Lancaster County, Pennsylvania Will Book B, Volume 1, page 716

Jacob McDill Deceased BE IT REMBERED that I Jacob McDILL of Sadsbury Township Lancaster County in the Province of Pennsylvania yeoman, being weak and inform in body, but of disposing mind and retention I do make and ordain this my last Will and Testament in form following I will and allow that all my just debts and funeral charges be fully paid and satisfied. I will and allow to the use of St. John's Church whereof I am a member the sum of five pounds Currency to be paid out of the first Bond due my Estate after my Decease, from my son James when such bond is fully paid. I will and allow that all and singular of my Estate of any kind be equally divided into five shares in such advantageous manner as my Executors shall deem meet and equal, and being so divided (except as above allowed) allow to my son James McDILL aforesaid one fifth part and to my sons in law Robert BAILEY Benjamin BLYTH and Stewart HERBERT to each of them a fifth part in right of their Wives Margaret Obigail (sic) and Sidney severally abd (sic) Respectively and the remaining fifth part to my deceased Son George's two children named Jacob and Elizabeth that is to the said Jacob two thirds of said fifth and to the said Elizabeth the other third of said Fifth. To be given to my said Son James and to my said sons in law their heirs and afsigns severally and respectively on sight and yo (sic) the said Jacob and Elizabeth when they arrive at age severally and Respectively. But in case any of them decease before they arrive at age as aforesaid, then and in such case I allow the surviving one the whole fifth. But in case they both decease before they so arrive at age. Then I allow their fifth part to be equally divided to and amongst my said Children their heirs Executors Administrators or afsigns (sic) severally and respectively. Provided always on the whole, That if any of my children or Grand Children shall either by themselves or others by from or under them or any or either of them Seek by law, to overturn this will, to get any more than what is and how is herein allowed, or otherwise to Cavil against my Estate or the Land by me sold Under what Colour or on what ground or pretext soever. That then and in such case I will and allow the sum of Five Shillings and no more to such child or children, Grand child or grand children so acting in the premises as aforesaid . And the remainer of his or her or their share so transgerssing (sic) I will and allow to be divided equally to anf (sic) amongst such of my other children or grand children aforesaid as shall or may be fully satisfied in the premises, so as to comply with this will and my late disposition of the land to my son James respectively, to all intents and purposes any thing herein contained to the contrary in any wise notwithstanding. And lastly I nominate ordain constitute and appoint my Sons in Law Robert BAILEY and Stewart HERBERT and my Trusty Friend John JOHNSTON to be my Executors of this my last will and Testament hereby revoking and disanulling (sic) all former or other wills Testaments by me heretofore had or made and Confirming this and this alone to be my last Will and Testament. Lancaster County SS On the Sixth day of Noember (sic) Anno Domini 1771 Personally appeared the above named James HENRY and David BROWN two of the Subscribing witnefses (sic) to the above and within will and on their Solumn (sic) affirmation according to law did declare and say that they were present and saw and Heard Jacob McDILL the Testator within named Sign Seal publish pronouce and declare the above within Writing as and for his last Will and Testament and that at the doing thereof he was of sound Mind Menoryn (sic) and Understanding to the best of their Knowledge Observation and Belef (sic)

BE IT REMBERED that on the sixth day of November Anno Domini 1771 the last will and Testament of Jacob McDILL late of Sadsbury Township in the County of Lancaster Yeoman deceased was proved in due form of Law and Letters Testamntary (sic) were granted to Robert BAILEY, Stewart HERBERT and JOHNSTON they Executors herein named they being first duly qualified well and truly to administer the Estate of the Testator and to Exhibit a true and perfect Inventory thereof into the Registers Office at Lancaster on or before the sixth day of December next and to render a true and just account of their administration when _____ lawfully required. Given under the Seal of the said Office
