Last Will and Testament of JOB ROGERS 

In the name of God, Amen.  I, JOB ROGERS of the County of Weakley and State of Tennessee being infirm in body but of sound mind and memory, thanks be unto God for the same and calling to mind the mortality of the body and knowing that it is appointed for all men once to die, do make and ordain this my last will and testament for the purpose of disposing of such worldly estate as it has pleased God to bless me with and pointing out the manner in which I wish it divided after death and other things.  I recommend my soul unto God that gave it me and my body to the earth from whence it came to be buried in a decent manner Christian like at the discretion of my executors hereafter named nothing doubting but at the resurrection I shall receive such a one as it shall please God to give and as to my estate I give and devise in the following manner. 

Item - My will and desire is that all my just and lawful debts and funeral expenses be paid - 

Item - I gave and devise unto my loving wife AGNES ROGERS one negro girl named MARIAH one horse the choice of my stock of horses, one saddle and bridle, one yoke of oxen, two cows and calves, five head of sheep, four sows and pigs, one feather bed and furniture, one chaney press and its contents, one half dozen sitting chairs, one half dozen knives and forks, one chest, one coffee kettle, one pair of fire dogs, two spinning wheels, two pair of cards, one loom, and kitchen furniture sufficient for her use, one dining table, two ploughs and gear, and one year's provision for herself and family at her own disposal to do as she pleases with - 

(page 180) Item - I lend unto my beloved wife AGNES ROGERS, one negro man named LEWIS, one negro woman, ELIZA, one careall and carriage and gear, one pair cart wheels during the time she remains my widow and no longer then to revert to my estate and be disposed of as I shall hereafter direct.  I also loan her one hundred acres of land to be laid off in the following manner to-wit, beginning at the mouth of Owl Branch and running up the meanders of the same far enough to enclose my dwelling house and one third part of my plantation and timber and fire wood sufficient for her and I lend the same to her during the time she remains my widow and no longer then to revert to my estate to be disposed of as I shall hereafter direct.  None of the property above loaned is to be removed out of Weakley County if such an attempt is made it is no longer to be a loan but immediately to revert to my estate - 

Item - I give and devise unto my two young daughters SARAH JANE BENJAMIN ROGERS and DRUSELLER ALLEN ROGERS three hundred acres of land to be equally divided between them to be laid of in the following manner (viz.) beginning at the mouth of Owl Branch and running up the nearest course of the same sufficiently for so as to just include the hundred acres loaned to my wife AGNES POGERS their mother and so continue on and include two hundred acres more than I loaned my wife AGNES and so include the plantation and timber and fire wood sufficient to support the plantation and to be passed with the two hundred acres.  When either of them marry or arrives at the age of eighteen years old to be equally divided between them and the other hundred (page 181) acres when my wife may marry or decease also to be equally divided between them which I give to them and their heirs begotten of their body forever.  I also give them the nine following negroes to wit one negro man named LEWIS and one negro woman named ELIZA and her child named CATHERINE, one negro girl named EMELINE, one negro boy named HENRY, one negro girl named GRACE, one negro boy named FREEMAN, one negro girl named MARY, one negro girl named MARTHA to be possessed with LEWIS and ELIZA at the marriage or decease of my wife AGNES and the others when either of them marries or either of them arrives to the age of eighteen years old to be equally divided between them except one of the negroes loaned to my wife AGNES their mother should die or become infirm if so my will is my executors hereafter named shall put my wife in possession of one other of the negroes I have given to my two youngest daughters such a one as they may think proper which negro she shall hold so long as she remains my widow and keeps the same in this county and at her marriage or decease I give the whole of the above named negroes to them and the heirs begotten of their body but if either of them should die without heirs begotten of their body and in that case the whole of the property allotted to the one or both of them so doing shall l be divided among the rest of my children which I give to them and their heirs forever - 

I also give unto my two youngest daughters one feather bed and furniture (page 182) apiece, one horse bridle and saddle apiece, two cows and calves apiece, two sows and pigs apiece, two ewes and lambs apiece, one plough and gear apiece, one years provision for themselves and their family of negros allotted to them.  It is also my will they and their property shall remain with my wife AGNES until they shall marry or arrive of the age of eighteen years old except my executors shall think proper to send them to some female institution to receive their education or some other reasonable cause and in that case my will is that my executors here after named shall act at their own discretion to the best advantage for my infant daughters - 

