Whereas on the 15th day of June 1870 Geo F. Smith former Clerk & Master of the Chancery Court at Jasper Tennessee my (predecessor in office) in pursuance of a decree of said court rendered on the 16th day of March 1870 proceeded to sell (with other lands belonging to the estate of Robert S. Raulston deceased) tract No 6 being the North west half of a 5000 acre tract granted to James M. Bryson which had before been partitioned between said estateand said Bryson, said sale was made after legal advertisement at the Court House Door in the town of Jasper at public sale to the highest bidder on a credit of one, two and three years (except ten percent paid down) notes bearing interest from the day of sale, at which sale said tract of land was struck off to A. A. Hyde at the sum of five hundred dollars, his being the highest and best bid. The tract of land so sold and bid off is bounded and described as follows to wit:

Lying in Marion County Tennessee, eastward of Battle Creek on the side and top of Cumberland Mountain. Beginning at a stake on the east side of Battle Creek near the foot of the mountain, Hinche Gilliams corner, a post oak, persimmon & black oak poimters; thence south 3 deg east 129 poles to a dogwood, Harrises north east corner, thence south 114 poles to a stake on Hises line, hickory pointers, thence east with said line 65 poles to a poplar, Hises north east corner, thence south with Hises line 160 poles to a stake; thence south 64 deg east 28 poles to a stake Hises corner, thence east 90 poles to a stake, hickory, sourwood & forked beech on the side of the mountain, Hises corner; thence north 5 1/2 deg east 1100 (eleven hundred) poles to the north east corner of said Byrson's tract; thence west 815 poles to a stake; thence south 881 poles to the beginning containing about 2692 acres more or less.

And whereas on the 29th day of Oct 1870, the aforsaid sale of said tract of land was confirmed by said Chancery Court and all the title thereto vested out of the heirs at law of said Robert S. Raulston deceased, and the same vested in A. A. Hyde the purchaser and in Geo F. Smith (to whom said purchaser had transferred a grant(?) and equal interest) their heirs and assigns forever, subject to a lein for the purchase money until paid.

Whereas it is further ordered by said decree of confirmation that the purchasers; upon full payment of the purchase money, shall be entitled to a deed from Clk & Master of said Court as a muniment of title, and the lein for said purchase money having been discharged by said A. A. Hyde & Smith by the full payment of the purchase price, with the accruing interest, and the said A. A. Hyde and G. F. Smith having fo a valuable consideration transferred and assigned to Augustus R. Wright all the right title and interest acquired by them by virtue of said sale and purchase, confirmation vesture and divesture of title and by the full discharge of the lein aforesaid, do order & direct that the deed to said tract of land be made by me to said Wright.

Now therefore, I George S. Deakins Clerk & Master of the Chancery Court at Jasper Tennessee in consideration of the premises do hereby transfer and convey in fee simple to said August R. Wright, his heirs and assigns forever all the right, title, claim and interest in and to the before described tract of land of 2692 acres more or less, heretofore vested in James M. Bryson, the heirs at law of Robert S. Raulston and in said A. A. Hyde and Geo F. Smith for the consideration as aforesaid, to have and to hold said tract of land to the said Augustus R. Wright, his heirs and assigns forever in as full and ample a manner as I as Clerk & Master as aforesaid can or ought to convey the same but no further or otherwise.
