    This indenture made the (?) day of May 1852 between Thomas Smith of the County of Marion and State of Tennessee of the one part and BENJAMIN F. SMITH of the County and State aforesaid of the other part witnesseth that the said THOMAS SMITH for and in consideration of the sum of one thousand dollars to him in hand said by the said BENJAMIN F. SMITH, before the sealing and delivery of these presence the receipt is hereby acknowledged hath granted bargain seal and by these presence both grants, bargain and seal unto the said BENJAMIN F. SMITH his heirs and assigns forever. A certain tract or parcel of land situated in the County of aforesaid on the southeast side of Sequatchee River containing two hundred fifty-seven acres be the same more or less adjoining land of ALEXANDER HILLARD, JOHN LOWRY, WILLIAM HOLLOWAY, and others; Beginning at a black walnut neat the branch; thence number fifty-nine west when reduced to a strait line two hundred ten poles on the half pen branch; thence north thirty-five, east eighteen poles to pointers; thence west one hundred forty-three poles to a black gum at the river; thence south one hundred forty-four poles to a white oak; thence east one hundred thirty-five poles to a stake in SMITH's field; thence south sixty-nine poles to a stake in LOONEY's field; thence east one hundred and two poles to a ELUMON HILLARDS Spring branch; thence up the same as it meanders when reduced to a strait line north forty-two east one hundred and twelve poles to the being including the place and premises whereon the said BENJAMIN F. SMITH now lives together with all and singular the Tenants appurtenances and hereditaments there appertaining there appertaining or belonging to have and to hold the same above described tract or parcel of land hereby granted bargained and sold and every part and parcel thereof with all the tenants and appurtenance thereunto belonging for the proper use and benefit of the said BENJAMIN F. SMITH for himself and his heirs all and singular the premises hereby granted bargained and sold with the hereditaments and appurtenances there unto the said BENJAMIN F. SMITH for his heirs and assigns against him the said THOMAS SMITH his heirs and every and all person or persons whatsoever shall and will forever warrant and defend the same in witness the said THOMAS SMITH have here unto set hand and seal the day and date first above written.
