    This 4th day of July 1859. This Indenture made and entered into by and between William F. Smith of the County of Marion and State of Tennessee of the one part and Reubin Smith of the other part both of the County and State aforesaid witnesseth, that for and in consideration of the sum of two hundred and fifty eight dollars in hand paid the receipt of which is hereby acknowledged, I, William F. Smith have granted, bargained and sold and by these presents do bargain, grant and sell and deliver to the said Reubin Smith his heirs and assigns forever a certain tract or parcel of land containing forty two and a half acres by survey. Bounded as follows to wit, Beginning at a Hickory the beginning corner of the said William F. Smith land then went 45 poles to a stake and pointers near branch then South 16� East 120 poles to a stake thence East 2 poles to a stake then South 70� West 23 poles to a Dogwood on the bank of a branch then up the same as it meanders North 80� East 53 1/2 poles to a stake and pointers on the bank of said branch then North 14� West 135 1/4 poles to stake and pointers then South 77� West 8 � poles as the beginning. To have and to hold the above described tract of land with all its a purtenancesI, William F. Smith warrant and forever defend against the claim or claims of any person or persons whatever unto the said Reubin Smith his heirs and assigns forever.

    Personally appeared before me W. Byrne Clerk of the County Court of said County William F. Smith with whom 7 am personally acquainted who acknowledged that he executed the foregoing deed of conveyance on the day it bears date, for the purposes therein contained and expressed.
