WILL OF JOHN ROGERS SR

State of South Carolina

Horry District

Dated 30 Aug 1826

In the name of God Amen, I, John Rogers of the State and District aforesaid planter being sick in body but of sound and perfect mind and memory thanks be unto the Almighty for the same and calling to mind the mortality of this life and knowing that it is appointed for all men once to die do hereby make and ordain this my Last Will and Testament viz: I recommend my Soul unto the almighty who gave it and my body to the earth to be buried in a decent Christian like manner and as touching such worldly estate as the Lord has blessed me with I give & dispose of it in the following manner. Item - I give and bequeath unto my beloved wife DELELA ROGERS three Negroes namely Mary, young Moley and Matilda with all their future increase for and during the term of her natural life. At her decease the said Negroes to be equally divided among such of my children as may be then living. It is further my will and desire that all my stock of horses, cattle, hogs and sheep, all my household & kitchen furniture and plantation tools remain in the possession of my beloved wife during her widowhood or until my three children now unmarried become of lawful age or marry when I wish them to draw an equal share together with my said wife. It is also my will and desire that all the money which may be in my possession at my decease (except such parts as is hereafter ordered to be laid out in the purchase of Negroes) and all the debts due to me together with the crop on hand, be appropriated to my beloved wife DELILA (sic) toward the support and education of my three unmarried children. Item - I give & bequeath unto my beloved son JOHN ROGERS ten Negroes, namely Abel, Lucy, Caesar, Mary Ann, Hester, Sam, Hannah, Mariah, Jenny & Eli with all their future increase to him and his heirs forever. Also, all that plantation or tract of land known by the name of Bear Swamp extending from Conwayborough to James Woodward's plantation or tract of land to him and his heirs forever. I also wish it to be understood that my said son JOHN is to receive an equal part of the debts due to me (with the exception of Thomas Evans bond), he having received his share of said bond. Item - I give and bequeath unto my beloved son WILLIAM ROGERS ten Negroes namely Nancy, Sandy, Berium, Big Prince, Abram, Rhoda, Tom, Milly, Bess & Ledia with all their future increase to him & his heirs forever. Also all that tract of land on Hunting Swamp generally known by the name of the Mill Place to him and his heirs forever. Item - I give and bequeath unto my beloved daughter MARY ROGERS ten Negroes viz: Robin, Selvia, Sally, Diana, Chany, Scylla, Rose, Harriote and Lizete together with one other Negro to be purchased for her by my executors hereafter named the said Negroes and their increase to her and her heirs forever. Also, all that plantation or tract of land on the sea shore generally known by the name of the Upper Plantation adjoining lands belonging to William Gore & William D. Briant to have and to hold to her & her heirs forever. Item - I give and bequeath unto my beloved son JAMES ROGERS ten Negroes viz: Ben, Abegal, Rhina, Roger, Little Ben, Joshua & Little Prince & March; also two other Negroes to purchased for him by my executors hereafter named at or before the time of his arrival at lawful age. The said Negroes with their future increase to him and his heirs forever. Also all that plantation or tract of land lying on Hunting Swamp generally known by the name of Wm Snows land; also all that plantation or tract of land generally known by the name of the Lower Plantation adjoining lands belonging to James Bessent & Robt. West - his mother to have the use of the land until he becomes of lawful age or marries or during her widowhood. After his arrival to full age the property to be given to him and his heirs forever. Item - It is my express will and desire that all the lands not mentioned in this my last will shall be equally divided between my four children - JOHN, WILLIAM, MARY & JAMES to them and their heirs forever. Item - it is my will and desire that if any of my said four children should die before marriage without leaving lawful issue then and in that case the share of property which I have given to them or either of them with all the future increase is to be equally divided among the surviving part of them and their heirs forever. Item - It is also my express will and desire that each of my said children before named shall receive all the property I have given to them as soon as they arrive at lawful age or marry and not before. Lastly I do hereby nominate constitute and appoint my friends HENRY DURANT and SILVIOUS SWEET executors to this my Last Will and Testament in witness whereof I have hereunto set my hand and seal this thirtieth day of August one thousand eight hundred and twenty six.
