State of Tennessee, Benton County, July Term 1845

At a County Court began and held for the County of Benton at the Courthouse in the Town of Camden on the first Monday in July.  It being the 7^th day of said Month in the year of Our Lord one thousand eight hundred & forty five & 70^th year of American Independence.  There being present and presiding on the bench the worshipfuls, Esqrs. D.P. Hudson, Chairman, E. Perkins, N. Williams, Thos. R. Jett, S.H. Davidson, Eligiah Alsop, Geo. W. Farmer, John D. Rushing, John D. Rushing, John W. Davidson, Wm. M. McAuley, H. Greer, D.W. Benton, William Barnes, B. Beard and J.R. Mathews.

Personally appeared in open Court John Hignite, Administrator of the Estate of Peter Hignite deceased and Made return of the inventory & sale bill of said estate and oath having been made to the same.  It is ordered to be recorded.

Personally appeared in open Court Jonathan K. Thomas and produced a commission from his excellency James C. Jones, Governor of the State of Tennessee, Commissioning the said Thomas a Justice of the Peace in & for the County of Benton. Whereupon the said J.K. Thomas appeared and took an oath to support the Constitution of the United States & of the State of Tennessee, an oath against dueling & the oath of office.

Personally appeared in open Court William H. Smally and produced a commission from his excellency James C. Jones commissioning him a Justice of the peace in and for the County of Benton.  Whereupon the said Smally took an oath to support the Constitution of the United States and the State of Tennessee an oath against dueling & the oath of office.

Personally appeared in open Court Amos Bruce, who was this day chosen and appointed guardian of the Minor heirs of Burrel Lashlee deceased and together with him William Smith his security who appeared in open Court and acknowledged the due execution of their bond in the penal sum of Two thousand dollars conditioned as the law directs.

July Term 1845

The Court then proceeded to appoint judges to hold the election in the several districts of the County of Benton the 7^th day of August Next, as follows;

The Clerk of this Court presented a settlement made with John Pearce security of Martha Wyatt deceased as guardian of the Minor heirs of Isaac Wyatt deceased which said settlement was examined Not concurred in by the Court.

The Clerk of this Court presented a settlement Made with James Stepto one of the administrators of the estate of Hilliary Capps dec. which said settlement was examined and approved by the Court and ordered to be recorded.

Personally appeared in open Court Joel Rushing guardian of the Minor heirs of Abel Rushing deceased and together with him J.W. Utley, Jackson Rushing and Noah Rushing his securities who appeared in open Court and acknowledged the due execution of their bond in the penal sum of Two hundred dollars condition as the law directs.

The Clerk of this Court presented a settlement Made with Sarah Hatley guardian of the Minor heirs of Hardy Hatley deceased which said settlement was examined and approved by the Court and ordered to be recorded.

The Clerk of this Court presented a settlement with Susannah Holland, guardian of the Minor heirs of Meritt Holland deceased which said settlement was examined and concurred in by the Court and ordered to be recorded.

July Term 1845

The Clerk of this Court presented a settlement Made with Mary Pully guardian of the Minor heirs of William Pully deceased which said settlement was examined and approved by the Court and ordered to be recorded.

The Clerk of this Court presented a settlement Made with Jesse Williams executor of the last will and testament of Nancy Harrison deceased which said settlement was examined and approved by the Court and ordered to be recorded.

The Clerk of this Court presented a settlement Made with Amos Bruce guardian of the Minor heirs of Burrel Lashlee deceased which said settlement was examined and approved by the Court and ordered to be recorded.

The Clerk of this Court presented a settlement Made with Calvin Hall Administrator of the estate of William and Henry Hall deceased which said settlement was examined and not concurred in by the Court for reasons therein expressed.

The Court then proceeded to Make an appropriation to Josiah T. Florence, for the half valuation of a stray cow which had been posted and the said Florence Made oath that the said cow was his right & property.  Whereupon it is ordered by the Court there being a Majority of all the Justices in said County on the bench and all voting in the affirmative, that the said Josiah T. Florence be allowed & paid the sum of Two dollars and that the Trustee of said County pay the same out of any Money in the Treasury for general County purposes not otherwise appropriated.

Issued July 19^th.

David Brewer, Sheriff and Collector of the public taxes for the County of Benton appeared in open Court and returned a list of taxable property & polls in said County for the year 1844.  And oath having been Made to the same as prescribed in the Acts of Assembly in such case Made and provided that the same is insolvent and that he has been unable to collect the State and County tax due severally thereon any part thereof for the said year 1844 which said report is as follows to wit:

Making in all 39 white polls and there being present and presiding on the bench Esqrs. D.P. Hudson, Perkins, Williams, Farmer, Benton, Thomas, J.W. Davidson, Beard, Rushing, S.H. Davidson, Alsop and W.H. Smally a Majority of all the Justices in Benton County and all voting in the affirmative.  It is order by the Court that the Sheriff & Collector as aforesaid have a credit for said insolvencies and that the Clerk of this Court Certify the part of State Tax to the Comptroller of the Treasury and the County part to the Trustees accordingly.

On Motion of A.W.C. Methany who Made oath according to law and together with him James Lindsey his security appeared in open Court and acknowledged the due execution of their bond in the penal sum of One hundred dollars conditioned as the law directs.  Whereupon it is ordered by the Court that he have letters of Administration upon the estate of James Daniel to be Made out in due form of law when required.

July Term 1845

The Court then proceeded to Make an appropriation to A.C. Presson former sheriff of Benton County for money which he wrongfully paid which was occasioned by an error in the settlement Made by the revenue Commissioners and there being present and presiding on the bench a majority of a all the Justices in Benton County and all voting in the affirmative, it is ordered by the Court that the sum of Seven dollars & 11 Cents be allowed & paid said Presson by the Trustee of Benton County out of any money in the Treasury for general county purposes not otherwise appropriated.

On Motion it is ordered by the Court that the Sheriff have a credit with the Trustee of Benton County for the poll tax.

Said persons having been listed in two Districts & with the Comptroller 25 cents for tax on two polls they having been listed in two districts.  And that the Sheriff also have a credit with the Trustee for 37½ cents being the amount due the County for Allen Williams^’ poll tax.  He having been listed before he was of age & 37½ cents being the amount of Daniel Massy Jr. poll tax he having been listed before he was of age.

Resolutions -

At a meeting of the County Court & citizens of Benton County held at the Courthouse in Camden J. Wyly was called to the chair when T. Jett, S.V. Aden and D.P. Hudson was appointed to draft resolutions:  Whereas we have heard with deep regret of the demise of Gen. A. Jackson and we believe according to the conventional forms of society we should pay a tribute of respect to departed worth.

RESOLVED          1^st:  That we deplore the death of Gen. Jackson as a national loss.

2^nd:  Resolved that we will wear the usual badge or mourning for 30 days.

3^rd:  Resolved that the proceedings of this Meeting be spread upon the records of the             County Court of Benton County.
