Whereas a controversy has risen between Jane Deggs
formerly Jane Jamerson wife of Jered Deggs
and
Susan Ghoalson
formerly Lawrence County SS)
Susan Jamerson, Joseph Jamerson, David R (or K?) Jamerson and
Harvey Jamerson who except the said Isrel Deggs are the heirs and
distributors of Martha Jamerson deceased, about the title of
certain Negro slaves named Emaline, William Garland, General
Scott, and Mary-Jane four in number. The said Jane Deggs claiming
said slaves as her own property and the said Susan, said Joseph,
said David R/K, and said Harvey claiming said slaves as the
property of said Martha Jamerson deceased at her death and the
children of the slave said Emaline born since the death of said
Martha Jamerson and whereas it is the wish and desire of the said
Jane Deggs, the said Susan Gholson, the said Joseph Jamerson, the
said David R Jamerson, and the said Harvey Jamerson to adjust and
compromise said controversy about the title of said slaves
Emaline who is a woman and the said William Garland, General
Scott, and Mary Jane, the three last mentioned slaves being the
children of said woman Emmaline and avoid a settlement of the
same by litigation and the expenses usually attendant on such
litigation now therefore in consideration of the ????? And of the
mutual agreement of the parties thereto. It is mutually hereby
agreed between the parties aforesaid as follows viz the said Jane
Deggs on her part consents and agrees to relinquish and does here
by relinquish and forever abandon all claim to as her own
property, except her right and claim to one distributive share
and interest in and to said slaves and there increase as the
property and Estate of the said Martha Jamerson deceased to which
she is entitled as one of the heirs and distributors of the
Estate of said Martha Jamerson deceased and the said Jane Deggs
hereby consents and agrees that said slaves may be Administered
as the property and estate of said Martha Jamerson deceased
saving to her the right and privileges here in after conceded by
the said Susan, the said Joseph, the said David R and the said
Harvey- and on the part of the said Susan, the said Joseph, the
said ? they consent and agree that the said slaves shall be
administered and disposed of as the property and Estate of the
said Martha Jamerson deceased, and that the said Jane Deggs shall
during her natural life have and enjoy the use or hire of said
slaves and the increase thereof for the sole and seperate Estate
for the sale and seperate use and behoof to dispose of the same
as she pleases, not however so as to or impare the right and
interest of the parties hereto in and to said slaves and there
increase as the property and Estate of said Martha Jamerson
deceased or to defeat the Administration thereof under the
porivsions of this contract- and it is further hereby mutually
agreed by and between all the parties hereto that upon the death
of the said Jane Deggs that said slaves and the increase thereof
shall desend and be distributed as the property and Estate of
said Martha Jamerson, Deceased who was the sister of said Jane
Deggs, said Susan, said Joseph, said David R and said Harvey and
who are the heirs and distributors of the Estate of the said
Martha Jamerson Deceased and it is further understood and agreed
that the said Jane Deggs is to have during her natural life the
use of said slaves and the use or hire of the increase of said
slaves only during her natural life under this contract witness
our hands and seals Nov 29th 1860.
