WILL OF ISAAC CASE

b.     February 8, 1786, in Massachusetts

d. May 23, 1864, at the Village of Borodino, Town of Spafford, Onondaga County, NY

 

At a Surrogate Court held in and for the County of Onondaga, at the Surrogate office in the City of Syracuse, the 24th day of October, in the year of our Lord one thousand eight hundred and sixty four.

Present Oscar S. Sprague, Surrogate.

In the matter of proving the

Last Will and Testament

            of

Isaac Case, deceased

                                                Onondaga County fr:

                                                                                    Be it remembered, that heretofore, upon the petition of Isaac Olmsted the Executor named in the last Will and Testament of Isaac Case late of the town of Spafford in said County, deceased, for that purpose to the Surrogate of said County a citation was duly issued in this manner, and Alexander M. Churchill, having been appointed special guardian of George W. Case and Seymour Case, minor heirs and next of kin of said deceased, which citation with the proofs of service was thereafter duly returned to said Surrogate, and which said petition  and citation  with the proofs of service thereof and said appointment, are now on file in the Office of said Surrogate, and therefore the last Will and Testament of the said Isaac Case deceased, with the proofs thereof, were produced and are as follows:

 

            In the name of God Amen, I Isaac Case of the Town of Spafford in the Country of Onondaga and State of New York, being of sound mind and memory, do make declare and publish this my last Will and Testament. _____

First, I give and bequeath to my wife Nancy the sum of one dollar, which is in lieu of her dower.

Second, I give and bequeath to my five children now living, viz: Eunice Olmsted, Betsy Howe, Sydia Pickett, Aaron G. Case and Arvilla M. Nickols, all the residue of my personal property, to be divided equally among them after paying from the same all my debts made by reason of sickness and expenses of my burial.

Third, I do nominate and appoint Isaac Olmsted to be the executor of this my last Will and Testament, _____ in testimony whereof I hereunto set my hand and seal, and publish and decree this to be my last Will and Testament, in presence of the witnesses named below, this eighth day of June in the year of our Lord, one thousand eight hundred and sixty four.
