MAHONE/ ARTHUR 1901 DEED

Mary A. Arthur's Trustees to 80 X 136 ft � of Lot 1 Brownstown Louden..S. H. & Nacy J. Campbell to cure defect in deed.

WHEREAS By deed dated on the 28th day of December, 1869, recorded in the office of the Clerk of the County Court of Kanawha County West Virginia, in Deed Book No. 26 page 172, Rufus Workman and wife conveyed to B. P. Clendenin and A. C. Mason Trustees, for Mary A. Arthur, a certain lot or parcel of land in said County and State, in what was formerly known as the town of Elizaville, now Brownstown, which said lot is known as one-half of lot No. 1 on plat of said town of Elizaville; and

WHEREAS, After the death of the said Mary A. Arthur, the said trustees and the heirs at law of said Mary A. Arthur by deed dated March 3rd, 1881 recorded in said Clerk's office in Deed Book No. 36 page 427, conveyed said lot to John L. Arthur; and,

WHEREAS, doubts have arisen as to the sufficiency of the acknowledgements of same of the parties to the two deeds aforesaid, and said lot having been afterwards conveyed to S. H. Campbell and Nancy J. Campbell, who having paid the consideration therefor and said A. C. Mason Trustee, having departed this life, and the surviving trustee, and the heirs-at-law of the said Mary A. Arthur, deceased, desiring to cure any defects in the deeds aforesaid, and to invest said S. H. Campbell and Nancy J. Campbell with the full and complete title to said lot;

NOW, THEREFORE, THIS DEED, Made this 16th day of September, in the year 1901, between B. P. Clendenin, trustee, and in his own right, and Eliza J. Clendenin, his wife, Frances E. Mason, Widow of A. C. Mason, deceased, Edward Jackson, and Susan H. Jackson, his wife, Mary A. Workman, widow of Rufus Workman, deceased, Ardenia C. Wells, widow of N. B. Wells, deceased, Benjamin E. Morris and Julia A. Morris, his wife, Emma C. Arthur, William J. Jackson and Ora Jackson, his wife, Thomas Jackson and Dena Jackson, his wife, Daniel C. Wood and Maggie Wood his wife, James Conaway and Mary Conaway his wife, Charles Brugh and Julia Brugh, his wife, and Augustus Jackson, parties of the first part, and S. H. Campbell and Nancy J. Campbell, his wife, parties of the second part,

WITNESSETH: That in consideration of the premises and Five Dollars cash in hand paid, the said parties of the first part do Grant and Convey unto the said S. H. Campbell, and Nancy J. Campbell, parties of the second part, all their, the said parties of the first part's, right, title and interest in and to said lot or parcel of land, bounded and described as follows, to-wit: one-half of Lot No. 1, as laid down on the plat of the town of Elizaville, the other half of which lot was owned by the late A. G. Walker.

Beginning at a post on the Northeast side of the turnpike, running thence N 25 � W. 80 feet to a stake; thence N 61 � E 136 feet to a stake; thence S 25 � E 80 feet to a stake; thence N 61 � W 136 feet to the beginning; and being the same lot conveyed by John L Arthur and wife to L. V. Smith, by deed dated on the 23rd day of April, 1883, recorded in said Clerk's office in Deed Book No. 39 page 124, and conveyed by said L. V. Smith to W. T. Smoot by deed dated February 24th, 1890, recorded in said Clerk's office in Deed Book No. 51, page 482, and conveyed by said Smoot and wife to the parties of the second part, by deed dated September 14th, 1897, recorded in said Clerk's office in Deed Book 76, page 327, to which deeds recorded as aforesaid, reference is here made for further description.
