State of Tennessee, Benton County, July Term 1843

At a County Court began and held for the County of Benton at the Court house in the Town of Camden on the first Monday in July it being the 3rd day of said Month in the Year of our Lord one thousand Eight hundred & forty three And the 67th year of American Independence, there being present and presiding on the bench the following Esqrs.. (Viz.) E. Perkins Chairman, D.P. Hudson, Nathan Williams, William A. Steele, Elijah Alsop, David W. Benton, Thos. L. Floyd, Hezekiah Greer, Jesse Hammonds, George W. Farmer, William Barnes, J.D. Rushing, J.R. Mathis, Wm. M. McAuley, B. Beard and John Buchanan.

The Clerk of this Court presented a settlement with James M. and Henry C. Kemp executors of the Estate of George Camp deceased which said Settlement was examined and approved by the Court and ordered to be entered of Record.

The Clerk of this Court presented a settlement Made with Mary Lashlee guardian of the Minor heirs of Burrel Lashlee Deceased which said settlement was examined and approved by the Court and ordered to be recorded.

The Clerk of this Court presented a settlement Made with Reddin Hollowell Administrator of the estate of Hensley Hollowell deceased which said settlement was examined and approved by the Court and ordered to be recorded.

On Motion it is ordered by the Court that the following Named persons be appointed as a jury of review to view and Mark a road to commence at the upper end of James Lindsey's field and running as the road now stands except that part near

said Lindseys lot which part of said road he wants turned on the opposite side of his house and lots and the balance of said road to stand as formerly (Viz.) James Daniel, James Stagner, Nathan Wilfred and William Acres and that the said July report to the next term of this court.

Personally appeared in open Court John Bell and Josiah T. Florence Administrators of the estate of Geo. Bell deceased and returned an Inventory & account of sale of the property of said deceased and oath having been made thereto, it is ordered by the Court to be entered of Record.

Personally appeared in open Court R. C. Mathis and presented a petition to the Court signed by sundry citizens of said County praying a Jury of Review to view and Mark a road leading from Winns' ferry to Camden and to leave said road near the school house on said road and to intersect it again near Dennis Stockdels' & it is therefore ordered by the Court that the following named persons be appointed (viz.) David A. Askew, Green B. Rolls, James McDaniel, Gideon Tozen, Drew A. Askew, James Rolls & William Odem and that said jury Make report at the next term of this Court.

On Motion it is ordered by the Court that the following persons be appointed a Jury of Review to view and Make a road leading from Tennessee River at a point where Lewis Hires lives rods to intersect the road leading from Cottons old ferry to Wyatts Mill at James Lindseys on said road (viz.) James Lindsey, Edward Lindsey, John Wyatt, William Lindsey, James Wyatt & Robert Jackson and that the said Jury Make return to the next term of this Court.

July Term 1843

On Motion it is ordered by the Court that Henry Stigall be appointed overseer of the road in room of Thos. Presson to work from race tracts near James Hudsons to the Creek between Edgar Greer's and said Pressons and the following hands work under said Stigall on said road (viz.) John Presson, J.F. Presson, Thos. Presson, Marcelles Cain and all other hands in the bounds shall work under Stigall on said Road which is established in the 2nd Class.

The Court then proceeded to appoint Judges to hold the election in Benton County to be held the first Thursday in August Next and the following persons were appointed (viz.)

2nd Dis. Green Flowers, James Merrick and Evans Jordan
3rd Dis. James S. Sales, Thomas Swindle and William Ballowe Sr.
4th Dis. Samuel B. Pearce, John Morris and John F. Johnson
5th Dis. Wilson M. Serratt, Willis Rushing and S.V. Aden.
6th Dis. John Pearce Sr., Levine Cottingham and H. Greer
7th Dis. John Melton, Wm. W. Wheatly and Etheldred Melton
8th Dis. William Waumack, Edward Brewer and William Holland
9th Dis. Lewis Hynes, William Stockdel and James Lindsey

Issued July 5th

The Court then proceeded to Make an appropriation to Amos Bruce former Trustee of Benton County and there being present and presiding on the bench a Majority of all the Justices in said County and all voting in the affirmative it is therefore ordered by the Court that Amos Bruce be allowed the sum of five dollars for a Jury Ticket which he satisfied while Trustee of said County and for which he had no credit ant that the Trustee pay the same out of any money in the Treasury for general county purposes not otherwise appropriated.

July Term 1843

On Motion of Mr. Sims who appeared in open Court and Nominated Thos. Jones as a Trustee for Benton County Academy in place of the Rev. R. S. Collins removed, it is therefore ordered by the Court that the said Thos. Jonese be Appointed one of the Trustees of said Academy.

State of Tennessee vs Peter Phifer, Bastardy

This day came the parties aforesaid by attorneys and on Motion of the defendant by atto. that the Warrant upon which the defendant was brought to Court was defective it is therefore considered by the Court that said Motion is sustained and the Warrant be dismissed and that the said defendant be hence released and that the plaintiff pay the cost of this suit.

On Motion of E. Perkins the Court considered of an appropriation to George Camp one of the former commissioners of the Town of Camden Made at a former term of this Court and it is ordered by the Court (all voting in the affirmative) that the said order be suspended and that the Clerk of this Court certify the same to the Trustee of Benton County.

Personally appeared in open Court A.C. Presson Sheriff and together with him Thos. Jones, James S. Sayles and James Presson his securities entered into and acknowledged their bond which were as follows (to wit)

Know all Men by these presence that we Allen C. Presson, Thom. Jones, James S. Sayles and James Presson, all of the County of Benton and State of Tennessee are held and firmly bound unto James C. Jones Govenor of the State for the time being and his successors in office in the penal sum of Twelve thousand five hundred dollars which payment well and truly to be Made we bind ourselves and legal Representatives jointly, severally and firmly by these presence given under our hands & seals this 3rd day of July 1843.

