John Allston

 

 

In the name of God Amen I John Allston of the Parish of Prince George Planter being very sick and weak of body but of sound mind and memory thanks be to God do make this my last will and testament in manner following that is to say first I will that all my just debts and funeral expenses be discharged.

Item.   I give to my brother in law Esther Marion (sic) the use of my house and lot in George Town for and During the term of her natural life and after her death I give the use of the said house & lot to my beloved Esther Allston for and during the time she remains my widow and after the marriage or death of my said wife I give devise and bequeath the said house and lot to my exors. hereafter mentioned to and for the use following that is to say be sold by them and the money arising thereby to be equally divided among my children share and share alike.

Item.   My will is that if the child my wife is now pregnant with should be a boy then I give devise and bequeath to him my son and to his heirs forever my plantation and all other my lands except as before given but should the said child be a girl then my will is that she shall have an equal share with any of my other children.

Item.   I give devise and bequeath to my wife and my children Martha, Elizabeth, Hester, Elinor and the child my wife is now pregnant with all the personal estate I die possessed of amongst them equally to be divided share and share alike as they severally do arrive to the age of twenty one years or to the day of marriage and in case any of my said children should die before they arrive at the said age or marry then I will the said child’s part be equally divided among the survivors of my children. Also my will is that in case the child my wife is pregnant with should not be a boy I give devise and bequeath all my real estate to my exors Thomas Mitchell, ______Allston and Benjamin Marion for the uses following that is to say to be sold by them when the youngest of my daughters marries or arrives at the age of twenty one years and the money arising thereby to be equally divided between my said children share and share alike also my will is that my wife Esther shall live and reside on my plantation for and during the term she continues my widow. Also I will that my exors. have full power when they shall think fit to purchase slaves or other wise apply the profits arising from my said plantation for the use and benefit of my children.

Lastly I do appoint my friends and brother Thomas Mitchell, Josiah Allston and Benjamin Marion to be the exors. to this my last will and Test.

In testimony whereof I have the 28th day of August Anno Domini 1750 set my hand and fixed my seal.

This will was proved before P. Trapier exor. & all exors. qualified.

 

The desire of John Allston now in a dangerous low condition Nov. 12th 1750. Item. If  Josias Allston will pay the sum of 190 pounds for a Lad called Tom and 160 lbs. for another called Brutus payable in March next insueing then they are to his property (Sic). Item also my clock now in my house _____________Esther Allston. Item. I give to my loving brother Benj__________the name of Jewell
