LAST WILL AND TESTAMENT OF

SAMUEL MIDKIFF

At a court held for Kanawha County at the Court House thereof on Monday, the 10th day of September, 1827.

The Last Will and Testament of Samuel Midkiff decd late of this County was this day presented in Court proved by the oaths of Joseph Midkiff & William Roberts subscribers of witnesses hereto and ordered to be recorded.

In the name of God amen. I Samuel Midkiff of Kanawha County .. being on my perfect senses and sound of memory do make this my last Will & Testament in the manner and for as followeth.

To wit,

First, of all I will and desire that all my just debts should honorably be paid.

2nd Item .. for my beloved wife Elizabeth Midkiff which was Elizabeth Smith, widow, she gave all her living to her children, nevertheless I give, I will I desire I bequeath unto her the … part of my plantation to a steep gut above the bain the third part of the orchard and a third part of the houses and no part of the Mill and Five dollars currency money of Virginia, and this to be her full part of my Estate her lifetime and no more 3rd and as I have but three sons

Item 3 I will give and desire unto them the following manner I will give and desire unto my son Ezekiel Midkiff sixty acres of land or the same more or less the place where he now lives on both sides of the river to the lower end of the narrows a straight dividing line across the river and that to be his full part of the land and no more and as for my son Eli Midkiff I will give and desire unto him seventy acres of land be the same more or less lacking all the land in the forke side of the river below Ezekiel’s and that to be his full part of the land and no ore and as for son Samuel Midkiff, Jr. I will give and desire unto him seventy acres of land be the same more of less lying on the south side of Cole river below Ezekiel’s dividing line accepting the third part below a steep gut, I bequeathed to my beloved wife Elizabeth Midkiff her lifetime and after her decease for him to have the whole, and also I desire that he should have the Mill in and that to his part of the land and no more, and as for all my other properties carried over I will and for all the rest of other property Negro girl Lette, cattle, horsebeast, hogs, sheep, beds and household furniture, plantation utensils, money and debts coming to me I give will and desire that it should be equally divided among my above mentioned three sons, Ezekiel Midkiff and Eli Midkiff, and Samuel Midkiff, Jr according to what I have gave them before, lastly I constitutes and appoint Ezhiam Polly and Ezekiel Midkiff Executors of this my last Will and Testament.

I do hereby revoke dissannul all other wills or Testaments heretofore by e made or that ever should hereafter be me made In Witness whereof I have hereunto set my hand and seal this 31st day of August One Thousand Eight Hundred and twenty seven.
