Cornelius KEARLEY(1866)
This is the last Will and Testament of me Cornelius Kearley of Newport in the Isle of Wight, Pork Butcher. I direct my debts funeral and testamentary expences to be paid as soon as conveniently can be after my decease. I give devise and beqeath all my real and personal estate and effects whatsoever and wheresoever unto Joseph Bevis of Newport aforesaid Builder and Gerard Rochfort of the parish of Carisbrooke in the said Isle Solicitors Clerk their heirs executors administrators and assigns upon trust to permit my dear Wife (during her widowhood) and my daughter Caroline and the survivor of them to hold and enjoy the same and receive and take the rents and profits thereof for their own use and benefit they keeping the same in tenantable repair and insured from loss or damage by fire. And from and after the death or marriage of my said Wife and the decease of my said Daughter then I direct my said trustees to sell and absolutely dispose of my real estate together or in parcels and either by public auction or private contract and to convert and get in my personal estate and stand possessed of the moneys to arise from such sale conversion and getting in of my real and personal estate. Upon the trusts following (that is to say) as to one fifth part thereof on trust for and I give the same to my son Cornelius as to one other fifth part thereof on trust for and I give the same to my son Edmund as to one other fifth part thereof on trust for and I give the same to my daughter Sarah the wife of William Harbourn as to one other fifth part thereof on trust for and I give the same to my daughter Emily the wife of Alfred Tyler and as to the remaining one fifth part thereof on trust for and I give the same unto and equally between the children of my late daughter Anne Cooke who shall be living at the time of the decease or marriage of my said Wife and the death of my said Daughter and to the issue of such of them as shall be then dead such issue nevertheless taking only the part or share which his her or their deceased parent would have been entitled to if living and I declare that every receipt in writing of them my said Trustees and the survivors and survivor of them his heirs executors or administrators for all purchase and other moneys which to them or him shall or may be paid in execution of the trusts of this my Will shall be a good and sufficient discharge to the person or persons paying the same who shall not be liable or accountable for the misapplication or nonapplication thereof or of any part thereof or be bound to see to the application thereof I devise all real estate vested in me as trustee or mortgagee to the said Joseph Bevis and Gerard Rochfort their heirs and assigns subject to the trusts and equities affecting the same respectively I declare that if my trustees hereinbefore named or either of them or any trustee or trustees to be appointed under this clause shall die or be unwilling or incompetent to accept or execute the trusts of my Will it shall be lawful for the competent accepting trustees or trustee for the time being if any whether retiring from the Office of trustee or not or if none for the executors or administrators of the last deceased Trustee to substitute by any writing under their or his hands or hand any person or persons in whom alone (or as the case may be) jointly with any surviving or continuing trustees or trustee my trust estate shall be vested.
I appoint the said Joseph Bevis and Gerard Rochfort Executors of this my Will and revoke all other Wills by me made and declare this to be my last Will and testament. In witness whereof I have hereunto subscribed my name the eleventh day of May One thousand eight hundred and sixty five.

Signed acknowledged and declared by the said Cornelius Kearley as and for his last Will and Testament in the joint presence of us who at the same time in his presence have subscribed our names as witnesses.

Proved at Winchester the twelfth day of December 1866 by the Oaths of Joseph Bevis and Gerard Rochfort the Executors to whom administration was granted.
The Testator Cornelius Kearley was late of Newport in the Isle of Wight in the County of Southampton Pork Butcher and died on the twenty second day of September 1866 at Newport aforesaid.