Item - I gave and devise unto my beloved son JOHN W. ROGERS seventy acres of land lying in Dyer County it being part of a six hundred and forty acre tract of land deeded from RICHARD SMITH and JESSEE GILL to JUBILLE ROGERS I also gave him one negro man named DANIEL, one negro girl named MIMA, one negro girl named GILLA, also one horse, bridle and saddle, one feather bed and furniture now in his possession to him and his heirs forever - 

Item - I gave and devise unto beloved son JUBILEE V. ROGERS the five following negroes (to wit) one negro man named HENDERSON, one negro boy named McKLIN, one negro boy named PLEASANT and one negro woman named SARAH and her child named LAWSON also one mare, bridle and saddle, one feather bed and furniture now in his possession to him and his heirs forever - 

Item - I gave and devise unto my son-in-law JACOB THOMPSON that married my daughter MARY P. ROGERS seventy acres of land (page 183) lying in Dyer County and being part of the same tract of land given to my son JOHN W. ROGERS.  I also gave him one negro man named ALFRED and one negro woman named WINNY and all the children the said WINNY now has and one negro girl named CAROLINE, one horse, bridle and saddle, one feather bed and furniture now in his possession to him and his heirs forever. 

Item - I gave and devise unto WHITMEAL H. COOPER that married my daughter ELIZABETH ALLEN ROGERS one note of hand I hold against him being about sever hundred dollars to him and his heirs forever. 

Item - I gave and devise unto the children of WHITMEAL H. COOPER born of the body of daughter ELIZABETH ALLEN COOPER, one negro man named CHARLES, one negro woman named NELLEY and said NELLEY's children being negroes I have heretofore made a deed in trust to which deed in trust my will is shall continue in full force and virtue until the said children shall recover them in full possession agreeable to the full meaning and interest of the same. 

Item - I gave and devise unto my grandson JOB CALVIN ROGERS son of JOHN W. ROGERS, one negro boy named UOY to him and his heirs forever - 

Item - I gave and devise unto my grandson JOHN CHESLEY THOMPSON son of JACOB THOMPSON one negro boy named SIMON to him and his heirs forever. 

Item - I gave and devise unto JOHN W. ROGERS and JUBILEE V. ROGERS and JACOB THOMPSON and the children that is now born and may hereafter be born of the body of my daughter (page 184) ELIZABETH ALLEN COOPER all negroes and perishable property I may decease possess with that is not above named except one negro girl named CANDIS which negro I gave more than the other children to the children of my daughter ELIZABETH ALLEN COOPER which is now born or may hereafter be born of her body and also said negro CANDIS child and her further increase to be possessed with as I shall hereafter direct. - I also gave unto JOHN W. ROGERS, JACOB THOMPSON and the children that is now born or may hereafter be born of the body of my daughter ELIZABETH ALLEN COOPER all the lands I may deceased possessed of or any claim thereto that is not above named and particular specified. - My will is that all the property that is above given to my children that is of age they shall be possessed with a! t my deceased.  But the property given to the children of my daughter ELIZABETH ALLEN COOPER shall be in the hands of my executors hereafter named as trustees and my will is they shall have full power to hire out said negroes or keep them on a farm as they in their discretion may think proper and the profits arriving therefrom shall be converted to the support of my daughter ELIZABETH ALLEN COOPER and family so long as she may live and at her decease the whole of the property to be equally divided among her children except my executors may believe or conserve in process of time that the said property may increase or so accumulate that there may be more than what may be necessary for the support of (page 185) my daughter ELIZABETH ALLEN and family then and in that case my will is that my executors shall have full power to give of to any of her children that may marry or arrive of age one or more negroes not exceeding a child's part to such of her children so marrying or  becoming of age and at her decease when all the property is to be divided the child so receiving property shall only account for the value of said property when they arrived the same in possession - 

I constitute and appoint by brother JUBILEE ROGERS and my two nephews CALEB BRASFIELD, PELEG TERRELL and my son JOHN W. ROGERS, executors of this my will and testament ratifying and confirming this and no other to be my last will and testament. 

Signed, sealed and delivered by the testator to be his last will and testament in the presence of us that is present at the time of signing and sealing of the same in testimony whereof I have hereunto set my hand and seal this 10th day of February A. D. 1837.
