarter, excepting what is already laid out in town lots and contracted away to the Coloma Coal Mining Company, all in section thirty three (33) township three (3) South range one west, and the north west quarter of the north west quarter of section twenty seven (27) township three (3) south of range one west of the third principal meridian during her natural life "Providing she remain my widow" otherwise revert or become the property of my heirs, and all of the live stock, horses, cattle, sheep, hogs, by me now owned, and other articles of personal property with herein enumerated or otherwise disposed of in this will, during the time she remains my widow after having disposed of a sufficient amount to pay and discharge the .... and debts aforesaid, and that at her death, or marriage, all the property aforesaid to her bequeath, or so much thereof as may remain unexpected, to my seven sons, Liberty Evilsizer, Oliver Evilsizer, Alvin Evilsizer, Charles Evilsizer, Lawson Evilsizer,
Lulla (sic) Evilsizer, and Stephen Evilsizer, and their heirs and assigns for ever, all the above mentioned property to be equally divided between the a bove named sons at the death or marriage of my wife Susan Evilsizer. And lastly, I hereby constitute and appoint my said wife Susan Evilsizer executor of this my last will and testament, revoking and annulling all former will by me made and satisfying and cam..pering this and no other to be by last will and testament. In witness whereof , I the said Jefferson Evilsizer have hereunto set my hand and seal this eleventh day of December in the year One Thousand Eig ht Hundred Sixty-Five.
