SAMUEL SPRUILL
May 25, 1765
proved in Tyrrell County March term 1766
In the name of God amen the twenty fifth day of May in the year of
our Lord one thousand seven hundred and sixty five I SAMUEL SPRUILL
of Bartea and Tyrrel County in North Carolina being well in body and in
perfect mind and memory thanks be given unto God for the same and willing
to mind the mortality of my body and knowing that it is appointed for all
men once to die do make and
ordain this my last will and testament that is to say principally and first
of all I given and recommend my soul into the hands of God and my body
I recommend to the earth to be buried in decent
Christian burial at the discretion of my executors nothing doubting but
at the genrial resurrection I shall receive the same again by the mighty
power of the almighty God and as touching such worldly estate whence ?????????
in this life I give and dispose of the same
ITEM. I give and bequeath unto my beloved wife ELIZABETH SPRUILL
one Negro wench called Cloe and all the cattle in Bartea that belong to
me together with twenty seven head of hogs big and little as they come
and the house furniture that she had when I was married to her and I lend
to her Jea? Able Mol Dick and Jesan Dewving her life or widowhood
ITEM I give unto my beloved son SAMUEL SPRUILL the plantation
that was formerly CUDBERT PHELPES upon the creek together with one
hundred and fifty acres of old Catim? land beginning at the head of the
Deep Branch where the SAMUEL ALEXANDER line begun running to the
road upward to the first Branch then along the road to WILLIAM JENNETT
line and along that line to the corner tree. also I give to my son SAMUEL
SPRUILL eighty two acres of land all the Cypress Branch also I give
to my son SAMUEL SPRUILL one ????????????????? part next to the
??????? Callorn? land to him and his heirs and assigns for ever
ITEM. I give unto my son ?ON SPRUILL the plantation up Great
Alligator and the land there unto belonging also one hundred and twenty
five acres of land at the lake joining his brother SAMUEL
SPRUILL land also the stock up Great Alligator to him and his heirs
and assigns for ever.
ITEM. I give unto my son JOSE SPRUILL the plantation whereon
SAMUEL ALEXANDER lived together with the land thereunto belonging
beginning at the head of the Deep Branch and along the branch down to the
Creek Swamp westerly and southwardly the various windings of the Swamp
?? Branch next to the clearing and then along the rode to the rode that
goes to JOSHUA PHELPSIS and along that rode to ??? containing one hundred
acres of land old Patten and fifty of New Patten land also two hundred
and twenty acres of land up Alligator Lake on the north side to him and
his heirs and assigns for ever.
ITEM. I give unto my son LEVON SPRUILL the place known by
the name of the Clearing with two hundred and fifty acres of land and fifty
acres of old Patten land and two hundred acres of ???? a hundred and twenty
acres of land joining his brother JOHN SPRUILL at the lake to him
and his heirs and assigns for ever.
ITEM. I give unto my beloved son SEMEON SPRUILL the Manner
Plantation whereon I did live together with two hundred acres of old Patten
land and one hundred acres of New Patten land to him and his heirs and
assigns for ever also I give to my son SAMUEL SPRUILL one half of
the still that he bought for his father and the other half I give unto
SEMEON SPRUILL to them and their heirs and assigns forever.
ITEM. I give unto JAMES the son of MARY DILLING also
one hundred acres of land know by the name of the Dogwood thicket at the
south land.
And I leave my Negroes to be divided among my children when SEMEON SPRUILL
comes to the age of twenty one years as equally as possible they can and
when they come to the age of twenty one years my executors or any three
free holders to let them have some part of ??? of the Negroes for to help
??? in the division aforesaid and one equal part ??? between SAMUEL
SPRUILL JOSEPH SPRUILL STEVEN SPRUILL and SEMEON SPRUILL at
the Manner Plantation and all other ??? that is mine Great? Alligator stock
excepted and that to JOHN SPRUILL as afore mentioned and as for
my household goods to be equally divided between SAMUEL SPRUILL JOHN
SPRUILL STEVEN SPRUILL and SEMEON SPRUILL when they come to
the age of twenty one years after the division then I give my Negroes according
as they are divided to them and the issue of their bodys lawfully begotten
forever and I do constitute make
and ordain my brother JOSEPH SPRUILL and my two sons SAMUEL SPRUILL
and JOHN SPRUILL executors of this my last will and testament and
I do hereby disanul revoke and disallow all other testaments wills legacys
bequeaths and executors by me in any ??? Named willed and bequeathed and
ratifying and confirming this and the other no be my last will and testament
in witness whereof I the said SAMUEL SPRUILL SENIOR have hereunto
signed sealed published pronounced and declared by the said SAMUEL SPRUILL
SENIOR as his last will and testament in the presence of the subscribers
