WILL OF MORRIS HUDSON
In the name of God Amen
I Morris Hudson of the County of Kanawha and Commonwealth of Virginia being of sound mind and memory but strongly impressed with the uncertainty of human life do make and ordain this my last will and testament of all such estate as it hath pleased the God to bless me with in this life, that is to say
First, it is my will and desire that my funeral expenses and just debts which are but few, and small amount be paid and discharged out of the money in hand I may leave at my decease and that none of my property, any kind be sold for those purposes.
2nd Item, I do give and bequeath to my son David Hudson, all my personal estate of what kind so ever the same may be comprehending as will all my slaves and their increases as my other personal estate and debts to hold the said personal estate slaves, and debts, which may be owing unto me to him the said Davis Hudson as his absolute property save and except one equal third part of the monies which may have been received or which may here after be received from the sale of a tract of one thousand acres of land lying in Botetourt County Virginia which has been sold to a certain Benjamin Carper for the sum of give hundred dollars, which third part of the said sum of five hundred dollars I do hereby bequeath to my daughter Sarah Philson widow of Robert Philson deceased and do direct that the same be paid to her by my son Davis Hudson as he shall receive
3rd Item The three hundred acres of land in Kanawha County on Kanawha River which I purchased from Alexander Spotswood together with the tract of land adjoining the same which I purchased of Washington Bale, except one hundred acres of the upper part of the latter which I have heretofore conveyed to Robert Philson in his lifetime, some also and except two acres herein after devised to the use of the Episcopal Church, I do dispose of and divide in the following manner that is to say, one hundred and fifty acres the lower majority of the said tract purchased of said Spotswood to be laid off by the following metis and bounds viz Beginning at a white oak and black oak on the back line of the said three hundred acres thence N 3 degrees E 3400 poled to a small beech and sycamore on the River bank thence down the river 72 poled to an elm and beech thence leaving the river S 2 degrees W 350 poles to a black oak beech and hickory on the back line of the … survey thence N 88 E to the beginning I do divide and will unto my son Samuel Hudson to hold to my said son Samuel in fee simple the remaining one hundred and fifty acres of said tract purchased of Spotswood as aforesaid together with one hundred and fifty seven acres immediately joining … and part of the said tract purchased of Washington Ball as aforesaid making together the quantity of three hundred and seven acres, I do will and devise unto my son Davis Hudson to hold to my said son Davis in fee simple and the remaining one hundred and fifty acres of the tract purchased as aforesaid of Washington Ball and lying between the land hereby divided to my said son Davis and conveyed to Robert Philson in his life tie as aforesaid I do will and devise unto my son Jesse Hudson to hold to my said son in fee simple.
4 Item It is my will and desire that the two acres of land be laid off immediately around adjacent and including the present graveyard which said two acres of land, I do will and devise to y son Davis Hudson in Trust for the use of the Episcopal Church, to be used as a church and graveyards and I do hereby direct that whensoever proper persons shall be appointed by that church, for the purpose their my son Davis and his heirs being required so to do shall convey the said two acres of land in such manner as the said church or its agents properly authorized may require
5th Item I do devise unto my daughters Nancy Hudson wife of Elijah Hudson, and Abigail Jones my 300 acres of land upon big Hurricane reek in Teays valley, patented to me by patent bearing date 10th July 1800 to be divided and laid off between them equally according to quantity and quality, but in such manner as that said Abigail’s part shall include her present improvement and each of the to hold her .. morely thereof thus divided her life only and as each of said daughters depart this life, then it is my will and desire that the .. of the one dying shall upon her death be sold and the profits arising from the sale thereof be divided equally among such of her children as may be living at her death
6th Item If at any time hereafter should be obtained from and in consequence of a contract formerly entered into by e with a certain Benjamin Martin, then it is my will and desire, that the same may be equally divided between my said children, Davis, Samuel, Jesse, Nancy, Abigail and Sarah
7th Item It is my will and desire that any personal property I may at anytime during my life have … to any of my children, or the profits arising therefrom may remain on his or hers to whom even without account and I hereby co.. the disposal … to be necessary do will it accordingly and lastly I do hereby appoint my sons Davis Hudson, Samuel Hudson, and Jessee Hudsons executors of this my last will and testament hereby revoking all former wills and testaments by me at any time made.
In Testimony whereof I have hereunto set my hand and affixed my seal the third day of October in the year of our Lord Christ one thousand eight hundred and twenty four

As a Court held for Kanawha County on the 11th day of June, 1832, The last will and Testament of Morris Hudson decd was proved by the oaths of Joseph Lovell and James T Twinsler subscribing witnesses thereto and ordered to be recorded.
