That the said Intestate left issue nine children & one grand child seven of whom are yet in their minority; that the personal estate of the said intestate is insufficient for the payment of his debts as by the statement produced with the Petition appears; And that the said intestate died seized in his demesne as of fee, of & (?) in a certain lot of ground situate in Martick township adjoining lands of David Herr & Henry Eberly & other adjoining lands of Henry Whitestick, Michael Shenck & others. Containing seven acres & 20 perches; Also a certain other lot situate in Drumore township adjoining lands of James Collins, Jacob Barr's & others containing Sixteen acres & 110 perches; And praying the Court to grant the Administrators an order to make sale of the said several lots, with the appurtenances, for the payment of the debts & the maintenance & education of the minor Children of the said Intestate; to the truth of the facts above stated said Adm. was duly affirmed in Open Court. It is ordered by the Court that the Adm. of the said dec'd, do expose to public sale the Real Estate of said dec'd as aforesaid, on Monday the 4th day of June 1827 at 10 o'clock a.m. at the Tavern house of Jacob Newswenger in Martick township. MARTIN BARR dec'd, On the Petition of Hannah Barr Widow & relict of Isaac Barr late of Bart township in said County dec'd, "Setting forth", that the Petitioner's husband (who was the son of Martin Barr late of said township dec'd), left issue one child, to wit, Mary Isabel Barr a minor under 14 years, and prays the Court to appoint David Barr as her Guardian. Petition read & Guardian appointed as prayed for. On the Petition of Anne Barr Widow of Martin Barr late of Bart township, Martin Barr, oldest son of said dec'd, John, Christian & Simon Barr minor sons & Anne Barr a minor daughter by their Guardian David Barr, Mary Isabel Barr a minor grand daughter said dec'd & daughter of Isaac Barr a son of said dec'd by her guardian David Barr, Benjamin Barr another minor son & Fanny Barr a minor daughter by their guardian Daniel Bleelcher (?), Mary Barr oldest daughter who is intermarried with Daniel Bleetcher & Susan Barr the second daughter of said dec'd, "Setting forth", That the said Martin Barr died intestate on or about the 11th day of December 1826 leaving a Widow & issue as aforesaid, & that the said intestate died seized in his demesne as of fee, of & in a certain tract of land situate in said township & County aforesaid, containing about Forty acres & three quarters of an acre, adjoining lands of Jacob Barr, John Lefever & others, the improvements whereon consist of a stone house & barn, wash house etc. And pray the Court to appoint & order Henry Brenneman Sen., and Henry Brenneman Jun., Christian Herr, Henry Groff, Simon Groff, Jacob Denlinger & John Keyports seven men who have been indifferently chosen on behalf & with the consent of the Petitioners to make paitition (?) of the premises aforesaid to & among the Widow & children & representatives of the said Intestate etc. It is ordered, by the Court, that the said seven Men do forthwith view the said premises, & make partition there of between the Widow & children & representatives of said dec'd, if the same can be done without prejudice to & spoiling of the whole. But, if they find that the same cannot be so divided, that they the inquire & report whether the said premises will conveniently accommodate more than one of the said children or representatives without prejudice to & spoiling of the whole. And, if the so find that they ascertain & report, how many the same will as aforesaid accommodate, describing each _______ by metes & bounds, & returning a just valuation & appraisment thereof. But, in case partition cannot be made between all the Children & representatives aforesaid nor the said premises accommodate more than one of the Children or representatives that they then value & appraise the whole premises agreeably to Law; that legal notice of the time & place of holding such Inquisition, be given to all the parties interested, and their legal representatives, that they may be present, of they think proper & that ______ of the said proceedings be made to this Court on the 3d. Monday in January next.

MARTIN BARR dec'd Pursuant to an Order of this Court of the 24th day of December A.D. 1827 Directing Henry Brenneman Sen., Henry Brenneman Jun., Christian Herr, Henry Groff, Simon Groff, Jacob Denlinger & John Keyports seven Men indifferently chosen on behalf & with consent of the representatives of Martin Barr Late of Bart township dec'd; to view etc. the real estate of said dec'd; one of said Men, to wit, Simon Groff not attending Jacob Neff was by the mutual agreement & consent of all the heirs & legal representatives of said dec'd, substituted in his stead. "Said Men now report", that having been sworn and affirmed according to Law, they did on the 29th day of December 1827 view the premises in the said order mentioned, that is to say a plantation or tract of land situate in Bart township & County aforesaid containing about Forty acres & 3/4 of an acre, adjoining lands of Jacob Barr, John Lefever & others, the improvements whereon consist of a stone dwelling house & barn, wash house etc. And did find that the same premises cannot be divided & partitioned between all the children & legal representatives of the said Martin Barr dec'd without prejudice to & spoiling of the whole, & finding that the same cannot be so divided, they have inquired whether the same premises will conveniently accommodate more that one of the children & legal representatives of the said dec'd without prejudice to & spoiling of the whole, & do find that the same premises cannot be partitioned & divided & will not conveniently accommodate more than one of the children & legal representatives without prejudice to & spoiling of the whole, they do therefore value & appraise the said 40 acres & 3/4 of an acre, the real estate of the said dec'd at & for the sum of Sixty two dollars per acre amounting to Five thousand five hundred twenty six dollars 50 cents lawful money of the United States. Which Inquisition being read, was confirmed by the Court. Same day Martin Barr oldest son of the said dec'd, appears in Open Court & accepts the real estate of said dec'd, as aforesaid, at the valuation & appraisement thereof as aforesaid. Whereupon the Court confirm the same to him, his heirs & assigns in fee, upon his paying or securing to be paid to the Widow & legal representatives of the said dec'd their several & respective shares of & in the valuation money, after deducting therefrom so much as may be necessary for the payment of the just debts of the dec'd; of the said Real estate, so accepted by him, on or before the 21st day of January A.D. 1829 with interest for the same the 21st day of January 1828.

Also a certain other lot situate in said township adjoining lands of Henry Whitestick, Michael Shenk & others containing 7 acres & 2 perches. Also a certain other lot situate in Drumore township adjoining land of James Collins, Jacob Barr & other containing 16 acres & 110 perches. "Said Admrs. now report, "That in pursuance of the said Order of Court, having given due & legal notice of the time & place of sale, they did expose the premises therein mentioned to public sale & sold No. 1 containing 15 ac. & 85 prs. strict measure to Joseph Shoub for Sixteen dollars 51 cents per acre. No. 2 containing 7 ac. & 20 prs. strict measure to Martin Herr for ten dollars & 39 cents per acre. No. 3 containing 16 ac. & 110 perches to Michael B. Barr for three dollars & 50 cents per acre, they being the highest & best bidders & that the highest & best price bidden for the same. Which report being read. The Court confers the sales of the premises sold to the several & respective purchases, to them, their heirs and assigns forever in fee, as fully as the said intestate had & held in the same immediately before & at the time of his death. Subject & liable to the payment of the purchase money.

Abraham Sides, who was 12 years of age on the 30th of November A.D. 1826 at $50 a year $72.88. Elizabeth Sides, 10 years of age on the 30th of September A.D. 1826, at $40 per year $58.31. Peter Sides 9 years of age on the 17th of April A.D. 1827 at $40 per year 58.31. Benjamin Sides who was of the age of 10 months & 20 days at the time of his Father’s decease, at $40 a year $58.31. Total $247.81. To the truth of the facts above stated said Sarah Sides was duly affirmed. Presented & the Court order notice to be given to John Keeports & Benjamin Graff Testamentary guardians of the minor children above mentioned, why the same should not be allowed on the 3d Monday in June next at 10 oClock A.M.
