This deed of general warranty made the 29th day of August in the year of our Lord one thousand eight hundred and thirty three between Isaac Easterly of the one part of the State of Tennessee & County of Warren and Laton K. Smith of the State of Tennessee & County of Marion.

Witnesseth that for and in consideration of the sum of two hundred & seventy five dollars to me in hand paid by the said Smith I have this day bargained and sold unto said Smith a certain tract or parcel of land containing one hundred & sixty acres lying in Marion County on the south east side of Sequatchee River bounded and described as follows adjoining lands of White & W. H. Standefer M. Mitchell & James Mayo.

Beginning on a stake and pointers a corner to White & Mayo thence with White's line south to a dogwood one hundred & twenty poles on Standefers line, thence with the same fifty three poles to a black oak a corner to Mitchell thence with the same fifty poles north to a dogwood thence east ninety eight poles to pointers thence with a conditional line north fifty four east twenty poles to a black oak thence north fifty eight east thirty four poles to a stake & pointers thence north twenty east twenty three poles to a red oak & post oak a corner to Cusart thence north with his line fifty four poles to pointers a corner to Cusart's thence east twenty poles to pointers at the foot of a spur of the mountain thence north with the same twenty three poles to pointers thence west one hundred & twenty eight poles to pointers a corner to Mayo's thence south with his line forty two poles to white oak a corner to Mayo's thence west with his line fifty eight poles to a stake at Mayo's corner thence with his line twenty poles to a stake a corner to Mayo thence west twenty poles to the beginning.

To have and to hold to the said Laton K. Smith and his heirs and assigns forever with all the appurtenances belonging to said tract of land and do hereby warrant and defend the title unto said land against myself my heirs and assigns forever to the said Smith his heirs and assigns forever as an indefeasible estate.

This Indenture made this tenth day of September in the year of our Lord one thousand eight hundred and thirty five betwixt Laton K. Smith of the County of Marion & State of Tennessee of the one part and Nathaniel Langly of the State & County aforesaid of the other part.

Witnesseth that the said Laton K. Smith for and in consideration of the sum of one hundred dollars to him in hand paid by the said Nathaniel Langly the receipt whereof is hereby acknowledged hath given granted bargained and sold aliened conveyed & confirmed unto the said Langly his heirs and assigns forever a certain tract or parcel of land situate and lying and being in the County of Marion and State of Tennessee lying on the south east side of Sequatchee River being part of a tract of land that Isaac Easterly sold unto said Smith known by the name of the Davis tract bounded and described as follows:

Beginning on a dogwood marked J. C. a corner to Mitchell & Langly thence east fifty three poles to a black oak corner to Ross thence north eighty poles to pointers thence east forty nine poles to a white oak thence north forty poles to a black oak on Anderson's line then west one hundred and two poles to a poplar Langlys corner thence a direct line south one hunded & twenty poles to the beginning so as to include fifty acres adjoining lands with Langly and Anderson

to have and to hold the aforesaid land with all and singular by the rights refits & emoluments here ? and appurtenances thereunto belonging or in anywise appertaining to the only proper use and behoof of him the said Langly his heirs & assigns forever and the said Smith for himself his executors & administrators doth covenant and agree to and with the said Langly his heirs and assigns that the affore recited lands & bargained premises he will warrant and forever defend against the right title interest or claim of all and every other person or persons whatsoever

To Deed 50 acres
Hezekiah Frederick.

This indenture made this thirty first day of January in the year of our Lord one thousand eight hundred and thirty seven between Laton K. Smith of Marion County and State of Tennessee of the one part and Hezekiah Fredrick of County and State aforesaid of the other part.

Witnesseth that the said Laton K. Smith for and in consideration of the sum of one hundred and seventy five dollars to him in hand paid by the said Fredrick the receipt whereof is hereby acknowledged hath given granted bargained and sold unto the said Fredrick his heirs and assigns forever a certain tract or parcel of land containing fifty acres lying in the County aforesaid on the mountain and on a fork of Chickamauga Creek including the improvement that John Harvel made on said tract.

Beginning on a double black oak on the side of a ridge south of said improvement, north nine east crossing the creek one hundred poles to a sourwood on the side of a ridge, then north eighty one west along the side of ridge eighty poles to a sourwood and dogwood on a drain thence south nine west crossing the creek again one hundred poles to a Spanish oak then a direct line to the beginning.

To have and to hold to the said Hezekiah Fredrick and his heirs and assigns forever with all the appurtenances belonging to said tract of land, and do hereby warrant and defend the title to said land against myself my heirs and assigns forever to the said Fredrick his heirs and assigns forever as an indefeasible estate.

The administrator of Laton K. Smith

State of Tennessee. Hamilton County. Monday September 6th 1852.

Be it remembered that at a County of Chancery opened began and held at the Court House in the town of Harison in the County and State aforesaid the first Monday of September 1852 and on the sixth day of said month before the Thomas D. Williams Chancellor of the Eastern Division of said State presiding.

The following other proceeding we have Henry Harvell and his wife Sarah Harvell, James N. Smith, Alfred M. Smith, William J. Smith and J. Smith minors heirs of Laton K. Smith by their guardian Aaron Smith expart.

