March 12, 1880

State of Tennessee, Marion County.

This indenture made entered into this 1st day of 1879 between Henry S. Kelly of the County of Marion, State of Tennessee of the one part and Geo. D. Smith of the other part of the County and State aforesaid.

Witnesseth that the said Henry S. Kelly for and in consideration of the sum of one hundred and fifty dollars paid by notes the receipts of which is hereby acknowledged hath and doth by these presents grant Deed convey and deliver unto the said Geo. D. Smith, his heirs and assigns, forever a one fourth interest in the dower assigned to Sarah Smith, widow of Martin Smith. Deed containing fifty acres be the same more or less lying on the South west corner of the Rubin Smith farm including all of the buildings of said dower and bounded on the South & West by Johnsons on the North & east by Geo. D. & J. R. Smith.

To have and to hold the above described land with all its appurtenances, I, Henry S. Kelly, bind myself, my heirs and assigns, to warrant and forever defend the above described land against all other claims whatever unto the said Geo. D. Smith, his heirs and assigns, forever in testimony whereof I have this day set my hand and seal.

Personally appeared before me John L. Minter. Clerk of said County, Henry Kelly and wife Amanda Kelly, the within named bargainers with whom I am personally acquainted and who acknowledged that they executed the within Deed for the purposes therein contained and Amanda Kelly, wife of the said Henry Kelly, having appeared before me privately and apart from her husband, the said Amanda Kelly acknowledged the execution of the said Deed to have been done by her freely, voluntarily and understandingly without compulsion or constraint from her said husband and for the purposes therein expressed.

Witness, John L. Minter, Clerk of said Court at office, this 12th day of March A. D. 1880.

Smith and Lorinda Smith, the within named bargainers with whom I am personally acquainted and who acknowledged that they executed the within Deed for the purposes therein contained and Lorinda Smith, wife of said Thomas M. Smith, appeared before me privately and apart from her husband, said Lorinda Smith acknowledged the execution of the said Deed to have been done by her freely, voluntarily and understandingly without compulsion or constraint from her said husband and for the purposes therein expressed.
