In the name of God amen.  I Valentine Rathbon of Marcellus County of Onondaga in a State of New York considering the uncertainty of this mortal life and being of sound and perfect mind and memory blessed my almighty God for the same do make and publish this my last Will and Testament in manner and form following that is to say 1# I give my soul to god who gave it and my body to the Earth to be decently buried by my executor hereafter mentioned.

2’ly- Whereas my son Saxton Rathbon hath bound himself in an obligation being evendate herewith to support and maintain me and his mother Tabithy Rathbon from all charges at his own expense during our lives.  I therefore give and devise to him my said son Saxton his heirs and assigns forever all that farm of land on which I now live being part of Lot No 54 in Marcellus except forty two acres lying on the West End thereof, and I also give and devise to my said son Saxton his heirs and assigns forever all the Lands which I own in the Susquahanna Country the whole of the above to become his after my death and that of my wife.  3’ly I give and bequeath to my said son Saxton all my personal property of every kind and nature whatsoever that shall be found after my death and the death of my wife.

4’ly- I give and bequeath to the heirs of my son Joshua deceased one dollar if called for___

5’ly- I give and bequeath to the heirs of my son Daniel deceased five dollars to be equally divided between them ___

6’ly I give and bequeath to my sons James and Benjamin one dollar cash   I give to my son Valentine one Dollar if called for   I give to the heirs of my Daughter Niles deceased one Dollar if called for.  I give to my three Daughters Susanna Eunice and Cinthier one Dollar each if called for and lastly I give to the heir of my son Ruben deceased one Dollar.  My meaning and intent however is that if my wife Tabitha Rathbon shall survive my death she shall hold and enjoy all my estate both real and personal until her death and I do hereby will and bequeath to her the use of the same during her life and further I order that each and all the papers and mentioned legacies be paid in six months after the last demise of myself and my said wife- I do hereby ordain constitute and appoint my son Saxton Rathbone sole executor of this my last will and Testament hereby revoking all former wills by me made in testimony whereof I have hereunto set my hand and seal this Seventeenth day of November in the year of our Lord One Thousand eight hundred and eight  Signed sealed published and declared by the above named Valentine Rathbon to be his last will and testament in presence of us who have hereunto subscribed our names as witnesses in presence of the said Testator.

Be it remembered that on the seventeenth day of February in the year eighteen hundred and fourteen personally came before me George Hall Surrogate of the County of Onondaga Jesse Copp whose name is subscribed to the Last Will and Testament of Valentine Rathbone deceased who being duly sworn deposeth and saith that his name subscribed to the said will is of his own proper hand writing and that he saw the said Valentine Rathbone sign and seal an instrument in writing purporting to be his last will and testament bearing date the seventeenth day of November in the year one thousand eight hundred and eight (the preceding whereof is a true copy ) and knew him publish and declare same as and for his last will and testament and the said deceased at the time thereof was  of sound disposing mind and memory to the best of the knowledge and being of him this deponent and that he with other subscribing witnesses subscribed the said will in the presence of each other and in the presence of the testator and he in their presence                                                George Hall Surrogate

 

 

Be it remembered that on the seventeenth day of February in the year eighteen hundred and fourteen personally came Saxton Rathbone the executor in the preceding will named and was duly qualified by taking the necessary oaths and letters testamentery with a copy of the said will annexed (the proceeding whereof are true copies) were issued anond* inxly**and recorded in this office the day and year above written.
