Evidence of the claim of Susanna Tagert widow of Jacob Tagert late of Sumpter County deceased, and the heirs of the said Jacob Tagert dec’d to the North West q of Section 11 in Township 18 Range 1 East u__n(?)  the pre-emption law of the 19 June 1834 –

Before me Charles H Drummond of the county of Marengo personally came & appeared Susanna Tagert widow of Jacob Tagert deceased who being first duly sworn deposes and answers to the interrogations propounded to her by the Register and Receiver as follows to wit –

          Intg 1st – Did your husband Jacob Tagert in his lifetime cultivate any part of the above described q section of land in the year 1833 __ ___ __ posses____(? paper torn) of the pre emption law of the19 June 1834 and of the _______ _____(?) in pursuance _____(?)

Answer – My husband Jacob Tagert purchased an improvement on said q section which was cultivated in corn in 1833 __(?)   S___-_____(?) upon the same with his family in January last and resided upon & cultivated a portion of said q section on the 19 June 1834 & had a dwelling house thereon.  My husband Jacob Tagert departed this life since the 19 June 1834 to wit  about the 8 or 10 October 1834 –

          Intg 2nd – Did any other person in like manner cultivate upon said q section –

          Answer – No other person –

          Received from Susana Tagert Widow of Jacob Tagert dec’d of Sumpter County the sum of two hundred dollars and thirty nine cents being in full payment for  N W q of Section No. Eleven Township No. Eighteen of Range one East containing one hundred and sixty acres, at the rate of 1.25 per acre.

                            Preemption Act of 1834

          IT IS HEREBY CERTIFIED, That, in pursuance of law Susanna Tagert widow of Jacob Tagert dec’d of Sumter county state of Ala on this day purchased of the Register of this office, the lot or North West quarter of section number Eleven in township number eighteen in Range number one East containing one hundred & sixty 11/100 acres, at the rate of one dollar and twenty five cents per acre, amounting to two hundred dollars and thirty nine cents, for which the said Susanna Tagert has made payment in full according to law.

          NOW THEREFORE BE IT KNOWN, That, on presentation of this certificate to the Commissioner of the General Land Office, the said Susanna Tagert  shall be entitled to receive a patent for the lot above described.

                    For value received I Susanna Tagert, widow of Jacob Tagert dec’d of Sumter County Alabama do hereby assign transfer and set over unto Francis S. Lyon of Marengo County Alabama, all my right title claim and demand to a tract of land purchased by me on the 13th day of November 1834 as per Receivers Receipt No. 2903 designated as the North West quarter of section No Eleven in Township No Eighteen of Range No One East situate in the district of Land subject to sale at Demopolis, Ala and reques that a patent may be issued to Francis S Lyon his heirs or assigns.

                    Witness my hand this thirtieth day of November 1835

James Roberts                                     Know all men by these presents that I Isaac Cavender of the County and State Aforesaid hath made and constituted James Roberts of the County and State Aforesaid my lawful attorney for me and in my place to act According to law in my business particularly in the land whereon I now reside said land numbered as follows Sec No 8 To No 8 Ra 5 East in Rankin County said land Entered in the name of Susannah Taget of Rankin County Miss Dec 25th 1844 now therefore I the said Isaac Cavender lawful guardian of the said Susannah Tagets Bodily heirs hath vested in the said James Roberts all the legal power of a Guardian to act in my place at his discretion to rent said land for one year or more as he may think best for the benefit of the estate and also the necessary Improvements made on said land and also pay for the same out of the rent of said land and also to present to the Probate Court for allowance on my account for Keeping and raising the first children of my wife the said Susannah Taget for the t___? of years _______? on my account Against said children provided(?) ___ ___ ____ __ ___ should the said heirs to it John Wesley Taget William Asbury Taget and Sarah Elizabeth Taget peaceably consent to give to me the Rent of said land Above named for the years of 1850 and 1851 then in such case said land to be sold at Administration sale And after all expense of the Administration the neat proceeds to be divided Amongst the bodily heirs of the said Susanna Tagets first children of James West(land?) Taget John Wesley Taget William Asbury Tagett Sarah Elizabeth Taget And also her Bodily heirs as follows Isaac Cavender George Cavender Green Cavender Thomas Jefferson Cavender and Susanna Katherine Cavender, Signed and acknowledged this 12th day of November 1850

                                       Samuel Davis who being duly sworn deposeth and says that he saw the within named Isaac Cavender sign seal and deliver the foregoing power of Attorney for the purpose therein contained as his voluntary act and deed           This 28th  (the last line is missing from this transcription, but it is on file at the Rankin County Courthouse in Brandon, MS   Isaac Cavender & family are enumerated on the 1850 census, but the enumerator mistakenly spelled the name, Cavinah. The widow Susannah Tagert, his first wife, died sometime before 1848. They were married in 1836 in Rankin county. Her first husband Jacob Tagert, died in October 1834 in Sumter county Aalabama. Isaac Cavender was married to the widow Susan Kennard circa 1848)
