It is tempting to believe that Esther may have been a half-sister of Jaquemaz, first wife of Isaac Margueron. However, parish records of Lucens, which only begin in 1639, do not reveal the parentage of either woman. A document of Isaac Jacob Briod (06 dec 1699) involves Esther and Susanne Marie, daughters of Isaac Margueron, with advice from their brother Jaques Margueron, and their maternal uncle Thomas Dutoit. The document specifies very clearly that Thomas is the maternal uncle of Jaques as well as of Esther and Susanne Marie—and we know from the church records that do exist that Jaques Margueron's mother was Jaquemaz Dutoit, not Esther Dutoit. Esther is last noted alive (so far as we know) in 1691, as the widow of the late Isaac Margueron. A separate document in 1699 has Jaques Margueron, "justicier et conseiller de Lucens", selling to Egrège Estienne Pillard (also conseiller) a plot of land next to a garden that Pillard recently acquired from Susanne Marie and Esther, daughters of the late Isaac Margueron. From this document, we want to infer that Jaques is the same son of Isaac and Jaquemaz who was baptised in 1641, and that Susanne Marie and Esther are the only surviving children of Isaac Margueron and Esther Dutoit, his second wife.

In the documents of this period, Estienne Pillard appears frequently in assocation with Esther Dutoit. However, his wife Ursule Amiet is cited continuously from 1678 until his death in 1712, so it appears he was simply a neighbor and friend who used his authority to assist Esther in the many legal matters that she had to endure.

We have found the baptism of Susanne Marie in 1668, about two years after Isaac and Esther were married. The baptism of the other daughter, Esther, has not been found, but we also have a baptism of Pierre Anthoine in 1673, claiming to be the son of Isaac Margueron and Esther his wife, with one of the sponsors being Esther Dutoit!

Esther's birthdate is estimated from the dates of her children, her marriages, and the dates of her siblings. There is no baptism for Esther daughter of Jean Dutoit, but there is an otherwise unassignable baptism for Esther daughter of Antoine Dutoit of Chavannes 02 jul 1637 (the name of the mother is not given), with sponsors Thomas Dutoit and his wife Esther (DuCrest). This is interesting, since the same Thomas Dutoit was also a sponsor at the baptism of Esther's brother in 1634 (both parents are named in the latter record). Perhaps the baptism of 1637 is another example of the many errors that have been discovered in the church registers at Moudon.

Meanwhile, the notarial records refer to the "discution des biens" (a phrase usually indicating settlement of an estate) of Isaac Margueron in 1671. However, it is now clear that the "discution des biens" in this case was a settlement with his creditors, his various properties having been auctioned off or forfeited to repay his debts.

One solution to the problem of the extra son, Pierre Anthoine, is to assume that he was in fact the son of Jaques (not Isaac) Margueron and his wife Esther Buttin. This sort of error is common enough in the parish registers. It is possible it can be confirmed if later records mentioning the parentage of Pierre Anthoine can be found. Therefore, we have moved Pierre Anthoine to the family of Jaques Margueron. If the parents of Pierre Anthoine are actually Jaques Margueron and Esther Buttin, then the sponsor Esther Dutoit is the wife of Isaac Margueron, and thus Pierre Anthoine's grandmother.

The parentage of this Esther seemed at first to be settled by the testament of Susanne Masset, wife of "Egrège et Provide" Anthoine Dutoit, juge, etc. (10 mar 1649, Benoit Giraudet, notary), naming her sons and daughters. This document establishes that Esther, daughter of Susanne Masset, had a brother Thomas, as required by the other documents cited above. But this Esther (b. 1613), the daughter of Anthoine and Susanne, would be much too old to have children by Jules Croserens and Isaac Margueron, and this Thomas (b. 1611) died in the 1650's. So we must look for a later Thomas Dutoit as the brother of a later Esther, for the key to her parentage.

The marriage of Esther Dutoit and Jules Croserens is not recorded at Moudon. It might have been recorded at Lutry, seat of the Croserens, but there is a long gap in the church records there. Her second marriage, to Isaac Margueron, is recorded at Moudon rather than Isaac's hometown of Lucens, which would seem to indicate that Esther's family still lived at Moudon by 1666. The marriage of her brother Thomas, sometime before 1659, has not been found. Among the witnesses at the baptism of Esther's first known child, Jean Pierre André Croserens, are Agathe d'Estavayer, daugher of Philippe d'Estavayer and Jeanne Masset, and thus related to the Dutoit family through Susanne Masset, wife of Anthoine the Banderet, and through Barbille Masset, wife of one of the Jaques. Also at the same baptism are Jean and Pierre Dutoit, of which the latter is probably the same Pierre whose son André was baptised in 1662 in the presence also of Agathe d'Estavayer. None of these connections has been explained.

