Last Will and Testament of Joseph T. Selby


Being fully conscious of the uncertainty of life and the certainty of death which may overtake me, as it may all others, at an hour where I can least expect it, and being of sound mind and desirous to have all my business affairs in a condition to be disposed of after my death, according to my own will and wishes, and also according to ideas of justice and equity and right, I, J. T. Selby, do make and publish this, my Last Will and Testament, as follows:

1st: After paying my debts and settling up my estate in full, I give and bequeath to my beloved wife, Margaret F. Selby, in her own right in fee simple, to have and to hold while she remains my widow, all the residue of my property, both personal and real, lying and being in Denton County, or elsewhere which I now own individually or in connection with any other person, and I also give and bequeath to her in her own right, under like condition, all property both personal and real which I may hereafter acquire, by purchase, inheritance or otherwise, before or after my death.

2nd: If, after my death, my wife Margaret F. Selby shall marry again, I direct that the property left to her, in the first section of this, my Last Will and Testament, and which is therein described, shall be equally divided between her and our two children, Mattie Florence Selby and Effie Wells Selby.

3rd: If my beloved wife Margaret F. Selby shall deem it best for her good and the good of our children to dispose of the homestead, I desire that she shall do so, and I hereby give her the power to dispose of said homestead and to warrant the title to any one purchasing the same, without an order to decree from any court.

4th: Having full confidence in the ability and capacity of my wife, Margaret F. Selby, and having implicit confidence in the honesty and integrity of my friend, N. Wilson, I do hereby constitute and appoint these two, Executors of this my Last Will and Testament, with full power and authority to carry out its provision, and I further desire and direct that no security be requested of my two Executors in carrying out the trust I hereby repose on them

In testimony whereof I have hereunto my hand and scroll for seal in the presence of M. Stelzer, R. T. Bowling and J. A. L. McFarland, subscribing witnesses, at my request.

Done at Pilot Point, Denton County, Texas, August the 27th, A. D. 1878.
