PETITION OF A. O. HOWELL ET AL
TO HAVE C. P. LINDSEY APPOINTED
On
this the 10th, day of March, A. D. 1913, came on to be considered the
petition of A. O. Howell et al, to have C. P. Lindsey to be appointed
as Justice of the Peace for Precinct Number Fourt, which has been made
vacant by the death of E. P. Smith.
The
Court, after considering said petition is of the opinion that the said
C. P. Lindsey ought to, and he is hereby appointed to fill out the
unexpired term of the said deceased, E. P. Smith.
RETURNS MOSS SP’GS HOG LAW
On
this the 10th day of March, A. D. 1913, came on to be counted the
returns of an election held with in the bounds of the School District
of Moss Springs for the purpose of determining whether or not sheep,
hogs and goats shall be permitted to run at large in said School
District Viz. Moss Springs.
Said
returns having been opened in open court and the returns of said
election having been canvassed, it is found that there were cast for
the Stock Law … 6 votes, and there were cast against the stock law … 10
votes. The court finds that there were a majority against the
stock law of 4 votes.
RETURNS FOR MALTA HOG LAW
On
this the 10th day of March, A. D. 1913, came on to be counted the
returns of an election held with in the bounds of the School District
of Malta for the purpose of determing where or not sheep, hogs and
goats shall be permitted to run at large in said Malta School District.
Said
returns having been opened and counted in open court, the court finds
that there were cast at said election for the Stock law 22 votes; and
against the Stock Law 26 votes. Therefore, the Court finds that
there were cast at said election 4 votes majority against the Stock Law.
APPLICATION OF C. B. HELMS.
On
this the 10th day of March A. D., 1913, came on to be heard the request
of Commissioner of C. B. Helms, to divide the Public Road running from
Old Boston to Corley. Ist section beginning at Old Boston and
ending with the intersection of Maud Road. 2nd section to begin
at Maud Road and extend to Corley.
On
motion of helms and seconded by Braswell, all voted for the division to
be made, and the same is ordered by the court to be done.
THE APPOINTMENT OF SCHOOL TRUSTEE
ELECTION MANAGERS AND JUDGES.
Be
it ordered by the Commissioners Court of Bowie County, Texas, in
regular session at Boston, Texas, at the Court of said County, on this
the 10th day of March A. D., 1913, that the following named persons are
hereby appointed managers of the election for Trustees for the various
districts, and also for County Board of education, in and for Bowie
County, Texas, said elections to be held at the various School Houses
in said Districts in Bowie County, Texas.

DECLARING THE RESULT OF THE COUNTY HOG LAW ELECTION.
Boston, Texas, April 9th, 1913.
On this day came on to be counted and canvasses the returns of an
election held on the 29th day of March, 1913, throughout Bowie County,
to determine whether or not hogs, sheep and goats shall be permitted to
run at large in said Bowie County, Texas, which said election had
heretofore been duly and legally ordered and held according to law when
I, Lee Tidwell, County Judge of Bowie County, Texas, in the presence of
Joe White, County Clerk of Bowie County, Texas, and also in the
presence of J. C. McDuffie and T. J. Abel, canvassed the returns of
said election from the returns delivered to me by the various election
officers throughout Bowie County, and after due and careful canvass of
said returns having tabulated and counted same, I find that there said
returns having tabulated and counted same, I find from said election
the following vote to-wit:
For
the Stock Law there were cast …………………540 votes.
Against the Stock Law there were cast …………….408 votes.
I therefore find from said returns that said election resulted in favor
of the stock law by a majority of 132 votes, therefore, I, Lee Tidwell,
County Judge of Bowie County, Texas, having found from the canvass of
said vote as above stated, hereby declare that said election resulted
in favor of the Stock Law throughout Bowie County, Texas, and that
thirty days posting of notice of the result above, it shall be unlawful
for any person to permit either hogs, sheep or goats to run at large in
any part of Bowie County, Texas.

