WILL OF JEREMIAH OLMSTED

b. September 21, 1835, Town of Hope, Hamilton County, NY

d. July 30, 1912, Village of Borodino, Town of Spafford, Onondaga County, NY

Son of Isaac Olmsted and  Eunice Case

 

I, JEREMIAH OLMSTED, of the Town of Onondaga, County of Onondaga and State of New York, being of sound mind and memory, and mindful of the uncertainty of life, do hereby make, ordain, publish and declare this to be my last WILL and TESTAMENT, in the manner and form following, that is to say:

 

            FIRST:- I direct the payment of my just debts, if any.

 

            SECOND:- I direct my executor hereinafter named, as soon as may be without sacrifice, to sell and dispose of my real property and chattels of every name, nature and description, hereby giving and granting to my said executor, full power and authority to sell and convey any and all real property of which I may die siezed and possessed.

 

            THIRD:- I direct my said executor to divide all my property into seven equal hares or portions, the first of which said shares or portions I give, devise and bequeath unto my beloved daughter, Evie J. Brott to her and her heirs forever. The second of said shares or portions I give, devise and bequeath unto my beloved son, David J.  Olmsted and his  heirs forever. The third of said shares or portions I give, devise and bequeath unto my beloved daughter, Addie E. Streeter and to her heirs forever. The forth of said shares or portions I give, devise and bequeath unto my beloved son, A. Lee  Olmsted, and his  heirs forever. The fifth of said shares or portions I give, devise and bequeath unto my beloved daughter, L. beryl Slocum and her heirs forever. The sixth of said shares or portions I give, devise and bequeath to my executor hereinafter named, but in trust, and for the uses and purposes as follows:

 

            My said executor shall invest and receive the income from, such share or portion and shall pay the same annually to my grandchildren, Hazel Olmsted, Edwin Olmsted, and Walter Olmsted, children of my deceased son, Isaac C. Olmsted, share and share alike, until such time as said grandchildren shall obtain the age of twenty-one years, at which time, to wit: when each of said children shall respectively  obtain the age of twenty-one years, then I direct my executor to pay and turn over to each of said children on third of said sixth portion of my estate.

 

            I further direct that my executor hereinafter named, may in his discretion, in addition  to payment of income advance to each of my said grandchildren, from time to time, such sums out of the principal as may be necessary and required for the care, maintenance and support of any of my said grandchildren, such advancement to any such child to be charged against his or her share of this trust fund upon the final payment of the principle thereof to such child.

 

            The seventh of said shares or portions I give to my executor hereinafter named, but in trust, and for the uses and purposes as follows:

 

            My said executor shall invest and receive the income from, such share or portion and shall pay the same annually to my grandchildren, Jeremiah and Howard Olmsted, children of my deceased son, A. Jay Olmsted, share and share alike, until such time as said grandchildren shall obtain the age of twenty-one years, at which time, to wit: when each of said children shall respectively  obtain the age of twenty-one years, then I direct my executor to pay and turn over to each of said children on third of said seventh portion of my estate.

 

            I further direct that my executor hereinafter named, may in his discretion, in addition  to payment of income advance to each of my said grandchildren, from time to time, such sums out of the principal as may be necessary and required for the care, maintenance and support of any of my said grandchildren, such advancement to any such child to be charged against his or her share of this trust fund upon the final payment of the principle thereof to such child.

 

            LASTLY:- I make, constitute and appoint my son, A. Lee olmsted, to be the sole executor of this my last will and testiment, hereby revoking all former wills by me made.

 

            IN WITNESS THEREOF, I have set my hand and seal this 29th day of June, in the year of our Lord, One thousand nine Hundred and twelve.

            The above instrument was made at the date thereof subscribed by Jeremiah Olmsted, the testator therein named in the presence of us and each of us, and at the time of  making such subscription, the said above instrument was declared by the said testator to be his last Will and Testament, and we at his request, and in his presence and in the presence of each other have hereunto subscribed our names as witnesses thereto and have written opposite to our names our respective places of residence.
