THOMAS M. SMITH

This indenture made and entered into this the 25th day of September 1849 by and between MICHAEL BURKHALTER, of the County of Marion and State of Tennessee of the one part and THOMAS M. SMITH, of the County of Marion and State aforesaid of the other part withnesseth that the said, MICHAEL BURKHALTER, hath this day bargained sold and delivered to the said, T. M. SMITH, for the sum of eight hundred dollars in hand paid the receipt whereof is hereby acknowledged a certain tract or parcel of land containing one hundred and sixty acres more or less situated in Marion County on the east side of Sequatchee River and runs as follows: Beginning on a white oak on the southeast bank of said river; thence down the same as it meanders south forty-seven, west eighteen poles, south seventy-five, west sixteen poles, south seventy, west forty-six poles, south fifty poles, south twenty-eight, east forty poles, south nineteen, east fifty poles to an elm and water oak; thence east one hundred and thirty-two poles to a water oak on the MAXWELL's line; thence north forty-four poles to a poplar; thence north thirteen, east eighty poles to a black oak; thence north sixty-five, east forty poles to a hickory; thence north fifty-nine, west sixty-seven poles to a black gum; thence west to the beginning together with all that appertains here unto to the said, T. M. SMITH, his heirs executors and assigns.

To have and to hold the right whereof I do bind myself my heirs executors and assigns forever to warrant and defend against the lawful claims of all other. In witness whereof I here unto set my hand and seal the day and date above written.