ORDER ORDERING AN ELECTION TO ABOLISH THE INCORPORATION IN DEKALB, TEXAS
Whereas an application signed by a majority of the qualified property
tax paying voters of the incorporated town of DeKalb, Texas, was filed
in the office of the County Judge of Bowie County, Texas, petitioning
that an election be ordered for the purpose of allowing the qualified
voters residing in said town to determine whether or not said
incorporation should be abolished.
And
it appearing to me that said application is in due and legal form and
that said territory was duly incorporated on ______ day _________ 1892,
an election is hereby ordered to be held at the Justice Peace office of
precinct Number 3, in the town of DeKalb, Bowie County, Texas, on the
5th day of October, A. D. 1913, and Will Welch is hereby appointed
manager of said election.
Every male person who has attained the age of twenty-one years, and who
has resided within the hereinafter described territory for the past six
months and who are qualified property tax paying voters under the laws
of this State shall be entitled to vote at said election.
Said
territory is described as follows to-wit: Beginning where the
Texas & Pacific Railway crosses the original East Boundary line of
the W. L. Browning H. R. Survey running North to Mud Creek; Thence West
1900 vrs. Thence South 2375; Thence East 1900 vrs. To said original
East line. Thence North with said line to the place of beginning.
All
persons desiring to vote for the abolition of said incorporation shall
have written or printed upon their ballot “For Abolishing the
Incorporation”. All persons desiring to vote against the
abolition of the incorporation shall have written or printed upon their
ballot “Against the abolition of the incorporation”.

ORDER DECLARING RESULT OF ELECTION HELD AT DEKALB TO ABOLISH THE
INCORPORATION, AND AABOLISHING SAID INCORPORATION.
On
this the 7th day of October, A. D. 1913, came on to be counted and
canvassed the returns of an election held on the 5th day of October, A.
D. 1913, in the Town of DeKalb, Bowie County, Texas, to determine
whether or not the incorporation of said town should be abolished, said
incorporation being described by metes and bounds as follows,
to-wit: Beginning where the Texas & Pacific Railway crosses
the original East Boundary line of the W. L. Browning H. R. Survey
running North to Mud Creek; Thence West 1900 Vrs. Thence South 2375
Vrs. Thence East 1900 Vrs to said original East boundary line.
Thence North with said line to the place of beginning, which said
election has heretofore been duly and legally ordered and held
according to law, when I, Lee Tidwell, County Judge of Bowie County,
Texas, canvassed to returns of said election made and delivered to me
by E. J. McKinney, manager of said election, find from said returns the
following vote to-wit:
For
the abolition of the incorporation there were cast 57 votes and against
the abolition of the incorporation there west cast 31 votes, I find
from said returns that said election resulted in favor of abolishing
the incorporation by a majority 26 votes.
Therefore, I, Lee Tidwell, County Judge of Bowie County, Texas, having
found from the canvass of said return as above stated, hereby declare
that said election resulted in favor of the abolishment of the
incorporation of the town of DeKalb, Texas, and the same is this day
abolished.