July Term 1843

The conditions of the above obligations is such that whereas the above bound Allen C. Presson is duly and constitutionally elected Sheriff of the County of Benton as Appears by and from the Certificate of the proper officer as directed by law which certificate bears date the 5th of March 1842.  Now if the said Allen C. Presson shall well and truly execute and due return Make all process and precepts to him directed and pay & satisfy all fees and sums of Money by him received by virtue of any process into the proper office as directed by law or by which the same ought by the tenor thereof to be paid or the person or persons to which the same shall be due his, her or their Executors, Administrators, Attorneys or Agents and in all other things well truly & faithfully execute the said office of Sheriff during his continuance in office then this bond to be null & void otherwise to Remain in full force and effect in law.

Jones Governor of said State for the time being and his successors in office in the penal sum of Five hundred dollars for the payment of which well and truly to be Made we bind ourselves, our heirs, Executors and Administrators jointly, severally & firmly by these presence sealed with our seals and dated this 3rd day of July 1843.

The condition of the above obligations is such that whereas the above bound A.C. Presson has been duly and conditionally elected Sheriff & Collector of the public taxes of said County of Benton for two years from the first Saturday in March 1842.  Now if the said A.C. Presson shall well and truly collect all state taxes and also all taxes on school lands within said County which by law he ought to collect and well and truly account for and pay over all taxes by him collected or which ought to be collected on the 1st day of Dec. 1843.  Then the above obligations to be void otherwise to remain in full force and effect.

July Term 1843

Know all Men by these presence that we A.C. Presson, Thos. Jones, James S. Sayles and James Presson all of the County of Benton and State of Tennessee are held and firmly bound unto Ephraim Perkins Chairman of the County Court of Benton County and his successors in office in the penal sum of fifteen hundred dollars for the payment of which well and truly to be made we bind ourselves, our heirs, Executors and Administrators, jointly & severally firmly by these presence sealed with our seals and dated this the 3rd day of July 1843.

The condition of the above obligation is such that whereas the above bound A.C. Presson has been duly and constitutionally Elected Sheriff & Collector of the public & county taxes for said Benton County.  Now if the said A.C. Presson shall well and truly collect and pay over into the hands of the Trustee of Benton County all the taxes which May be due and owing to the County of Benton for the year 1843 for the payment of County Contingencies for the payment of Jurors for the payment of paupers and all other taxes in such case accruing in said County then the above obligation to be void else to remain in full force and effect.

On Motion it is ordered by the Court that Isaac Davidson be appointed overseer of the Ross's ferry road in room of James S. Sayles to work from the ferry to Chalk Level and the following hands work under said Davidson on said road (viz.) James Wyly & hands, John Ford, John Hardin, John Waldross, L.D. Combs, Wm. Ballowe Sr., William Ballowe Jr., William Noring & hands John Smith Franklin Smith, James Smith, George Smith, and all other hands in the bounds work under said Davidson on said road which is Established in the 2nd Class.

Personally appeared in open Court Obediah Bullock Administrator of the Estate of John Nobles deceased and return an inventory and account of sale of the property of said Estate and oath having been Made hereto it is ordered by the Court to be entered of record.

July Term 1843

Personally appeared in open Court Zechariah Nash Administrator of the Estate of A. Nash deceased and returned an inventory and account of sale of the property of said Estate and oath having been Made hereto it is ordered by the Court to be recorded.

In pursuance of a former order of this Court Making it the duty of the Sheriff to bring the children of Hiram Cox deceased to Court for the purpose of having them bound.  The children were presented in open Court and it is was considered by the Court that they would bind Shadrick Cox a boy about thirteen years of age and said boy was bound to William Smith who entered and acknowledged his bond, also I.B. Cox his securities acknowledge the bond in the sum of two thousand & fifty dollars conditioned that the William Smith teach the said orphan the art and mystery of a farmer and to give him six months schooling in the summer and fall seasons sometime about the eighteenth or nineteenth year of his age and when he arrives at full age furnish him with a horse, saddle & bridle worth Seventy five dollars, one good suit of Jeans, Cloak & fur hat, one good pair of shoes & 2 pair of stockings and during his apprenticeship to furnish him a sufficiency of food, washing and clothing suitable to an apprentice.

The Court also proceeded to bind Harmon Cox a boy about the age of fifteen and said Harmon Cox was bound to Johnathan B. Cox, who appeared in open Court together with him, his security entered into and acknowledged their bond in the penal sum of two hundred & fifty dollars conditioned as follows (viz.) that the said Johnathan B. Cox learn the said orphan the art and Mystery of a farmer and to give him six months' schooling in the summer & fall seasons sometime about the eighteenth or nineteenth year of his age and when he arrives at full age, furnish him with a horse and saddle & bridle worth seventy five dollars, one good suit of Jeans, Cloak & fur hat, one good

One good pair of shoes & 2 pairs of stockings and during his apprenticeship to furnish him a sufficiency of food washing & clothing suitable to an apprentice.

The Court then proceeded to Make an appropriation to Irvin B Carnes for the Making and hanging a door to the Court house stairs there being nine of the Justices on the bench and the vote being taken those who voted in the affirmative are Esquires E. Perkins, Hudson, Steele, Williams, Rushing, Alsop, and Buchanan 7, And those who voted in the Negative are Esquires Burns and Greer 2.  It is therefore ordered by the Court that the sum of Eleven dollars & 25 cts. be allowed and that the Trustee pay the same out of any Money in the treasury for general county purposes not otherwise appropriated.

Court then adjourned until Court in Course.
