Identified in document of F. Ballif, notary at Moudon, 04 feb 1613, involving a dispute between Jean and Jean Becholley father and son, with Moyse Dutey of Chesalles who has married Sarraz daugher of Jean Becholley. Moyse himself is noted at Chesalles as early as 1598 and as late as 1625.

He may also have had a son Daniel and a daughter who married Jean Wagnieres, if we have correctly identified the subject of a terse notation in the records of the Cour de Justice of Moudon (ACV Bil 51, 17 mar 1659), indicating the resolution of an action by Baltazard Maquelin son of the late Claude Maquelin son of the late Anthoine Maquelin, against Jean Wagnieres, Jean Dutoit and his brother Daniel Dutoit and their wives, "heritiers et bientenants de Pierre fils de feu Anthoine Maquelin, situes lesdits biens en La Faye riere ledit Moudon". The notice further indicates that the testament of Anthoine Maquelin was dated 1620. Further details are probably contained in a preceding volume of court records, now lost. However since Jean Dutoit son of Moyse Dutoit had married Jeannaz Maquelin daughter of Anthoine Maquelin in 1618, it seems likely that he must be one of the defendants named, and thus should have a brother Daniel who had a wife who was also a daughter of Anthoine Maquelin. All of this would probably be explained if we could locate the testament of Pierre Maquelin, who died about 1641.

The Moyse Dutoit who was at Chesalles is revealed in the terrier ACV Fn 347 (fol. 302, 13 apr 1592) as the son of the late Jean who was a son of Maurice son of Claude.

Records of J. Jaquier, notary, show Nicod and wife Fran�oise Veyre in 1559, a Nicod son of Pierre (with unnamed brothers) in the same year, then a partage of Nicod and his brothers Pierre, Jean, Fran�ois, and Guillaume, all sons of the late Nicod, in 1568. The relationships inferred from these facts could be questioned, as it is possible the wife is attached to the wrong Nicod or that ambiguous language in the notarial records has been misinterpreted. However, surviving records of the some of the other notaries repeat this statement, the father of this group of five brothers was called Nicod. Further, the partage of property held in common by the five brothers contains mentions of another brother, Claude, possibly deceased. It is also possible he was a half-brother to the other five, son of a different marriage, or that this reference is in error.

Inexplicably, the corresponding church records identify the father of at least a couple of these children as Pierre rather than Nicod. However, we have also discovered that the church records have failed to distinguish the children of the various contemporary Jean Dutoit's, etc. Also, the terrier ACV Fn 347 (1592-1593) calls the father of at least some of the brothers Pierre.

There are a number of documents that need to be mentioned here:

Among the papers of Jean Jaquier or Jaqueri of Demoret (ACV DL 53, covering 1557-1583), there are a series of conveyances by Noble Aym� de Prez, Seigneur de Corcelles-le-Jorat and other places, that appear to be confirmation of titles for descendants of various Dutoit relatives who have died. These give information about the spouses and relationships of some branches of the family, notably the descendants of Nicod (brother of Guy).

The same notary recorded documents (1565) concerning the marriage of Pierre son of the late Jean Dutoit to Anteine daughter of the late Maurice Dutoit, in which a variety of other relatives make appearances.

A partage dated 15 may 1568, with other related documents, names the sons of the late "Nicod" (the one who is called "Pierre" in the church records of the time). Another dated 30 may 1569, which remains to be explained in genealogical terms, concerns a settlement for property owned 1/2 by Claude Demont and 1/2 by the heirs of the late Bernard Demont, with the same list of sons of the late "Nicod" Dutoit. One possible interpretation is that the mother of the late "Nicod" was a Demont, and so the Dutoit brothers had an interest in property left by the decease of a Demont relative. This notion is consistent with the large number of documents relating to this family that are recorded by Rodolphe Demont, notary at Moudon, during the period 1517-1561. There are also tangential mentions of such a connection in the terriers. In any event, the settlement of 30 may 1569 came about as a result of a protest by the Demont family with respect ot the partage of the Dutoit brothers executed in 1568. The Demont family seems to have had an interest in some of the properties so divided, and wanted to void the partage. The settlement held that the partage was valid, but that the Dutoit brothers could not dispose of the property except by selling it to each other or to their heirs. In all probability, the brothers probably settled among themselves in exactly this way, because we find no mention of Guillaume in the terrier ACV Fn 347 (1592), even though his descendants were very much alive.

