Carol explained this to me in this way: 
    These are births where people had to come back and obtain a birth certificate because they evidently were not required at the
time of birth, and then they needed them later - likemostly (I think) for when Social Security began.  They had to have 2 witnesses swear to the informationthey gave about their birth. 
    The index is not in order by year, I noticed some from late 1800's way up in book 7!! 
   Also might be a good idea to note that the Probate Birth Index is in order only as the records were obtained.  So that a person does not mistakenly think that they should find very early births in the first couple of pages.  At least this way  a person can see if someone they're looking for was born in Mason Co., and order the birth record copy for $12.00 if they want.

Texas Department of Health -
In 1903, the Bureau of Vital Statistics was created and given the primary responsibility for maintaining a statewide system of vital statistics. Certificates of birth and death were filed by the county clerks and forwarded to the Board of Health. Thus a dual system of registration began which is still in existence today. Even after the Bureau was established, the registration of vital events was haphazard. Not until 1933 did it achieve a level of 90% registration. So many early 1900 records were not timely filed and when families needed a copy of their birth certificate, they would file their records with the county judge as a probate court record. Probate court records were filed from June 1939 to December of 1959 for births which were not recorded at the time of birth. County Judges approved these delayed registrations and forwarded the original certificate to our office.
