Preface

Gloucester, Virginia, is a fascinating county steeped in culture and history.  As part of an archaeology internship with The Fairfield Foundation, I started taking a closer look at the documents that enable historians, archeologists, and genealogists to understand Gloucester’s early years.  Unfortunately, Gloucester experienced what the Library of Virginia deems “a catastrophic loss” of records twice: once in 1820 and again in 1865.  The first fire took place in April 1820 at the Gloucester Clerk's Office, and it destroyed most of the county's official records.  The second fire occurred in Richmond where official county records from across Virginia were moved to keep them safe during the Civil War.  Among the only surviving documents from these fires are the county court's minute books. 

            In general, minute books contain court proceedings.  The 1820 Minute Book is extraordinary as it also attempts to mitigate the devastation of the 1820 Clerk's Office fire.  Beginning in June, it contains transcriptions of original documents such as indentures and land transactions as well as ongoing debt cases, appointments, and county financial information.  The vast majority of the Minute Book deals with lawsuits and debt cases.  The information is unevenly spread over seven months.  Consequently, the number of pages per month varies greatly from four pages to seventy pages, the least amount in December and the most in November.

            The following work summarizes the 1820 Minute Book in outline form.  It is not a verbatim transcription.  Instead, my goal was to make the archaic legalese readable and useful for a twenty-first century audience.  To facilitate ease of reading, while I included as much information as possible, I also grouped content under subheadings such as “orphan affairs” or “debt cases.” Spelling, including place and family names, is as close to the original as possible.  Some names have footnote explanations as needed.  The presences and absences of attorneys and justices are noted as in the original.  Additionally, Latin legal terms are italicized with footnote definitions.

There is always the possibility of error, both in the past and in my own work, particularly as the minute book was handwritten.  I have included page numbers in order for researchers to refer back to the original.  Nevertheless, I am confident that my overview of the text is complete, and I hope that it will be useful for future reference, particularly for genealogists, historians, and archaeologists.

Susan Whiting, admin of Mathew Whiting, deceased, (Plt) against John B. Seawell and William S. Thornton (Defts).  Motion concerned a forfeit bond executed by the Defts and Benjamin W. Cluverius. The plaintiff’s attorney was Mann Page. William Robins swore that the defendants had ten days notice of the motion. Defendants did not arrive.  Plaintiff may execute against the defendants for $80 with 6% interest and $5.36 court fees. Two mules were “taken by virtue of the Plts execution.”

Michael Pointer (Plt), against John B. Seawell and William S. Thornton (Defts).  Motion concerned a forthcoming returned forfeited [bond] executed by the Defts and Benjamin W. Cluverius The plaintiff’s attorney was Catesby Jones. William Robins swore that the defendants had ten days notice of the motion. Defendants did not arrive.  Plaintiff may execute against the defendants for $147 with 6% interest and $5.36 court fees. Two horses were “taken by virtue of the Plts execution.”

A riding horse was “taken by virtue of the Pets. Execution sued out of this court against the goods and chattels of Thomas Throckmorton, decd, co-obliger of P. W. Lewis.”

Elizabeth Carney admin of William Carney, deceased (Plt) against John B. Seawell and William L. Thornton (Defts). The plaintiff’s attorney was Catesby Jones. William Robins swore that the defendants had ten days notice of the motion. Defendants did not arrive.  Plaintiff may execute against the defendants for $219 with 6% interest and $5.36 court fees. Two horses were “taken by virtue of the Plts execution.”

Defendant was in custody because he could not pay his bail.  He owes the plaintiff $188.12.  Defendant subscribed and delivered a schedule of his whole estate and took the oath of an insolvent debtor.  He was then discharged out of custody.

The defendant acknowledged his debt of $50 to the plaintiff.  The defendant must repay the debt with 6 % interest and court fees of $7.54.  The plaintiff agreed to give the defendant 9 months.

Trial:

Israel, a Negro slave belonging to the estate of John Catlett deceased, property of Robert and Charles Ann Yates infant children of Bartholomew Yates decd, charged with larceny. Catesby Jones was appointed by the court to conduct the prosecution.

On November 3, 1820, Israel broke into the Negro Quarter and Dwelling house of Baylor Stubblefield.

Stole $20 worth of clothing and other things.

Committed other wrongs and injuries.

Witnesses:  Baylor F. Stubblefield, William Smith, James H. Jones, and James Williams, and Jacob, a slave.   

Pleaded not guilty.

Found guilty.

Punishment: he is to be “burnt in the hand.”
