YAUHANNAH WILLS

 

 

Will of

 

John Green

 

In the name of God amen, I John Green of  Prince George Parish in Craven County in the Province of South Carolina Planter being in sound and disposing mind and memory thanks be to Almighty God but considering the uncertainty of  this life do declare these presents to be and contain my last Will and Testament and being heartily sorry for all my sins past I commit my soul unto Almighty God my Creator trusting through his infinite mercy and by the merits of my most blessed Saviour Jesus Christ to have full and free remission of all my sins and my body I commit to the earth.

I order will and appoint that all such debts and sums of money which I shall owe at that time of my decease be first paid and discharged and for the settling the temporal estate which it hath pleased God to bless me with.

I give and devise in manner and form following.

Imprimus. My will is and I do hereby give and bequeath all my personal estate of what nature soever as negroes or Indians slaves stocks of cattle hogs and sheep their and every of their increase between my loving wife Elizabeth and my sons and daughter that is to say John and Richard and daughter Elizabeth to be equally divided share and share alike the division to be made after my decease and if it should so happen that my wife or any of my children should depart this life before they arrive to their respective ages that is to say my sons to their age of twenty one and my daughter to her age of eighteen & before they receive their share or dividend as by this my will is here before given them then my will is and I do hereby order & appoint that such share or shares of the deceased be equally divided among the survivors that is to say my wife Elizabeth and my sons John & Richard and my daughter to be equ____ & share alike and my will further is that my sons receive their dividend or shares when they shall attain their ages of twenty one and my daughter to her age of eighteen and further my will is and I do hereby order will and appoint that my Exors. herein after nominated & appointed have the guardianship and tution (sic) of my said children till they arrive to their respective ages that is say my sons to twenty one years and my daughter to eighteen years and I do hereby further order and appoint and my will is that my wife shall make choice out of my furniture before any division be made of a bed bedstead bolster & pillows of feathers with all other furniture thereunto belonging to the same bed and my will further is & I do hereby order & appoint that my wife have liberty to take out of my stock of horses and cattle what is her proper right before any division be made and my will further is and I do order and appoint my wife shall have suitable apparel and maintenance found her out of the profits arising out of my estate during her widowhood and no longer.

Item. I give and bequeath  unto my son William Green ten pounds current money.

Item. I give and bequeath unto my daughter Sarah wife of Daniel Maginney ten pounds current money.

Item. I give and bequeath unto my daughter Hannah wife of William Smith ten pounds current money to be paid them out of the profits that shall or may arise out of my Plantation or stock of cattle above mentioned.

Item.  I give and bequeath unto my son Richard a tract of land containing five hundred acres situate in Craven County butting and bounding on the southwest Black River to the northwest on the land of Wm. Sacby(sic) Esq. to the ____th east on the land of Mr. John Lewis to have and to hold the said P_____tation or tract of land containing five hundred acres more or less with all the buildings and improvements thereon and all o____r appurs. thereunto belonging or any ways appurtaining h____ heirs & assigns forever.

Item. I give and bequeath to my daughter Elizabeth all that tract of land containing three hundred acres situate in Craven County on Waccamaw neck butting and bounding on the ___h east and south on land not laid ____ on Waccamaw Creek to have and to hold the said tract of three hundred acres to her and her heirs eshued & born of her body and if it should so happen that she depart this life and not having any hear then my will is and I do hereby order and appoint the said tract or parcel of land be given to my sons John & Richard to them & their heirs forever and my will is and I do hereby order and appoint that one certain piece and parcel of land containing five hundred acres situate in Craven County butting and bounding to the northeast on Black River southeast on lands not laid out on the northeast on land of my own and southwest on part of land of Saml. Scriven’s and my will is and I do hereby order and appoint that this tract or parcel of land be sold and the money the said be sold for be equally divided with the survivors that is to say my wife Elizabeth and my sons John & Richard & my daughter Eliz. share & share alike the division to be made after my decease and if in case my daughter Elizabeth should depart this life before she arrives to the age of eighteen years then my will is and I do hereby order & appoint that the said share of the decd. be sould (sic) and the moneys that they shall be sold for shall be equally divided amongst the survivors of her that is to say my wife Eliz. if living and my sons John & Richard to be equally divided amongst them three share & share alike.

Item. I give devise and bequeath to my beloved wife Elizabeth a tract of land containing two hundred and fortynine acres situate in Craven County which said plantation I now dwell on to have and to hold the said tract of two hundred and fortynine acres of land during her widowhood & no longer, then my will is & I do hereby order and appoint that the said tract of land be given to my daughter Elizabeth to her and her heirs eshuid (sic) and born of her body and if it should so happen that she depart this life & leave no heirs then my will is and I do hereby order and appoint that the said tract or parcel of land be given and divided unto my sons John and Richard to them and their heirs forever, and I do hereby nominate constitute and appoint my wife during her widowhood and no longer with my sons John & Richard Exors. of this my Will in Witness whereof to this my Last Will & Testament & seal this eight day of January Anno Domini one thousand seven hundred and fortynine and in the twenty second year of his majesty’s Reign.

This will was Proved by Virtue of a Dedimus before Paul Trapier Esq. ye 1st of Mch 1750 and at the same time The Exix. & Exors. there named qualified.
