WILL OF FRANCIS BRITTON

IN THE NAME OF GOD, AMEN, I Francis Britton of Craven County in ye Province of South Carolina, being sick and weak in body but of perfect mind and memory and calling to mind the mortality of mankind do make and constitute this my Last Will and Testament commiting and resigning first of all my Soul into the hands of God who gave it hoping through the alone Merits and mediation of a Glorious Redeemer he will graciously be pleased to Receive the same and my Body I Commit to the Earth to be decently Buried at the discretion of my Executors Nothing doubting but it will be raised again by the same Almighty power wherewith it was Created and reunited to the same Spirit in a Glorious Resurrection and for what worldly Estate it hath pleased God to blefs me with I now dispose of in manner and form following, VIZ: I give and bequeath to my beloved Son Moses Britton during his life the use of these Ten Negroes VIZ: Ben, Rouse, Betty, Cubit, Boson, Old Jenny, Venus, Young Jack, Clemontina Old Cate and Babinah and after his decease to be the Sole property of his Children to be equally divided amongst them, to them and their heirs forever, and also one Tract of Land called Tower -Hill and in case my son Moses should die leaving no lawful heirs from his body the above Ten Negroes to return and be divided between all my Surviving Children. Item: I give and bequeath to my beloved Son Francis Britton during his life the use of these seven Negroes VIZ: Little Isaac, Cloyey, Hannah, Bob, Young Jenny, Save and Gothron and after his decease to be the Sole property of his Children to be equally divided amongst them, to them and their heirs forever also One Tract of Land called Sawhee Tract and in case my Son Francis should die leaving no Lawful heirs from his Body the above Seven Negroes to return and be divided between all my Surviving Children. Item: I give and bequeath to my beloved Son Henry Britton during his life the Use of these nine Negroes VIZ: Bargan, Champion, Old Cate, Sarah, Hager, Old Jack, Little Pedron, Carolina and Sue and after his decease to be the Sole property of his Children, to be equally divided amongst them to them and their Heirs forever, also One Tract of Land on Britton's Neck and in case my Son Henry should die leaving no lawful heirs from his Body the above Nine Negroes to return and be divided amongst all my surviving children.
Item: I give and bequeath to my beloved daughter Mary Britton during her life the Use of these Seven Negroes VIZ: Susan, Hope, Clarinder, Candice, Duck, Little Cate, and Little Jupiter, Little Cato and in case my daughter Mary should die leaving no Lawful heirs from her body the above Seven negroes to return and be divided amongst all my surviving children. I give and bequeath to my Son Francis these Six Negroes by name Old Jupiter, Jenny, Old Isaac, Grace, Venter, and Silvia. I give to my Son Henry these Four Negroes Tom, Old Pedrow, Dinah and Sampson. I give Daniel Laine Britton, Son of Moses Britton One Negroe Girl named Phillida. I give to Martha Britton, One Negroe Girl Silvia. I give to Philip Britton, Son of Joseph Britton, three head cattle. I give to Thomas Britton, three head cattle. After all my just debts is paid it is my desire that the remainder of estate to be sold and equally divided amongst all my children. I leave and Constitute my Brother Joseph Britton as Trustee to this my Last Will and that nothing be done by my Executors without the consent of my Trustee, it is my desire that my Sons Moses, Francis, and Henry Britton do act as my Executors to this my Last Will and Testament. Revoking and disannulling all other former Wills, AS WITNESS my Hand and Seal this fourteenth day of May 1766. Signed: Francis Britton (L.S.)

Proved by Virtue of a Dedimus directed by His Excellency the Rt Ho Ld Charles Greville Montagu to Samuel Nesmith, Esq. 24th March 1768
14th May 1768 Qualified Francis Britton Executor to the said Will.
