April Term 1847

 

State of Tennessee, Benton County, April Term 1847

At a County Court began and held for the County of Benton at the Courthouse in the Town of Camden on the first Monday in April, it being the 5th day of said Month in the year of our Lord one thousand eighteen hundred and forty seven and 71st year of American Independence, their being present and presiding on the bench the worshipfuls, Esqrs, (to wit) Elijah Alsop, J.R. Thomas, E. Perkins, Jesse D. Hall, John W. Davidson, H. Greer, Nathan Williams, S.H. Davidson, Sterling Brewer, J.D. Rushing, D.G. Hudson, Wm. M. McAuley, J.C. McDaniel, William Barnes, E. Jordan.

The Clerk of this Court presented a settlement Made with Malcomb Beaton, Administrator of the estate of Christopher Beaton deceased which said settlement was examined and approved by the Court and ordered to be recorded.

The Clerk of this Court presented a settlement Made with Obediah Bullock, Administrator of the estate of Milly Nobles deceased which said settlement was examined and approved by the Court and ordered to be recorded.

The Clerk of this Court presented a settlement Made with Mary Swift guardian of the Minor heirs of Harvey Swift Sr., deceased which said settlement was examined and approved by the Court and ordered to be reported.

On Motion it is ordered by the Court that W.H. Nivins be appointed overseer of the road to work from half mile above Abel Utley’s to where it intersects the Camden road at the 3 Mile Slough, hands as follows; Booker Nivins, Burrell Utley, Sr., Burrell Utley, Jr., Wm. Harden, Samuel Davidson, Jr., Jackson Utley, and other hands in the bounds shall work under said W.H. Nivins on said road which is established in the 2nd Class.

Issued April 6th.

On Motion it is ordered by the Court that Willis Sullens be appointed overseer of the road to work from Alfred Ballard’s to the four Mile post, hands as follows; Alfred Ballard, James Gandy, B.W. Whitley and all other hands in the bounds shall work under said Sullins on said road which is established in the 2nd Class.

April Term 1847.

On Motion it is ordered by the Court that Jesse D. Hall, Thomas W. Wynn, Hyman Taylor, Green R. Rolls, William Odom and William Wright be appointed Jury of Review to view and Mark a road to lead from Hampton’s Ferry on Sandy River and running so as to strike the Tennessee river about one mile above Wynn’s Ferry and to make report to the next term of this Court of the advantages and disadvantages arising to the public and to individuals.

Issued April 6th.

On Motion it is ordered by the Court that Turner Barfoot be appointed overseer of the road to work from the forks of the road near Eligah M. Bush’s to Willis Rushing’s, hands as follows; James Taylor, Wm. Herndon, H. Melton, E. Phifer, C. Pafford, T. Waters, William Waters, Wm. Jones, T. Bush and all other hands in the bounds shall work under said Barfoot, hands in the bounds shall work under said Barfoot on said road which is established in the 2nd Class.

On Motion of Basil Rodgers who Made oath according to law together with him John D. Rushing and John McGill, Jr., his securities who appeared in open Court and acknowledged the due execution of their bond in the penal sum of Three hundred dollars conditioned as the law directs.  Whereupon it is ordered by the Court that he have letters of Administration upon the estate of David Nisler deceased to be Made out in due form of law when required.

On Motion it is ordered by the Court that John D. Rushing, James C. Brown and James K. Nance be appointed commissioners to lay off and set apart a sufficiency of provisions to serve the widow & family of David Nisler deceased one year and to make report to the Next term of this Court.

On Motion it is ordered by the Court that William C. Holmes be appointed overseer of the stage road to work from Tennessee River to the 4 Mile tree, hands as follows; James H. Homes, Wm. A.T. Cate, John Arnold, Willie Arnold & hands, F.A. Cuff, James Cuff, Pinckney Cuff, John Penick, Eligah Penick and hands, Hyram Johnson, Wm. Durdin, Thomas Durdin, James Sykes and all other hands in the bounds shall work under said Holmes on said road which is established in the 1st Class.

April Term 1847

On Motion it is ordered by the Court that Arrison G. Combs be appointed overseer of the road to work from Beaver’s old place to Rushing Creek Meeting house, hands as follows; Reubin Beasley, Jonathan Latimer, Joshua Hill, John Westbrook and all other hands in the bounds shall work under said A.G. Combs on said road which is established in the 2nd Class.

Issued April 6th.

The Clerk then proceeded to Make an alteration to David Brewer, Sheriff of said County ex officio services for the year 1846.  And there being present and presiding on the bench a Majority of all the Justices in Benton County and all voting in the affirmative, it is ordered by the Court that the said David Brewer sheriff as aforesaid be allowed and paid the sum of Twenty five dollars by the Trustee of Benton County out of any money in the Treasury for general County purposes not otherwise appropriated.