COUNTY SCHOOL TRUSTESS OR COUNTY BOARD OF EDUCA.
On
this the 14th day of April, A. D. 1913, the Commissioners’ Court being
in regular session the with County Judge present and presiding, and all
of the County Commissioners with the County Clerk present, came on to
be counted the returns of the election held through out the County for
the purpose of electing one member from each of the commissioners
precincts and one member at large for the county, to constitute the
County School Trustees or the County Board of Education.
After such returns having been open and correctly canvassed, the court
finds that the following named persons received the following votes for
said County Trustees respectively:
Commissioners Precinct Number One A. S. Watlington received 146 votes,
which was a majority of the votes cast throughout the county for a
member of the County School trustees or County Board of Education for
the County, of Bowie, and State of Texas, and Commissioners’ Precinct
Number One.
Commissioners’ Precinct Number Two, D. A. Chambers received 130 votes,
which was a majority of the votes cast throughout the county for a
member of the County School Trustees or County Board of Education for
the County of Bowie, State of Texas, and Commissioners Precinct Number
Two.
Commissioners’ Precinct Number Three, N. E. Lawrence received 135
votes, which was a majority of the votes cast throughout the county for
a member of the County School Trustees or County Board of Education for
the County of Bowie, State of Texas, and Commissioners’ Precinct Number
Three.
Commissioners’ Precinct Number Four, T. M. Braley received 180 votes,
which was a majority of the votes cast throughout the county for a
member of the County School Trustees or County Board of Education for
the County of Bowie, State of Texas, and for Commissioners’ Precinct
Number Four.
The
Court further finds that the next person receiving the highest number
of votes throughout the county shall be declared elected as a member of
the County Board of Education as a member at large from the county, and
the canvass shows that A. G. Howell received the next highest number of
votes.
Therefore it is ordered, decreed and adjudged by the Court that A. S.
Watlington from Precinct Number One; D. A. Chambers from Precinct
Number Two; N. F. Lawrence from Precinct Number Three and T. M. Braley
from Precinct Number Four and A. G. Howell at large are duly elected
and shall constitute the County School Trustees or County Board of
Education until their successors are elected and qualified. The
precincts above referred to are to be construed as Commissioners’
Precincts of Bowie County, Texas.
COMMON DISTRICT TRUSTEES FOR BOWIE COUNTY, TEXAS
On
this the 14th day of April came on to be counted the returns of an
election held on the 5th day of April throughout the County of Bowie at
the various school houses the same being the usual voting places, for
the purpose of electing School Trustees for the various Common School
Districts of the said County of Bowie. The County Judge being
present and presiding with the Commissioners and the Clerk of the
County Court present, the returns of said election were open and the
votes canvassed, and the following named persons were found to receive
the highest number of votes for trustees of their respective districts

TO BUILD A STEEL BRIDGE OVER SULPHUR
On
this the 13th day of May, A.D. 1913, the Commissioners Court of Bowie
County, Texas, in session with all members present, when the
proposition came on for consideration of joining the County of Cass in
building a Steel Bridge across Sulphur and after a careful
consideration of the same, the Court is of the opinion that for the
prosperity and good of the people of said Bowie County, Texas, said
bridge ought to be constructed.
Therefore by a motion duly made and seconded all votes yea to join Cass
County in building said Steel Bridge.
ORDER CREATING SCHOOL DISTRICT NO. 10
On
this, the 14th day of May, A. D. 1913, came on to be considered the
application and petition of J. L. Earnest and others for a change in
school district No. 3.
It
appearing to the Court that said District No. 3, as heretofore
districted, was districted in such a manner as not to meet the best
conveniences of the patrons therein embodied.
It
further appearing to the court that school district No. 3, as it now
is, is of sufficient size to warrant a division of same into three
common school districts, viz., RED LICK COMMON SCHOOL DISTRICT---LEARY
COMMON SCHOOL DISTRICT and RED SPRINGS COMMON SCHOOL DISTRICT.
Red Lick School District to hereafter be known as No. 10, Red Springs
Common School District to be hereafter known as district No. 3, and
Leary School District, hereafter to be known as school district No. 67.
It
is therefore ordered, adjudged and decreed by the court that Common
School District No. 10 be and the same is this day created and said
District shall hereafter be bounded by metes and bounds as follows:
To
be known as RED LICK COMMON SCHOOL DISTRICT NO. 10. Beginning at
the Northeast Corner of the M. H. Janes Survey, Thence South with the
East Boundary Line of the M. H. Janes Survey to the northwest Corner of
the George Brinlee Survey; Thence South, Southwest and South to the
line of Park Independent School District; Thence South, West and South
with the Boundary line of the Park Independent School District to the
Texas & Pacific Railroad; Thence West with said Railway to the West
Boundary Line of the J. H. Bostic Survey; Thence North with the Leary
and Red River Public Road to Barkman’s Creek; Thence East with the
meanders of said Creek to where Barkman’s Creek crosses the South
Boundary line of the John H. Bostic Survey; Thence East with the South
boundary line of the John H. Bostic Survey to the place of beginning.
ORDER CREATING SCHOOL DISTRICT NO. 3.
On
this the 14th day of May, A. D. 1913, came on to be considered the
application and petition of W. G. Hibbs and others to have Red Springs
Common School District No. 3 created.
It
having been made plain to the court that said district No. 3 should be
created for the best interests of all concerned.
Therefore it is ordered, adjudged and decreed by the court that COMMON
SCHOOL DISTRICT NO. 3 OF RED SPRINGS and the same is hereby this day
created, and said district shall hereafter be bounded by metes and
bounds as follows:
BEGINNING at a point where the Texas & Pacific Railroad crosses
Section No. 244 of the M.E.P. & P. Railroad Survey; Thence South
with the East boundary of said Section No. 244 to the South East corner
of said Section; Thence West with the South boundary of Section No. 244
to the Northeast Corner of the Alexander Fry Survey; thence South with
the East boundary of the Alexander Fry, Nancy Dycas, and J. H. Smelser
Serveys; Thence East, South and West with the north East and South
boundaries of the J. M. Napp Surveys to the north East corner of the
Edward H. Tarrant Survey; Thence South with the East boundary of the
Edward H. Tarrant Survey to the St. L.S.W. Railway; Thence South West
with said Railway to where said Railway crosses the West boundary of
the Howard Ethridge Survey; Thence North, West and North with the West
boundary line of the Howard Ethridge Survey to the Southeast corner of
the James Wharton Survey; Thence West and North with the South and West

