CHARGED WITH EMBEZZLEMENT

Alleged Defendant Misappropriated
Sum Of $30.00

Among the true bills returned by the recent grand jury was one against John
Love, a negro boarding house keeper of this city, on a charge of
misappropriating funds left in his hands to the amount of $30.00.
The complaining witness is Sam Kelly, also a negro, and
whose is not in Marlin.
According to Sam's story, he came to Marlin for his
health and stopped a short time at Love's boarding house. Having $30.00 more
than he needed, and being possessed of great faith in his race, and particularly
John, be turned this money over to the latter requesting him to send it to a
member of his family in a distant community. Time wore on and Sam heard no
response from the party to whom he desired the money sent.
Then Sam grew suspicious. He accosted John and John
claimed that he had placed the money in a letter and deposited the letter,
properly addressed, in the post office at Marlin. This was in the first part of
the threatened exposure. It appears that after this claim was made the post
office employes were consulted and one of them affirms that an envelope,
containing what, the deponent knew not, had been dropped in the letter box, with
the name of Sam's relative on the "adress" side, but with a post office not in
the guide or unknown to post office officials, and that for this reason the
envelope was returned to the sender.
Then John remembered that he got so much mail that he
did not remember how much he did get, nor the appearance of the wrappers
thereon; that his mail was so large, in fact, that he did not have time to read
it all and that if the letter was returned to him, it was probably among this
accumulated surplus of mail and that he would "look it up".
When pressed a little closer on the subject, John got
busy and
re-imbursed Sum to the extent of $10.00. But his explanation did not seem to
satisfy the grand jury and the indictment resulted.