Now, the partage and related documents of 1568, involving the five sons of the late "Nicod", specify repeatedly that the wife of the surviving Nicod is Fran�oise Veyre. However, the marriage record of 08 feb 1538 (or possibly to be interpreted as 1539, it is not entirely clear whether the notary was reckoning the year from January 1 or from March 25) specifies that the father of the husband of Fran�oise Veyre, daughter of the late Roulx, was Pierre Dutoit, and this is repeated in the contract executed the same day for the marriage of Antheyne Veyre, also daughter of the late Roulx, to Claude son of Pierre Dutoit. It seems unlikely that it is simply a matter of two different women of the same name, whose fathers were two different men who also happened to have the same name. Instead, it may be that the later notaries in the 1560's were confused about the name of the long-dead father of the five brothers. Possibly the surviving terriers of Chavannes will provide a solution to these contradictions.

The sale of 1569 is also important because of the notation it bears, indicating that a copy was made at a later date for Jaques, son of the late Fran�ois Dutoit, one of the parties to the document. This notation reveals the true parentage of the Fran�ois Dutoit who married into the Maillard family. No other Jaques son of Fran�ois is documented at this period. Moreover, the copy that Jaques Dutoit requested turns out to concern a later dispute resolved in 1618, which has the added benefit of establishing the parentage of the Billet branch.

We get some idea of the purpose of the copy of the document of 1569 that was made for Jaques son of the late Fran�ois Dutoit in a document of 18 feb 1618 recorded by Denis Pivard, notary at Moudon, which involves a settlement between two parties:

  1. Jean son of the late Rod Dutoit dit Billet, with his brother Abraham, and his (Abraham's) son David;
  2. Jaques son of the late Fran�ois Dutoit dit Maillard, with his "beaufr�re" Eg. Jaques Pidoux.
It appears that Jean Dutoit thought that Jaques owed him 1/5th of a feudal "cense" or tithe, and 1/3rd part of another, as a result of inheritance of 1/3rd part of the estate of the late Johannod Dutoit.

We know of only one Pidoux or Puidoux connected to any Dutoit at such an early date. In 1619, Andr� Dutoit, son of the late Claude "le jeune", married Fran�oise Pidoux. However, that would not make Jaques Pidoux a "beaufr�re" even if he were the brother of Fran�oise. So, it is most likely that one of the siblings of Jaques must have married a Pidoux, so far undiscovered. (Another possibility, not yet ruled out, is that Jaques Dutoit's well-documented wife "Evaz" was a Pidoux! Her surname has not yet been found.)

To add to the confusion, or perhaps eventually to clarify it, we find a listing in the tax rolls of 1550 (ACV Bp 14/1 fol. 62v) for "Nicod du Tey, les biens de luy et de ses freres" valued at 1021 florins, implying very strongly that the five or six brothers had already come into their inheritance by that date, and now held their property jointly. This record also carries the implication that Nicod was the eldest of the brothers. (It was not unusual at that period for siblings to keep their inheritance undivided for many years, sometimes for decades. In the case of the Gachet family of Payerne, for example, the father died in 1528, but the seven sons did not divide the property until 1560. This case is unusual because the dates are so well documented, but we have found many families where an estate was held jointly over a very long period.)

The isolated records mentioning Nicod and his own family after about 1560 are vague. In the absence of better candidates, he seems to be the one whose daughter Catherine married Jean Buttet of Ferlin 06 nov 1575 at M�zi�res. Nicod is implicated in a dispute over taxes (1618, Denis Pivard, notary) as the father of Rod Dutoit, first known member of the dit Billet branch of the Dutoit family. If that is correct, Rod would have to be the only son of Nicod who left male descendants surviving in 1618.