We thought we had found the brother Thomas in the son of Abraham Dutoit and Pernon Veyre. This Thomas (born about 1651) is first mentioned in 1667, apparently the youngest of four brothers, all sons of Abraham Dutoit. The birth of this Thomas is not recorded at Moudon. We thought he might be Thomas the "Grand Voyer" and "intendant des chemins du Pays de Vaud" mentioned in 1691, but Thomas the "Grand Voyer" delegated some of his duties due to the "infirmities of his age" in 1695, suggesting that the "Grand Voyer" is an older man than the Thomas born in 1651. The Thomas born in 1651 is conclusively rejected, however, upon finding the marriage settlement of Isaac and Esther recorded by an unknown notary 18 dec 1667 (see below), wherein she is identified as the daughter of the late Jean Dutoit, and assisted by her brother Thomas Dutoit, Châtelain de Syens. Clearly, we are looking for a Thomas who is considerably older than the son of Abraham, and we therefore come to the conclusion that he was none other than the Grand Voyer himself.

The only remaining Thomas in the baptismal records, and the only one remaining who could also be the Grand Voyer, is the son of Jean Dutoit, "guererier" (?), and Catherine Bosson, possibly a daughter of Michel Bosson, surgeon (?). This suggests a solution to the relationships listed in a document recorded by Jaques Crausaz, 17 nov 1691, as well as the testament of Susanne Bosson, widow of the late Jaques Chatelanat, recorded by Isaac Dutoit, 17 sep 1688. Crausaz says that Daniel François Chatelanat and Michel Bridel were "relatives" of Esther Dutoit, wife of Isaac Margueron. Since the testament says that Susanne Bosson was the mother of Daniel François Chatelanat and the mother-in-law of Michel Bridel, the relationship (albeit a loose one) to Esther Dutoit would arise if Susanne and Catherine Bosson were sisters. No other solution has been found. Moreover, a document recorded in 1686 by Jaques Crausaz notes that Daniel François Chatelanat's wife was Estiennaz Dutoit, whose identity has likewise not been established. (Note that the generally accepted term for a healer is "guérisseur". The meaning of "guererier," as written in the baptismal register, remains unclear.)

Probably the best way to estimate Esther's date of birth is to try to make deductions based on the age of her first husband. Jules Croserens was apparently still a minor as late as 1647, when his mother agreed to pay his expenses while he stayed in Bern with Jean Philippe Grobety, probably an uncle. He was probably attending school at that time, thus in his early teens. He was probably married to Esther about 1660, and must have had time for either a prior marriage or an illegitimate liaison that produced his daughter Isbrande. Further, Jules and his brother and sister all appear to have reached the age of majority by 1655, when they executed a partage in their own names, without the assistance of a guardian. Most likely, that means Jules was born about 1630. Esther was probably a few years younger, thus born around 1635. If we have correctly identified her mother as Catherine Bosson, the most likely date would be about 1637, making Esther 25 years of age when her first son was born.

The circumstances that ended her marriage to Jules Croserens have not yet been discovered. The record of her second marriage says that she was "delaissée" (in effect, abandoned) by her first husband, and that a divorce had been granted by the Supreme Consistory of Bern. The records of the Supreme Consistory of Bern revealed a little more, and there are probably more details in the records of the consistory of Lutry (not yet located or examined). We learn a bit more from documents recorded at Lutry:

If the documents are correct, Esther had left Lutry with her young son Jean Pierre André Croserens, and was living in Moudon with her mother (unfortunately, not named in these documents—Esther's father can be inferred from the wording already to have died). Since her son was actually baptised in Moudon, we suppose that her husband had left before the son's birth, and that she lived with her mother during her pregnancy. She was unable to pay the small taxes on property at Lutry that had been awarded to her son in the settlement of her first husband's debts. Exactly what happened to Jules has not been determined, but the documents suggest that he had gone abroad and had not returned. Perhaps to avoid his debts? Or to seek his fortune? Or something more sinister? The divorce decree, retrieved by Therese Metzger from the minutes of the Oberchorgericht or Suprème Consistoire, implies that Jules fled because he was accused of some criminal act. For the details, we will have to consult the minutes of the Consistoire de Lutry and the communal archives. (For reasons yet to be explained, the archives of Moudon also has papers of some sort relating to the Croserens family, but of what generation, we do not know.)

Jules had a daughter Isbrande, probably by a prior wife of whom we have no other evidence, since she had a different guardian and apparently also different property from young Jean Pierre.

Among the records of an unknown notary of Moudon (AVC DL 91/8, fol. 186b, 18 dec 1667), is an acknowlegement of the fulfillment of Esther's second marriage contract. The contract itself was apparently recorded by Abraham Faucherres, but does not seem to have survived. (Anne Bohy very kindly offered her assistance in some of the more difficult passages. In spite of our best efforts, there are still a few words that remain in question, mostly concerning household items.)

That he undertook this mission at all seems difficult to understand unless Esther was closely related to Isaac's first wife, Jaquemaz Dutoit. Isaac is not known to have had any other connection to the Dutoit family, none of whom lived in Lucens.]. It is especially noteworthy that Isaac Margueron mentions his trips to Lutry and Bern on Esther's behalf. Assuming he was at that point her brother-in-law, husband of Esther's late sister Jaquemaz, it is implied here that he helped the young mother through the legal difficulties that arose from the termination of her first marriage. It was this passage that first suggested it would be useful to examine the surviving records of the notaries of Lutry from that period.

