    This indenture made the twenty-first day of May in the year of our Lord one thousand eight hundred and fifty-one by & between Thomas Smith of the County of Marion & State of Tennessee of the one part and Edwin Duke of the County aforesaid of the other part-- Witnesseth that the said Smith for and in consideration of the sum of three hundred and thirty-seven and one half dollars, to him in hand well paid the receipt whereof is hereby acknowledged hath granted, bargained & sold and by this presents both grant, bargain & sell unto the said Edwin Duke his heirs and assigns a certain tract of parcel of land situate lying and being in the County of Marion and adjoining lands with said Smith on the East & Mc?ee on the West, H. Richards on the South & W. Wilson, on the north beginning and cornering in the Big road on the South East of the tract at stake & pointers, thence with the center of the Big road N. 20� E. 113 poles & 12� feet to a stake and pointers, thence W. 208 poles to pointers, thence S. 35 W. 75 poles & 12� feet to a black oak, thence E. 180 poles to pointers in dry branch, thence South 44 poles to pointers, thence East 32 poles to beginning by est Marion containing one hundred & twelve and � acres of land with all appertenances thereunto belonging or in any wise appertaining and all the estate tight title interest claim and demand whatever of him the said Smith or in and to the said lands and premises and every part and parcel thereof.

    To have and to hold the said land and premises and every part and parcel thereof with appurtenances unto the said E. Duke his heirs and assigns to the only proper use, and behoof of the said Duke his heirs and assigns forever. And the said Smith for himself and his heirs the said lands and premises and every part and parcel thereof against himself and his heirs and all and every other person whatever will warrant and forever defend to the said E. Duke his heirs and assigns.

    Personally appeared before me, James H. Conatser, Clerk of the County Court of Marion County State aforesaid, Thomas Smith, the within bargainor with whom I am personally acquainted who acknowledged that he made and executed the within transfer and assignment for the purposes therein contained and expressed upon the day it bears date.