Issued April 30th.

The Court then proceeded to Make an appropriation to E. Perkins for Money which he paid as Commissioner of the Town of Camden to W.L. Williams as attorney in the case of same vs. Commissioner and there being present and presiding on the bench a Majority of all the Justices of Benton County and all voting in the affirmative it is therefore ordered by the Court that the said E. Perkins be allowed and paid the sum of Twelve dollars & 62½ cents by the Trustee of said County out of any Money in the Treasury for general County purposes not otherwise appropriated.

The Court then proceed to Make appropriation to the Revenue Commissioners for taking a list of taxable property and polls in said County for the year 1847, who are as follows; J.C. McDaniel, Nathan Williams, S.H. Davidson, John W. Davidson, D.P. Hudson, John D. Rushing, Geo. W. Farmer, Sterling Brewer and Jesse D. Hall and there being present and presiding on the bench a Majority of all the Justices in Benton County and all voting in the affirmative it is therefore ordered by the Court that the sum of three dollars be allowed and paid said Revenue Commissioners kept by the Trustee of Benton County out of any money in the Treasury for general County purposes not otherwise appropriated.

April Term 1847.

On Motion it is ordered by the Court that William Cottingham be appointed overseer of the road to work from the stage road to Cottingham’s Mill, hands as follows; Freeman Presson, James Cottingham and the hands that live at Levin Cottingham’s and Eli Craig shall work under said Cottingham on said road which is established in the 3rd Class.

Issued April 7th.

On Motion it is ordered by the Court that J.W. Matlock be appointed overseer of the road to work from the widow Matlock to William Malin’s, hands as follows; James Walker, B.B. Barnett, John Hubbs and all hands that formerly worked under John Crabb on said road or in the bounds shall work under said Matlock on said road which is established in the 2nd Class.

Issued April 7th.

On Motion and it appearing to the satisfaction of the Court that Lewis Cross was listed for taxes in two districts for the year 1846 and it also appearing that E.W. Penick and Alexander Wiseman was also listed for poll tax and that the said Wiseman and Penick are under age.  It is therefore ordered by the Court a Majority of all the Justices in said Court being on the bench and all voting in the affirmative that said Cross be released from paying poll tax in the 6th District and that the said Penick and Wiseman be released from paying the County taxes thus charged against them and that the Sheriff have a credit in his settlement with the Trustee for the same.

On Motion and it appearing to the satisfaction of the Court that there is a fund in the hands of the Trustee of this County Collected for the payment of paupers and it also appearing that the fund is not needed for that purpose.  It is therefore ordered by the Court that the Trustee appropriate said fund to the payment of Jurors.

Personally appeared in open Court Roland Rushing who was at the January Term of this Court 1847 duly and lawfully elected tax Collector for Benton County for the present year and together with him John D. Rushing, Levin Cottingham, John W. Utley and Seth Utley his securities who appeared in open Court and acknowledged the due.

April Term 1847.

execution of their bonds in the penal sum Twenty five hundred dollars for the faithful paying over of the County tax Five hundred dollars for the collecting and paying over of the State Tax conditioned as the law directs.

On Motion it is ordered by the Court that David Norman be appointed overseer of the road in room of Ichabod Farmer to work from Pridgen Melton’s to Davidson’s Ferry on the Tennessee river and all the hands that formerly worked under Ichabod Farmer or in the bounds shall now work under David Norman on said road which is established in the 2nd Class.

Issued April 7th.

Personally appeared in open Court C.A. Crawley, Administrator of the estate of Joseph Taylor deceased and returned an inventory of the property and effects of said estate and oath being Made to the same it is ordered by the Court to be recorded.

The Court then went into the election of Trustees for Benton County Academy and after counting the votes it appears that S.C. Pavatt, E. Perkins, T.A. Douglas, C.K. Wyly and I.B. Carnes received the highest number of votes.  Whereupon the said S.C. Pavatt, E. Perkins, T.A. Douglass, C.K. Wyly and I.B. Carnes appeared in open Court and entered into bond in the penal sum of Fifteen hundred dollars conditioned as the law directs.

Personally appeared in open Court R.W. Rowe executor of the last will and testament of William Walker, Sr., deceased and together with him Joseph Walker, Calborn Hichs, William Walker and C.H. Thompson his securities who appeared in open Court and acknowledged the due execution of their bond in the penal sum of Seven hundred dollars conditioned as the law directs.

Court then adjourned until Court in Course.