There is still one obstacle to the conclusion that the two wives of Isaac Margueron were half-sisters. Their Excellencies of Bern issued very detailed prohibitions about forbidden degrees of consanguinity in marriage, the major provisions of which can be found in the recent publication of Regula Matzinger-Pfister, Les sources du droit du Canton de Vaud. C. Epoque bernoise. I. Les mandats généraux bernois pour le Pays de Vaud, 1536-1798, Basel: Schwabe & Co., 2003. A long mandate concerning marriage was issued in 1537. Under the heading, "Lesqueuls à cause de consanguinité se peulvent prendre en mariage," we find the following paragraph:

La fillie ne prendra point en mariage: son grand-pere, son pere, son parestre [parrain, or godparent], le filz du filz de son parestre, le filz de la fillie de son parestre, son frere de pere et de mere, son beaulx frere d'apart pere ou mere seul, son filz, le filz de son filz, le filz de sa fillie, le frere de son pere, le frere de sa mere, le mary de la seur de son pere, le mary de la seur à sa mere, le mary de sa fillie, le mary de sa seur, le filz de son mary, le filz du filz de son mary, le filz de la fillie de son mary, le frere de son mary, le pere de son mary.

The highlighted passage is, unfortunately, somewhat ambiguous. It might be construed, because of it's location in the series of prohibitions, to mean that a woman cannot marry her half-brother; that is, not only may she not marry her brother by her father and mother (the previous item in the list), but she may also not marry her half-brother by either her father or mother. The more common usage of beau-frère is for brother-in-law (as understood in modern English), but, as in earlier usage in English, this term could also mean step-brother. If the latter was the intended usage, and if the term "sister" elsewhere in the list does not include half-sisters unless further qualified, then there is one prohibition that is missing, regarding the marriage of a woman to the former husband of her half-sister. It is possible that the original version of this document, in German, would settle the question, but this document seems not to have been published (AEB WMissB B, fol. 28-42). Therefore, while we can see one interpretation that would allow Isaac to marry his first wife's half-sister, a different interpretation is possible that would indicate our solution to this genealogical puzzle is incorrect.

Esther's two daughters by Isaac Margueron are next found, apparently, in Vevey, where both married rather late in life. What drew them to Vevey is not known.

The baptism clearly indicates parents as Daniel Dutoit and Jeanne Wagnieres, with witnesses Anthoine Dutoit, banderet, and Esther DuCrest, wife of Thomas Dutoit. Were it not so clear, it would be tempting to believe that this Esther is the second wife of Isaac Margueron.

She may have been the Estiennaz who was the daughter of Thomas Dutoit and Esther DuCrest, baptised in 1647. However, she and her husband sold land at Chavannes to "Isaac Dutoit son of the late Abraham Dutoit" in 1686, followed immediately in the register of the notary Jaques Crausaz (ACV DL 24/1) by another sale in the same area adjacent to the heirs of "Abraham Dutoit dit Baud". The relationships among these families are not presently known.

The document of most interest so far discovered follows:

Notoire soit a tous, comme le neufvieme jour de mois d'Aoust, l'an de grace Courant mille six cents huictante six, par devant le Notaire & les tesmoings cy baz nommés, soit constitué honnorable Daniel François Chastellanat, Chyrurgien et bourgeois de Moudon, agissant au nom & comme personne conjointe d'honnorée Estiennaz Duthoict sa femme avec promesse de la faire advenir & rattiffier par authorisation requise, Sçachant & bien advisé, A vendu, quitté, remis et habandonné purement & perpetuellement, A honnorable Isaac fils de feu honnorable Abraham Dutoict de Chavanes & bourgeois dudit Moudon present & acceptant, Assavoir l'environ d'une poze & demi de terre riere ledit Chavanes en la Fin de la Battaille, lieudit en Dury, Jouxte la terre des hoirs de feu Daniel Duthoict dit André d'orient, la chemin soit charriere publique d'occident, la terre de Monsieur le Ministre Isaac Nicaty de vent & bize, Avec ses fonds, fruicts, droicts, appartenances & despendances quelconques, Et a esté faite & passé la presente Vendition pour & moyennant la somme de Cent florins pps. She had a brother Samuel, dead by 1744. He left a widow, but her name was not mentioned in the document explaining these relationships, 20 apr 1744, Daniel Antoine Jossevel, notary at Moudon. This is the evidence that leads us to identify the wife of Antoine Dutoit, Officier de Chavannes, with the daughter of Baltazard Dutoit and Estiennaz DuPuis.

Baptised as Jeanne Marie, but this seems to be the daughter of François Dutoit of Neyruz who married first Philippe Rosset and then Denis Samuel Dutoit. Transactions among her heirs were recorded in 1741 by Daniel Antoine Jossevel, notary at Moudon. Her testament was recorded by Jaques David Burnand, notary at Moudon, naming brothers Pierre and Daniel, her sister Jeanne Marie, wife of Jean Papaux, and heirs of her deceased brother Abraham (dated 12 apr 1741, probated 19 apr 1741).