He is likely also the Nicod son of the late Pierre Dutoit who made a reconnaissance in the terrier ACV Fn 347 (fol. 263) on 22 mar 1592, for property previously recognized by Pierre and Jean, sons of the late Nicod Dutoit, in a previous terrier compiled by Fran�ois Collon (the date of the latter terrier is not known, but it could be as early as 1540 or as late as 1560). Among other reasons for this identification, none of the children of this Nicod are mentioned in this terrier, which appears to include all of the heads of families at Chavannes, and there is no other Nicod son of Pierre known there. Further study of Fn 347 is certainly warranted.

Both of these reconnaissances are dated 10 feb 1459.

Nicolas DUTOIT       (ID #I1900)

Only a few mentions found so far: marriage, baptism of his daughter, and a reference in 1590 indicating he has already died. His uncle Jaques, and Thomas son of the late Mauris DuThey appear in his marriage contract, 20 jan 1586, Pierre George notary. From the date, we wonder if an early compiler of the Moudon registers was confused about old-style dates. If this happened, the date problem with the children of Fran�ois Dutoit would be resolved. However, we have been unable to find definitive evidence one way or the other.

The date problem in this case is as follows:

If the compiler of the Moudon parish registers was holding to "old-style" dates, or if the existing register was compiled from records created by one or more persons who still placed the new year at March 25, we would find that some or all marriage and birth dates between January 1 and March 24 were one year too early. We might even find that only dates from a few years were affected. If there is uncertainty in the year, then it might be possible to explain why the birthdates of two of the children on Fran�ois Dutoit and Claudine Maillard seem too close together (Joseph, baptised 16 may 1572, and Adam, baptised 14 jan 1573). If there were a general rule, however, it would make their sons David (baptised 08 jan 1571) and Joseph (baptised 16 may 1572) too close.

A second point needs to be made about the surviving registers. Many of the church records of Canton Vaud, including those of Moudon, appear to be compiled from other records. In a few cases (not a Moudon, though), there exist both a working copy, with entries in different hands or evidently made at different times, and an old fair copy, neatly laid out, and often with flourishes that indicate it was intended as a permanent record. The fair copies sometimes show signs of their genesis, too, such as entries inadvertently skipped and then added at a later point with a notation that they were "copied" out of order. There are also references in some of the registers implying that the minister or deacon might have written down the day's activities on a slip of paper and then copied the accumulated entries into a formal register at a later time. This practice inevitably led to occasional confusion, a single entry being duplicated verbatim, except for the month or year, in two places in the same register. Thus, the registers of baptisms, marriages, and burials cannot be regarded as infallible primary sources. They are compiled records of varying reliability that has to be assessed on a case-by-case basis.

In the absence of evidence, we are left with uncertainty: either Joseph or Adam belongs to a different set of parents (child of another Fran�ois, or else illegitimate or adopted), or at least one of the dates is in error.

During our research on the Dutoit family, more marriage contracts have been compared to the dates listed in the church registers. There do not seem to be more than one or two instances in which the contract, in the period 1565-1590, is one year later than the corresponding entry in the register. Most of the contracts agree with the church records, the marriage normally being celebrated a few days after the contract was signed. Eventually, we hope to make a more systematic comparison based on an inventory of the surviving marriage contracts.

A further difficulty in the case of Nicolas Dutoit and his marriage contract, we had no record of an uncle Jaques, supposed to be a brother of the father of Nicolas. This problem could be resolved indirectly, if Fran�ois had a sister who married one of the Jaques Dutoits, or if a sibling or half-sibling of the wife of Fran�ois had done so. However, there seems to be no mention of a Jaques in the transactions that name Fran�ois with his brothers around 1560. There was also the possibility of error in the preparation of the marriage contract: in one place, Jaques calls the bride his sister-in-law, while calling Nicolas his nephew. Was it possible the notary, Pierre George, was simply confused by the crowd of Dutoits who were present for the signing of the contract and so misidentified Jaques in a couple places while drafting the document? Further study reveals the answer: Jaques son of Claude (the man apparently known as "Gros Jaques") was married to Marie Pache, sister of the bride of Nicolas Dutoit! Therefore, Jaques could be the uncle of Nicolas (if Nicolas is the son of Fran�ois brother of Jaques) and still call the wife of Nicolas his "sister-in-law".