ORDER CREATING SCHOOL DISTRICT NO. 67
On
this the 14th day of May, A. D. 1913, came on to be considered the
application and petition of Tip Cooley and others to have School
District of Leary No. 67 created.
The
said petition having been considered and it appearing to the court that
for the best interest of all concerned said district ought to and
should be established.
Therefore it is ordered, decreed and adjudged by the court that COMMON
SCHOOL DISTRICT NO. 67 OF LEARY be, and the same is hereby this day
created, and said district shall hereafter be bounded by metes and
bounds as follows:
BEGINNING at a point where the T. & P. Railroad crosses the East
boundary line of the Smither Survey; Thence South with the East
boundary line of the Smither Survey to the South East corner of said
Survey; Thence West with the South boundary line of the Smither Survey
to the Southwest corner of said Survey; Thence West to the South
boundary line of the J. M. Hawkins land; Thence along the West boundary
line of said Hawkins’ land to the northeast corner of T. W. Sexton’s
land; Thence North along Ward’s East boundary line to the T. & P.
Railroad; Thence West with said Railroad to the Southeast corner of the
Lemuel Peters Survey; Thence North with the East boundary line of the
Lemuel peters Survey to Barkman’s Creek; thence East with the meanders
of Barkman’s Creek to where the Leary and Red River Public Road crosses

ORDER APPOINTING DR. W. S. TYSON COUNTY HEALTH OFFICER
On
this the 26th day of September, A. D. 1913, came on to be considered
the application of Dr. W. S. Tyson to be appointed County Health office
in and for Bowie County, Texas, to fill out the unexpired term of Dr.
T. E. Oliver deceased.
The
Court having considered the application is of the opinion that the said
Dr. W. S. Tyson is a proper person to fill out said vacancy, and on
motion of Helms, seconded by Braswell, the Court voted unanimous for
the appointment of said W. S. Tyson.
Therefore, it is ordered, adjudged and decreed by the Court that Dr. W.
S. Tyson is hereby appointed County Health Officer of Bowie County,
Texas, to fill out the vacancy caused by the death of Dr. T. E. Oliver.
PETITION
To
the Hon. Commissioners Court, in and for Bowie County, Texas. We,
the undersigned qualified voters of the City of New Boston, we being at
least twenty per cent of all the qualified voters residing within the
corporate limits of said City, same being a political subdivision of
Bowie County, Texas, hereby petition your honorable Court to order an
election to be held within said City; at the First National Bank in New
Boston, not less than 15 days from the date of your order and not more

ORDER APPOINTING JANITOR COURT HOUSE AND YARDS.
This the 12th day of November, 1914.
This
day came on to be heard and considered by the Court the application of
J. C. Ross to be appointed janitor of the Bowie County Court house
buildings and grounds; and it appearing to the Court that the said J.
C. Rose the applicant presents to the Court the best bid therefore.
It
is therefore ordered, adjudged and decreed by the Court that said
application be and the same is hereby granted, and the said J. C. Rose
be and he is hereby appointed janitor of the Bowie County Court House
Building and the Court House yards for said Bowie County for the
ensuing two years with the distinct understanding that good and
acceptable service be rendered at and for the salary of Thirty-five
($35.00) Dollars per month, or until the further orders of this Court.

