30� Acres.Whereas at the July term of the worshipfully County of Marion County which sat at eh Court House in said County on the first Monday in July 1868 the report of WILLIAM HOLLOWAY, ROBERT E. C. DAVIS, AND A. K. KELLY, Commissioners, and G. L. MITCHELL, Surveyor appointed by said Court to partition the lands of RUBEN SMITH deed, was presented to the Court and be in unexecuted to was in all things confirmed and ordered to be spread of record, and whereas it further appearing from said report and the Platt accompanying it that Lot No. 1 containing thirty and one half acre (30�) had been assigned to ELMUS SMITH, which said or is bounded and described as follows to wit: Beginning at a stake at the northwest corner of SARAH SMITH DOWER, running thence north ninety-eight poles to pointers; thence east forty-nine 8/10 poles to a stake and pointers; thence north ninety-eight poles to a stake in the north boundary in thereof said lower; thence with the same west forty-nine 8/10 poles to the beginning. Now therefore, I, HOWELL G. BLANSETT, Clerk of the County Court of said County in consequence of the premises as a foresaid do herby transfer and convey the said tract of land above described to the said ELMUS SMITH, and his heirs and assigns forever in as full and ample manner as I am as Clerk aforesaid to authorized and required to do by law but no further or otherwise.
