JOHN BARR and Christian Moyer executors of the last Will and Testament of Henry Barr late of Leacock 'Township in the County of Lancaster Yeo- man deceased, produced to the Court the account of their acministration on the estate of the said deceased, examined by the Register whereby there appears a balance of sixty nine pounds four shillings and seven pence in their hands; which account the Court on examination allow and ap- prove of and direct that after deducting 12/ the ex- pences of this Court the remainder amounting to sixty eight pounds twelve shillings and seven pence be paid and distributed agreeable to the last will and Testament of the said deceased.

UPON 'THE PETITION of Thomas McDowell eldest son of James McDowell late of Little Britain Town- ship in the County of Lancaster Yeoman deceased, to this Court setting forth, that his father the said James McDowell died intestate seized and possessed of a certain plantation and tract of patented land situate in the Township and County aforesaid, con-taining ninety six acres and the usual allowance of six acres per cent for roads and highways, and also another tract of warranted land situate in the same Township and County, containing one hundred acres (be the same more or less) and left a widow and ten children, two of whom are yet minors That he is willing to hold and enjoy the said plantation and tracts of land and pay the several and respective shares of the widow and the other children of the said deceased, of, and in the same, according to a valuation or appraisement thereof to Be made by an Inquest to be appointed by this Court for that purpose: And praying this Court to award an Inquest to view the said plan-tation and tracts of' land, whether the same may or can be divided to and among the widow and children 0f the said deceased without injury to or spoiling of the whole: And if they find that the same cannot be so divided, that then they value and appraise the same and make report of their proceedings to the

next Court: It is considered. by the Court, and or-dered that the Sheriff- of Lancaster County do forth- with Summon an Inquest to view the said Plantation and tracts of land, in the said petition mentioned, whether the same may 01' can be divided to and am0ng the widow and children of the said deceased without injury to and spoiling of the whole: And if they find the same cannot be so divided that then they value and appraise the same, that notice be given to all parties interested, of the time of the partition or va-luation aforesaid, and make report of their pro-ceedings to the next Court.

UPON THE PETITION of John wunderlich and Valentine Hummel executor of the last will and Testament of Frederick Hummel late of Derry Town-ship in the county of Lancaster Yeoman deceased, to this Court setting forth, that the said Frederick .Huum-mel was seized in his demesne as of Fee, at the time of his death of and in a certain plantation and tract of land situate in the said Township and County containing one hundred and fifty acres and allowance for roads and highways, on which Hummmels Town- is erected: That the said Freder'ick Hummel made his last will bearing date the eighth day of April 1779 whereby he directed that his Sons Frederick and Da-vid should have the said plantation and Town, and that two years after his death the same with the Waggon, Plough and Harrow should be appraised by six men, the said petitioners being appointed his executors and John Early being nominated guardian over the minor children :That Frederick Hummel and David Hummel the sons of the said Testator, Peter frid-ley and Eve his wife one of the daughters of the said Testator, the said John Early guardian over the mi-nor children and these petitioners concur in the appli-cation now made to this Court to appoint six men as di-rected by the will for ' the purposes aforesaid: And pray-

PURSUANT To AN ORDER of this Court of the third day of December last, the Sheriff of the County of Lancaster, to wit, Thomas Edwards Esquire, returns the said order with an inquisition thereto annexed taken R upon the oath of twelve good and lawful men of his bai-liwick, who upon their respective oaths do say, that they have viewed a certain plantation and tract of patented land situate in .Little-Britain Township in the County of Lancaster containing ninety six acres and the usual allowance of six acres per cent for roads and Highways, and also another Tract of warranted land situate in the same township and County containing one hundred acres (be the same more or less) late of James McDowell deceased with the appurtenances, in the said order mentioned and do find that the said premises cannot be divided to and amongst the widow and children of the said James McDowell deceased, without prejudice to or spoiling of the whole and that the said several tracts of land containing in the whole one hundred and ninety six acres with the appur-tenances are worth and of the value of four hundred

And twenty two pounds in specie at and for which sum the said Inquest do value and appraise the same, and - Thomas McDowell Eldest son of James McDowe11 deceased appearing in Court and praying to hold and enjoy the said real estate of his said father at and for the valuation and appraisement aforesaid for that he was willing and desirous to pay the several and respective shares of the widow and children of the said deceased of and in the same. It is ordered that the said Thomas McDowell do on paying or securing to be paid the several and respective shares of the widow and other children of the said deceased, within one year; hold and enjoy the plantation and two, tracts of lands' aforesaid With the appurtenances in Fee, agreeable to the directions 0f the Acts of Assembly in such case made and provided: And the Court directs that the said Thomas McDowell do pay to Elizabeth McDowell the widow of the said deceased the sum of. eight pounds eight shillings and two pence yearly during her natural life in lieu and full satis-faction for her dower at common Law; out of a princi-pal of one hundred and forty pounds sixteen shillings and eight pence, one third part of the said valuation: which said principal sum and interest thereon is to be and remain charged on the premises as a security for the payment of the same, and that after the death of the said widow, the said principal sum of l140..16..8 shall be paid by the said Thomas McDowell his Heirs or Assigns holding the premises and be distributed and divided to and amongst the children of the deceased and their representatives according to the directions of the Acts of Assembly allotting two shares to the eldest son of the said decedent, and the Court directs a distribution of the valuation of the said estate in manner following:
