This indenture made and entered into the eight day of May in the year of our Lord one thousand eight hundred and fifty-four between ANDERSON SMITH, of the County of Jasper in the State of Missouri of the one part and ABBOTT SMITH, of the County of Marion in the State of Tennessee of the other part witness that the said, ANDERSON SMITH, for and in consideration of the sum of eight hundred dollar to him in hand paid by the said, ABBOTT SMITH, the receipt of which is hereby acknowledged hath granted bargained and sold and do by these resents grant, bargain and sell confirm and convey unto the said, ABBOTT SMITH, and into his heirs and assigns forever the following described tracts or parcel of land situate lying and being in the County of Marion and State of Tennessee to wit: thirty-seven acres more or less and bounded a follows and adjoining the lands formerly owned by MATTHEW PRYOR, SR., but now owned by RAPHAEL SHELTON, Beginning at the northeast corner of said RAPHAEL SHELTON, one hundred acre survey; thence running with the same west fifty-three rods to a stake on a former conditional line between MATTHEW PRYOR, SR., and MATTHEW PRYOR, JR., but now the line dividing the lands of RAPHAEL SHELTON and ELIZABETH CARLOCK; thence south sixty-eight poles to pointers on the school land or where they originally stood; thence east ninety-six poles to a sour wood tree corner of the school land; thence nine poles to a stake; thence north 71� west twenty-three poles to the beginning being the same piece of land conveyed to the said ANDERSON SMITH by MATTHEW PRYOR by deed bearing date February 21st 1850; and also the following described tract of land situate lying and being in the County of Marion and State of Tennessee and being the same tract of land conveyed to the said, ANDERSON SMITH by THOMAS SMITH, by deed bearing date the first day February A.D. 1828 and is bounded and was adjoining the following lands on the said first day of January 1828, to wit: to wit: Beginning at a hickory and pointers on the bank of a branch here tofore called the dry branch on a conditional line made between MATTHEW PRYOR and ENOCH OWENS; thence with said conditional line south 71� east twenty-one poles to pointers; thence south twenty-two poles to a black oak on SHELTONs line; thence with his line east twenty poles to pointers; thence north 20�east sixty poles to a sweet gum; thence east eighty-seven poles to a black oak a corner of DUDLEYs land; thence with his line north 16� east one hundred and sixty poles to a stake in WILLIAM DOUGLAS line; thence with his line west thirty-three poles to a small plumb bush; thence North four poles to a stake PHILLIP PRYOR's corner; thence with his line West one hundred and seventeen poles to a stake and pointers on the east boundary of the school land; thence with the same south eighty-seven poles to a stake on the aforesaid branch having passed the southeast corner of the school land nine poles; thence down said branch with the different meanders thereof as a conditional line here to fore made between ENOCH OWENS and John H. PRYOR in their occupant entries to the beginning, and containing one hundred and forty-seven acres and forty-seven poles be the same more or less and is situated on the southeast side of Sequachee River in said County of Marion in said State of Tennessee together with all and singular the privileges and appurtenances there unto belonging or in any wise appertaining. To have and to hold the above described premises unto the said ABBOTT SMITH, his heirs and assigns forever. And the said ANDERSON SMITH, the aforesaid premises every person whomsoever do and will warrant to forever defend by these presents in testimony whereof I the said, ANDERSON SMITH party of the first part has here unto set his hand and affixed his seal the day and date aforesaid.

Be it remembered that on this eighth day of May in the year of our Lord one thousand eight hundred fifty-four personally appeared before me, ELLWOOD B. JAMES, Clerk of Circuit Court with in and for the County and State aforesaid ANDERSON SMITH, who is personally known to me to be the person whose name is subscribed to the foregoing deed of conveyance as a party thereto acknowledged that he executed the same for the purposes therein mentioned.

In testimony wherof I, ELLWOOD B. JAMES, Clerk of the Circuit Court within and for the County of Jasper aforesaid have hereunto signed my name and affixed the seal of said Circuit Done at office this 8th day of May A.D. 1854