On

considered by the Court the application of Dr. W. S. Tyson to be
appointed County Health Officer for Bowie County, Texas, for the next
ensuing two years; and it appearing to the Court that said applicant
Dr. W. S. Tyson presents to the Court the best bid therefore.
It
is therefore ordered, adjudged and decreed by the Court that the said
application of the said Dr. W. S. Tyson be and the same is hereby
granted, and the said Dr. W. S. Tyson be and he is hereby appointed
County Health Office for Bowie County, Texas, for the ensuing two years
at and for the salary of Ten ($10.00) Dollars per month, acceptable

ORDER FOR JANITOR TO STOP SKATING IN THE COURT HOUSE HALL
Janitor and his duty in reference to skating in the Court House
Hall
March 9th, 1915. This day came on to be considered the matter of
placing a stop of the use of the Court House Hall for skating purposes
on roller skates or other means of skating.
It
is therefore ordered by the Court that it made the duty of the Janitor
of the Court House building to not permit any more skating in the hall
of the Court House on roller skates or any other means of skating on
the floor of said hall, and should any person thus offending persist in
the practice of skating in the Court House halls it is further made the
duty of said Janitor to report the offender to the County Judge or to
the County Attorney.
ORDER APPROPRIATING $200.00 FOR SIX WEEKS CAMPAIGN IN BOWIE COUNTY
On
this the 12th day of April, A. D. 1915, came on to be heard and
considered the application of the State Board of Health for an
appropriation of Two Hundred ($200.00) Dollars to help defray the local
expenses of a hookworm campaign in Bowie County, which application is
supplemented and endorsed by a large majority of the Physicians of the
County approving an appropriation for said purpose.
It
is therefore ordered, adjudged and decreed by the Court that the sum of
Two Hundred ($200.00) Dollars be and the same is hereby appropriated to
the State Health Department to be used by said health Department in a
six weeks Hookwork campaign to be used to cover the cost and in payment
of the drugs given the patients; and to pay the advertising of said
campaign in the County and for the local traveling expenses of the
laboratory assistant, and for the free examination and free treatment
of hookworm disease of all those who will apply for same at one of the
dispensaries to be opened in said County and the actual work that is,
lecturing, examining and treating of patients is done by a
representative of the State Board of Health under the supervision and
guidance of the County Health Officer.
It
is further ordered that the said sum of Two Hundred Dollars to be paid
out on the order and approval of the County Judge, he directing the
County Clerk to issue a warrant or warrants to cover the said amount.
ORDER APPROPRIATING $75.00 TO PURCHASE A PAIR OF TRAINED BLOOD HOUND
DOGS FOR THE COUNTY.
On
this the 12th day of April, A. D. 1915, came on to be heard and
considered the application of W. N. Morris, Deputy sheriff for an
appropriation of the sum of seventy-five Dollars to be used in the
purchase of a pair of well trained blood hound dogs for the County; and
it appearing that said should be granted by the court.
It
is therefore ordered by the Court that the sum of Seventy-five Dollars
be and the same is hereby appropriated out of the funds of the County
for the purpose of purchasing a pair of well trained blood hound dogs
for the County and said dogs to be kept at the County Jail, and it is
further ordered that a warrant to be issued upon the order of the
County Judge for said amount in payment of the purchase of said dogs.
ORDER ESTABLISHING NAME OF TWO PUBLIC ROADS.; July 20th, 1915
This
day came on to be heard and considered the matter of establishing and
fixing the name of two public roads in Bowie County, Texas; and it
appearing to the Court that the same ought to be granted.
Upon
motion of G. A. Richardson, County Commissioner of Precinct No. One and
duly seconded by C. G. Dalby, County Commissioner of Precinct No. Four
and all voting yes, that the public road running from the State Line to
the Boulevard at Spring Lake Park be designated and known as the
McCartney Boulevard in honor of W. A. McCartney; and that the road
running from Spring Lake Park to the Summerhill Public road be
designated and known as the Davis Boulevard in honor of D. L. Davis.
ORDER DECLARING RESULT OF PROHIBITION ELECTION
Thursday the 30th day of March, A. D. 1916.
On
this day the Commissioners’ Court of Bowie County, Texas, met in
special session, at the Court House in said County, present and
presiding Honorable Lee Tidwell, County Judge of Bowie County, Texas,
and the following named Commissioners, G. A. Richardson, J. W. McAnulty
and S. M. Braswell, for the purpose of opening the polls and counting
the votes of an election held in and throughout Bowie County, Texas, in
all of the various voting precincts of Bowie County, Texas, at the
regular voting places in said voting precincts on the 18th day of
March, A. D. 1916, in pursuance of the former orders of this Court, for
the purpose of determining whether or not the sale of intoxicating
liquors should be prohibited in Bowie County, Texas, and the Court
having opened the polls and counted the votes cast thereat, found as
the result of such count that at said election a total of 3475 votes
were cast, of which 2302 votes were cast for Prohibition and 1173 votes
were cast against Prohibition, making a majority of 1129 votes cast at
said election for Prohibition.
It
is therefore ordered, adjudged and decreed by the Court that the result
of said election was, that the majority of the votes cast thereat were
for prohibition. And it is further ordered, adjudged and decreed
by the Court that the sale of intoxicating liquors be, and the same is,
hereby absolutely prohibited in Bowie County, Texas, except for the
purposes and under the regulations specified in Title 69 of the Revised
Civil Statutes of the State of Texas, until such time as the qualified
voters of Bowie County, Texas, may, at a legal election held for such
purposes, by a majority vote decide otherwise.
It
is further ordered, adjudged and decreed by the Court that this order
shall take effect and be enforced from and after the publication of the
same for the time and in the manner prescribed by law.

