The parents of Samuel Smith both died  by the time he was very young.. John Wyat, his uncle, became the guardian for both Samuel Smith and his older brother, Maurice Smith.  In 1709 in a suit in Essex Co.,VA, John Wyat, guardian of Maruice and Samuel Smith, orphans, is attempting to oust Thomas Meriwether from lands that appear to belong to the orphans.

In 1713 (Court Orders p. 163) Samuel Smith chose his brother John Smith as his guardian for the time he left in his mnority.

In the Name of God Amen I Samuel Smith of Essex County being sick and weak of body but of perfect sense and memory doe make this my last Will and Testament in manner and form as followeth:
   Item I give unto my Son John Smith all my lands to him and his heirs for ever
   Item I give to my Son Samuel Smith twenty five pounds Sterlg money of England to be paid him by my Executors when he comes to the age of twenty one years but in case my said Son should die before he come to age my will and desire is that the twenty five pounds above mentioned be equally divided between my loving Wife Ann Smith and my other three children (Vizt) John and Jean and Mary Smith
   Item my will & desire is that all my negros and all my other Estate be equally divided between my loving Wife Ann Smith and my four children (Vizt) John Smith, Jean Smith, Samuuel Smith, and Mary Smith and to them I give my Estate and to their heirs forever.
   Item I doe appoint my loveing Wife Ann Smith and my Brother Maurice Smith and my Kindsman Rice Jones to be my hole and sole Executors and Executrix of this my last Will and Testament uterly revoking all other Will and Testaments.  In Witness whereof I have hereunto set my hand and Seal this Twenty Eight day of October in the year of our Lord one thousand seven hundred thirty and four.

At A Court held for Essex County at Tappa. on the XVII day of May MDCCXXXVII
This last Will and Testament of Samuel Smith deced was presented in Court by Ann Smith Executrix therein named who made oath thereto.  And being further proved by the oath of Charles Waller one of the witnesses thereto (who also declared that he say the other witnesses sign the name) is admitted to record.
