A petition by some residents of Leeds County to request a new provincial election, June 1835. Introduction and Transcription April 1997
INTRODUCTION AND BACKGROUND TO THE 1835 PETITION
For the Front of Leeds and Lansdowne Township (hereafter FOLL) there is an existing municipal census for the year 1833. The next existing census was taken in 1839. This time gap is when many immigrants, many Irish and Protestant, arrived in the Township; this was the first massive wave of Irish immigrants. The following petition of disaffected Tory/Gowan supporters, mainly Irish Protestant but with some old Tories, can aid in placing many newly arrived heads of households and, presumably, their age of majority male children, in some cases, in FOLL and other Townships in June of 1835. It can also give family researchers information on the political interests of their ancestors. Aside from land records, this is one of the few documents which can locate an ancestor in this time period; if the ancestors were leasing, their names would not appear until they purchased land. It may also identify individuals who had moved to another area before being recorded in surviving local censuses. Those interested in the politics of the time will have a list of many of Ogle Gowan's supporters, from Justices of the Peace to Orange Lodges members (they are not identified as such but it is tempting to identify certain groups of names, which appear more than once, in almost identical order, as Orange Lodges or at least groups which were, more that once, all present at the same time. The groupings which can be identified as belonging to FOLL Twp. certainly contain surnames that can easily be associated with Orangeism such as Birmingham and McAlpin in Leeds and Taylor, Steacy and McNickle in Lansdowne) and other members of the community. There is even a few identifiable Catholics in the list such as Dear, Curtin, Flood and Nailon (sic), in addition to the odd pre-Irish name such as Wiltse and Stevens. The Landons are conspicuous by their absence. Limitations This is not a complete list of all heads of households in Leeds County, by any means. It contains the names of Gowan/Tory supporters, many of whom would not have been able to vote because they were living at home and/or did not own land. Presumably everyone was age of majority, but that is a presumption only (James Turner Jr., on pages 84668 b & d, was in his fifteenth year. Recall how petitions are collected today, and what kind of control goes into the collection of signatures. What it does do, if your ancestor's name appears in the list is confirm that he and, most likely, his family is resident in the County at this date. If his name is surrounded by the same names as in later censuses then you can be more confident that he was in the locality you suspected but could not prove. One other caveat: simply because his name is on the list does not mean he actually signed the petition. As an example, John Deir's name appears on the petition three times, in association with the same group of names. Firstly, he could not write and no X's appear beside any names to indicate he was "signed for"; secondly, his name appears each time with the some of the most prominent Orange names in that part of the Township: Taylor, Webster and McNickle; thirdly, he was Irish Catholic. No one will ever know if John Deir actually supported Gowan, was coerced (his farm was a tiny bit of green in a sea of orange), or if his name was added each time without his knowledge. His brother James' name appears in the same grouping three times as well. It is noteworthy, though, that in 1846 he swore in an affidavit, with Robert Patterson, as to the residency in the township of Joseph Moxley (a relative of the Taylors); and in 1847 did the same, with William Moulton, concerning another piece of property. All of the names mentioned in the affidavits, including the J.P., Thomas Vanston, and the witness to the 1846 affidavit, John Neil, are on this petition. It does appear that John Deir got along quite amicably with his protestant neighbours. Background To The Petition In 1834 an election was held in Leeds County and the single polling station was at Beverly (now Delta). Ogle Gowan's "supporters" were on hand to intimidate the Reform voters and Ogle Gowan and Robert S. Jameson (Attorney General) were declared winners. It is interesting to note that elections then were very public affairs, with voters openly announcing their choices. Shortly after, the Reform government had the election annulled. In March of 1835, again at Beverly, a new election was held. The voting was scheduled to take six days but due to the violence and intimidation by the "Gowanites" the voting was halted after one day. Gowan claimed victory but the election was declared void in April. This petition was received by Sir John Colbourne, Lieutenant Governor, in June of 1835. According to Donald Akenson in the Irish in Ontario, A Study in Rural History there were approximately 800-850 eligible voters (keep this number in mind when you see the length of the list of petitioners). Both publications make reference to many other original sources of information. The subsequent elections are covered in the above publications, and are equally fascinating. Note: On the microfilm each page is identified as a poor copy. The page with the petition itself has pieces of the page missing, and some of the words at the edges of the page are difficult to read or illegible. The handwriting of the signatures can also be difficult to decipher. In many instances the same handwriting records several names in a row before someone else takes up the pen. were led to believe that they were men of private virtue...
and undoubted loyalty, and therefore little regarding shades of minor [illegible] abstract political
questions, but relying on their professions of loyalty and devotion, we were induced to return
them to Parliament, as the Representatives of the good and loyal people of this colony. Since
then, however, as a period has passed away, the Representatives of the people have been tried,
their professions have been put to the test, they have been "weighed in the balance" and, we
regret to add, a majority of them "found wanting".
At a period like the present when such a restless struggle is [illegible]
between principles of a destruction and conservative nature, we hoped to have found in the
members of our House of Assembly, men influenced by strong and rigorous desire to preserve
our Institutions from the introduction of destructive principles, and that they would be more than
ordinarly (sic) guarded against a deleterious mixture, with those anti British and Republican, but
[illegible] and fallacious notions, of liberty and equality, which so pre eminently distinguish our
southern neighbours, but instead of which, we were sorry to [illegible] bit too evident a leaving,
toward that form of Government which se(ems) repudiated by the brave and (hardy) [illegible] of
thousands of the inhabitants of this Colony, very often at the sacrifice of their property and
[illegible] unfrequently (sic) of their lives.
Believing as we do, that a majority of the present Ho(use) of Assembly
does not truly represent the feelings and wishes of the people of this Province, and that they
ought not to be further entrusted with political or legislative power, we respectfully entreat your
Excellency to exercise the Royal Prerogative with which you have been invested by our most
gracious and most excellent Sovereign, for the advantage and benefit of his loyal people in this
Colony, in dissolving the present Parliament, and thus appealing to that loyalty, devotion, and
good sense, which has never failed to character(ise) the people of Upper Canada in support of
their Monarch, the Constitution, and the Unity of the Empire.