The concern about which reading is correct is prompted by a few mentions around 1600 of a Fran�ois son of Claude Dutoit, who might be the brother of "Gros Jaques" Dutoit. It now seems entirely plausible that Fran�ois son of Claude is the true father of some of the children here attributed to Fran�ois son of Pierre Dutoit. This uncertainty extends even to Daniel and David Dutoit, brothers, known to be sons of Fran�ois, because Daniel appears at least once with his "uncle Jaques son of the late Claude Dutoit"! The records for this period need to be studied further in hopes of resolving these problems.

Nicolas, however, is certainly one of the children who must be assigned to Fran�ois son of Claude instead of Fran�ois son of Nicod (Pierre).

The marriage contract gives the impression that the groom was committing every bit of money he could scrape together to clinch the deal, down the the last 6 sols. However, a better explanation is that in many cases, the groom's contribution is found to be exactly half of the bride's contribution. This was probably expected under the prevailing "Coutumier de Moudon", the code of rights, privileges, rules, and regulations of the city of Moudon.

Nicolletus DUTOIT       (ID #I5893)

In a document recorded by Michel Frossard, 22 mar 1504, Nycolletus de Tecto de Villardoz Terroux filius Glaudii de Tecto filii quondam Jacobi de Tecto deeded his interest in any (future) inheritance from his parents or brothers to his brother Claude Dutoit (ACV DL 43/3, fol. 62). Nothing further is heard of him in the records of Moudon, and we assume he died before his father made his testament in 1524. The place in question is modern Villars-le-Terroir, a parish in the district of Echallens that remained Catholic during the Bernese occupation, and so we have here the origin of the Catholic Dutoit families in the area near Echallens.

Unfortunately, very little remains of the early records of the notaries of the district of Echallens. There is only one fragmentary register of the notary Jean Cl�ment covering approximately 1484-1502, but it contains five transactions mentioning Nicolletus Detecto, 1496-1500. The coincidence of names makes us suppose that these are the same parties to the transaction of 1504, still the only evidence relating to the possible origin of the Dutoit family of Echallens. One of the transactions, dated Feast of the Ascension, 1500, names Marguerite daughter of the late Nycodi Gleys of Paliez (an old variant of Pailly) or possibly Paluz (Praz-Paluz, a toponym at Echallens?) as the wife of Nycolletus Detecto. In none of these documents is Nycolletus identified in any way except as a resident of Villard luz Terrioux. There is also an oblique reference to a Claudius Detecto, but his relationship to Nycolletus appears not to be stated. There are several terriers (ACV S�rie Fp) that should provide more information.

In Fp 225, fol. 68, with signature of commissaire Saturninus Ruffy, there is a reconnaissance in Latin for Nicoletus douz They de Villard louz Terriouz, dated 05 may 1501, to Stephanus Loys, de tenememnto alias per Petrum Vuippens de Villard louz Terrioux Nobili Isabelle filie condam Spectabilis Francisci de Bussy militis recognito 10 may 1449 (terrier of Anthonius Comitis. Marginal notes indicate the properties were subsequently held by Fran�ois fils de Jean Duthey. The reconnaissance includes properties from other sources as well. (Fp 5 appears to be a copy of Fp 225.)