It appearing from the report of the Clerk and Master heretofore made that in this case he had under order and decree of this Court sale the land mentioned in complaints bills and at the sale Aaron Brown purchased the first tract containing two hundred acres on the south east side of Sequatchee River on the side of Waldens Ridge on the waters of Easterlies Mill Creek.

Beginning at a white oak near the head of said Easterlies Mill Creek corner to his mill tract of land and running with the line of said tract land and the meanders of the mountain south seventeen poles to a chestnut south seventy five degrees west forty poles to a bunch of dogwoods west forty five poles to a black oak south fifty degrees west thirty six poles to pointers south thirty three degrees west twenty eight poles to pointers then south forty five degrees west one hundred and ten poles to a dogwood on the spur of the mountain then north eighty two degrees east seventy two poles to a black walnut then up the mountain east seventy poles to a locus black locus then south forty five degrees east one hundred poles to a chestnut oak thence along the side of the mountainside north forty five degrees east one hundred sixty poles to a black walnut and pointer then north forty nine degrees west one hundred and sixty poles to the beginning.

Said Aaron Brimer being the highest and best bidder became the purchaser at the sum of one hundred dollars all of which sum has since been fully paid unto the hands of the Clerk and Master of this County.

Joshua Easterly became the purchaser of the second tract containing one hundred acres lying on the south east side of Sequatchee River on a spur of Waldens Ridge on the waters of Easterlies Mill Creek.

Beginning on a beech running thence south forty six poles to a dogwood then up the ridges south sixty seven degrees east forty nine poles to a chestnut oak then south fifty six poles to a pine and pointers, then east seventy poles to a stake on the side of the mountain then north one hundred and eighty poles to a black walnut in the line of the two hundred acres then south forty five degrees west seventy poles to the beginning.

Said Easterly being the highest and best bidder became the purchaser at the sum of forty four dollars which has since been paid unto the hands of the Clerk and Master of this Court.

John W. Hoodenpyle became the purchaser of the third and fourth tracts supposed to contain twenty and one forth acres lying on the waters of Easterlies Mill Creek

Beginning on a stake and pointers on said Creek near the mouth of a branch then up the branch to the mountain to pointers on the Cozer (maybe should be Cusart) line then with the same to May"s corner on a chestnut then May's line north fifty eight west sixty six poles to a Spanish oak May's corner then with his line north eighteen degrees east twelve poles to the beginning.

And the said fourth tract supposed to contain one fourth part of an acre described as follows,

all the land south of a line beginning on a small beech marked L.T. E.T. standing on the Bank of Easterlies Mill Creek then a straight line by a sweet gum and sycamore marked L.K.L. on the bank of said creek then a straight line on the mountain and on to the foregoing two hundred acre tract.

Said John W. Hoodenpyle being the highest and best bidder became the purchaser at the sum of two hundred dollars all of which has since been fully paid unto the hands of the Clerk and Master of this Court.

And Aleen Kirklen became the purchaser of the fifth tract containing seventy acres being the remainder of a track of 160 acres, 90 acres of which had been sold sealed and conveyed by Laton K. Smith said 150 acres beginning on a stake and pointers corner to White and Mays then with White's line south one hundred and twenty poles to a dogwood on the Standifer's line then with the same fifty three poles to a black oak corner to Mitchell then with the same north fifty poles to a dogwood then east ninety poles to pointers then with a conditional line north fifty four poles to a black oak then north fifty eight degrees east thirty four poles to a stake and pointer then north twenty degrees twenty three poles to a red oak and pointers on the corner of the Cozert tract then north with his line fifty four poles to pointers to Cozert then east twenty four poles to the foot of the mountain then with the same twenty three poles to pointers then west one hundred and twenty eight poles to pointers a corner to Mays then south with his line forty two poles to a white oak corner to Mays then with the line twenty poles to a stake and pointers corner to Mays then west to the beginning.

Being the highest and best bid said Kirklen became the purchaser at the sum of two hundred and eighty dollars all of which has since been fully paid unto the hands of the Clerk and Master of this Court.

And the Court being fully satisfied at this of this Court that the whole of the purchaser money has been fully paid by each of the purchasers.

Received the 6th day of September 1852.
Registered the 9th day of September 1852.

It is therefore ordered and decreed by the Court that title to said lands to be vested in the purchasers and that the title to said first tract two hundred acres be vested in Aaron Brimer and his heirs and assigns forever.

That the title to said second tract of one hundred acres be vested in Joshua Easterly and his heirs and assigns forever.

That the title to the third and fourth tracts of twenty four and one fourth acres be vested in John W. Hoodenpyle his heirs and assigns forever.

And the title to the said fourth tract of seventy acres be vested in Aleen Kirklen and his heirs and assigns forever and it is further ordered and decreed by the Court that certified copies of this decree that same may be registered in the Registrars office of Marion County Tennessee as evidenced of title of said lands to said purchasers.

I William J. Standefer Clerk and Master in the Chancery Court in the County and State aforesaid do hereby certify that the foregoing is a true and correct copy of for decree in the case of Laton K. Smith this has be there guardian Aaron Smith as the same appears of record in my office of Clerk and Master as aforesaid.