was made by J. W. McAnulty, Commissioner, Precinct No. Two and duly
seconded by O. D. Akin, Commissioner, Precinct No. One that the said
Dr. W. S. Tyson be appointed County Health officer for the next ensuing
two years, which motion was placed to a vote and all of the
Commissioners present voting yes.
It
is therefore ordered and adjudged by the Court that the application of
the said Dr. W. S. Tyson be and the same is hereby granted, and the
said Dr. W. S. Tyson, be and he is hereby appointed County Health
officer for Bowie County, Texas, for the next ensuing two years at and
for the sum of Ten Dollars per month, or until the further orders of
this Court, and it is so ordered by the Court.
APPLICATION FOR COUNTY HEALTH OFFICER.
On
this the 17th day of November, A. D. 1916, came on to be heard and
considered by the Court the application of Dr. J. W. E. H. Beck to be
appointed County Health Officer for Bowie County, Texas, and it was
moved by J. E. Elliott, Commissioner Precinct No. Three that the said
Dr. J. W. E. H. Beck be and appointed County Health officer, failing to
receive a second to the said appointment, said motion was lost.
ORDER APPOINTING JANITOR FOR THE COUNTY COURT HOUSE AT BOSTON.
On
this the 17th day of November, A. D. 1916, came on to be head and
considered before the Court the application of J. C. Ross to be
appointed County Janitor for the County Court House at Boston; and it
appearing to the court that said applicant presents to the Court the
best bid therefore, being for the sum of Forty-Five Dollars per month
during the winter months or as long as that it requires wood to be
carried up in the Court Room for the use of making fires, and then
after that at and for the sum of Thirty-Five Dollars per month.
It
is therefore ordered, adjudged and decreed by the Court that the said
J. C. Ross be and he is hereby employed as janitor for the County Court
House at Boston at and for the sum of Forty-five Dollars per month
during the winter months or as long as that it requires fires to be
made in the Court room or fires made in the upstair offices, and then
after that date at and for the sum of Thirty-five Dollars per month for
the ensuing two years, or until the further orders of this Court basing
said employment upon the faithful performance of the said J. C. Ross
rendering good and faithful work and keeping said building and offices
in a clean and sanitary condition at all times.