Fp 10 reveals another layer of the story: (fols. 143-156v, 06 feb 1516) "Recognitio Nicoleti Mestraulx alias du Tey filii quondam Glaudii du Tey et quondam Johannete filie quondam Nycoleti Mestraulx de Villars le Terrioux. Nicolletus Mestraulx alias du Tey filius quondam Glaudii du Tey et quondam Johannete filie quondam Nycoleti Mestraulx de Villars le Terrioux sciens, prudens, et spontaneus, non vi, non dolo, non metu ductus, nec aliquo fraudis ingenio circumventus aut subornatus..., coram nobis Anthonio Krumenstoll burgense Friburgi a presenti baillivo Orbe et castellano de Eschallens, et Luca Cumayne clerico habitatore Concise in dominio Grandissoni... commissariis et generalibus receptoribus extentarum et recognitiarum magnificorum potentissimorum et metuendissimorum dominorum, dominorum nostrorum urbium Bernensis et Friburgensis in eorum dominiis et mandamentis predictorum locorum Orbe et Eschallens specialiter ab eisdem deputatis, confitetur ... se esse velleque esse et esse debere pro se et suis heredibus et successoribus quibuscunque himine liberum... et se tenere velleque tenere et debere tenere pro se et sups quibus supra... , videlicet res et possessiones sequentes... sibi ex legitima successione materna deventas, olim in precedentibus extentis receptis per Peronetum Foresii tunc commissarium dicti dominii et mandamenti d'Eschallens recognitas, Et primo, medieatem domus antique dicti quondam Nycoleti Mestraulx partite et divise cum Petro Mestraulx herede in medietate dicti quondam Nycoleti..." There are many properties, most held jointly with the other Mestraulx.

A later terrier, Fp 216 (1564), shows some of the descendants: Claude du They, fol. 23; Bernard fils de Pierre du They, fol. 63; Legier du They, fol. 72, without much additional information.

Fp 217, from 1501-1502, commissaire Andreas Theyserens, contains a reconnaissance for Nicolletus de Tecto de Villart luz Terriouz, to Nobilis Johannes de Gumoens, for property purchased from others, as well as property held jointly with various members of the Mistralis family, 25 may 1501.

Nycodus DUTOIT       (ID #I5848)

The Dutoit family must have been in Chavannes-sur-Moudon prior to the development of surnames. A document preserved at the archives of Moudon, dated 31 aug 1356, involves a sale by Estienne Dutoit son of Pierre (or Perrod) Dutoit dit D'Ogo of Chavannes. Estienne was a merchant who resided at Estavayer. There is, however, a 100-year gap between him and the earliest connected genealogy we have been able to assemble for this family. Even earlier mentions are found in the collection of documents from the Cerjat family (ACV P Cerjat (I)). The earliest one discovered so far is dated 23 nov 1343, a sale by Nicod Dutoit and Jordanne widow of Jean Dutoit (who was the uncle of Nicod) to Nicollete, widow of Perrod Arma, all of Chavannes-sur-Moudon.

In early documents, the surname is most often rendered in Latin as De Tecto, a literal translation of "du toit". In the old script, it is sometimes difficult to distinguish the small letters "c" and "t", so it is possible that some names such as "De Tetto" (Johannes De Tetto, salt merchant and citizen of Lausanne, mentioned in the testament of his widow Guillermette, 05 feb 1407, AVL PT 14/47) might also be read as De Tecto.

There is very clear evidence for his sons Jacobus and Roletus in the terriers (e.g., Fn 323, dates in 1493, where Jacobus had been succeeded by his son Petrus, and Roletus by his sons Guido and Nycodus). The evidence for the other children needs to be reviewed carefully, as it is possible that they belong to a later generation, or to a different Nycodus. The evidence for the son Johannes seems strong, as his only son Petrus had died before the terrier Fn 27 (1459), leaving no sons, so that his properties descended through Agnes, daughter of Petrus, who married twice. There is much less evidence for a son Petrus, but the dates are in question. Much more investigation is needed in the terriers and other documents from the 14th and 15th Centuries.

Olivier DUTOIT       (ID #I4437)

Mentioned as brother of Antoine Louis Dutoit at baptism in 1736. This seems to be the same Olivier who died unmarried at Moudon. He is mentioned in a few other notarial records, but without any genealogical particulars. A record of Jean Daniel Crausaz, notary at Moudon, 26 jan 1726, regarding public sale of property belonging to Antoine Golay, includes a buyer described as Jean Jaques Dutoit of Chavannes for his brothers Olivier and Antoine Louis Dutoit, thus identifying an otherwise unknown brother.
