"Capt. John Kell's company, which, before the war, had been
organized as a militia company, called the Franklin Grays, was the
first company to leave the county for service under the telegraphic
call for troops."

"Col. John Kell was a native of Germany. He spent his life
mostly in America, and when the Mexican war broke out was a resident
of Steubenville. He came to Franklin about 1856, and opened a tailor
shop. He was made Postmaster by Buchanan. Having been in the Mexican
war, his military proclivities manifested themselves in the
interest he felt in all military affairs. He organized a company,
which, from their uniform, was called the Franklin Greys—Captain,
J. Kell; First Lieutenant, P. S. Turner; Second Lieutenant, O. C.
Maxwell; Orderly, I. M. Snell. This company became celebrated for
its proficiency in drill, and when the war broke out, almost all
of its members enlisted and the company retained its organization.
When they returned from the three-months' service, he was appointed
Lieutenant Colonel of the Second Ohio Volunteer Infantry, and entered
the Service. He was killed at the battle of Stone
River. His body was brought home and buried with Masonic rites in
the cemetery east of the canal."

"Franklin enjoys the distinction of sending out one of the
earliest, as well as one of the best-drilled, and best-equipped
companies in the early history of the war. As soon as the call of
the President was made for troops, in April, 1861, Capt. Kell called
for volunteers, and almost all his entire company, the Franklin
Greys, at once responded. Those who did not wish to go easily found
others to take their places. The citizens at once determined to
uniform the men, and, in less than a week, the company, uniformed
and numbering more than a hundred men, was in Columbus, Ohio. They
were assigned to the First Ohio and became Company B of that regiment.
They were assigned to duty in and near Washington. They were sent
out as skirmishers at Bull Run, and one of the company fired the
first shot in that battle, having discovered an artillery man of
the Southern army pulling brush from in front of a masked battery
and his fire brought a return shot from the battery. In this battle,
the company had one man, A. B. Spader, captured
by the rebels, and one blinded by a fragment of a shell. After their
discharge, most of the company re-enlisted—a great many in
the Second Ohio with Capt O. C. Maxwell."

"John Kell Post, No. 241.
This Post was chartered June 29, 1882, and is located at Franklin.
It is named for Colonel John Kell, late of the Second Ohio Volunteer
Infantry. Sprung from a line of soldiers, having himself been
in the Mexican war, of a high spirit and dauntless courage, John
Kell was fitted to be a leader of volunteers of '61. Enrolling
Company F, First Ohio, for three months' service, with a pledge
"to be in the struggle to its end," he joined early friends
in organizing the Second Ohio Volunteer Infantry, three years, becoming
its lieutenant-colonel. His service ending with his fall at
Stone River, summed up the best results of a strong, resolute manhood."

John Kell was enrolled into the service on 8 Aug 1861 at Camp Dennison
by the Governor of Ohio as a Lieut. Col. 2nd Regt. Ohio Volunteers
and was mustered into U. S. service for 3 years or during the war
on 27 Aug 1861. He was promoted to Col. on 24 Dec 1862. A week later
he was killed in action by a gunshot wound on 31 Dec 1862 at the
Battle of Stone River, Murfreesboro, TN.
John Kell married his 1st wife, Maria McCullough in Jefferson County,
Ohio on 17 Jan 1839. They had 3 children, William Hudson Kell, born
18 Apr 1841; Samuel Medary Kell, born 12 Apr 1843 and Martha Jane
Kell born 15 Apr 1848. Maria filed for and received a divorce from
John in 1853, claiming John Kell deserted his family about 2 Apr
1849. The Jefferson County court granted the divorce and awarded
her alimony of $100 per year for 10 years.
John Kell married his 2nd wife, Elizabeth Bailey, at Franklin, Ohio
on 30 Jan 1855. John & Elizabeth had two children, Joel B. Kell
born Feby 6th 1861 and Eliza R. Kell born Jan 31st 1856. Elizabeth
(Bailey) Kell died 22 Feb 1861.
Elias Bailey, of Franklin, Ohio, filed for a pension as the guardian
for his grandchildren, Joel B. Kell and Eliza R. Kell (Application
# 24941, Certificate # 87618). About the same time, Maria Kell,
of Steubenville, Ohio, filed for a pension for her youngest daughter,
Martha Jane Kell. All three children received a minor’s pension
until they turned sixteen.

says,
"On the breaking out of the Rebellion in 1861 he enlisted
at the age of 17, becoming Corporal of Company C, Fifth, O. V. I.
After a service of four and one half years he was honorably discharged
and immediately re-enlisted but the war soon ended as also his services
as a soldier, but as such he had participated in some 23 engagements,
fought in the battles of Winchester, Cedar Mountain, Antietam, Chancellorsville,
Gettysburg, and many other important battles, and was with Sherman
on his famous march to the Sea.
His regiment the 5th Ohio, was involved in some fierce and bloody
conflicts, was finally so cut to pieces that the survivors were
distributed among other regiments."

"Charles Kirk had the small-pox in Louisville. Our information
as to his being hurt by the cars was erroneous; and we learned that
he died last week."

"We learn from our friend Winston Ricks, that the death of
Charles Kirk from small-pox, at Louisville, was hastened if not
caused, by bad treatment. When it was first discovered that his
disease was small pox, he was conveyed from his boarding house to
the hospital, from thence sent to the pest house, where the young
practitioners declared his complaint to be typhoid fever and ordered
him back to the hospital. All this on a very cold day, and when
the disease was of the confluent kind. He did not know his monther
when she arrived at his bedside form Lebanon, and only recognized
her during a few moments of consciousness before death, when his
blindness prevented him from seeing her. Mrs. Shoemaker has brought
suit against the authorities of Louisville for $10,000 damages,
for the inhuman treatment given her son, with, it is said, fair
prospects of success. The Lawyers engaged on the plaintiff's sied
have agreed to push her claims gratuitously.

Society
" . . . Mr. Koogle served in the Civil war being a member
of the Seventh Independent troop of Ohio Cavalry, known as the Union
Light Guards, and organized by Governor Tod and sent to Washington
as a body guard for President Lincoln. The troop was composed of
men all of whom were at least six feet tall and all were mounted
on black horses. Mr. Koogle was discharged after serving almost
to the close of the war because of disability from the kick of a
horse. . . ."

Kurfiss, widow of John Kurfiss,
Captain, Co. B, 4th Kentucky Volunteer Cavalry (40

John Kurfiss enrolled at Louisville, Kentucky on 1 Oct
1861 to serve 3 years, was mustered in as a Captain of Company B,
4th Regt. Ky Cavalry on 24 Dec 1861 and was honorably discharged
on 15 Sep 1862. First Lt. Charles Kurfiss, Regimental Quartermaster,
certified that his brother, Capt. John Kurfiss, developed chronic
bronchitis which steadily worsened until he was no longer fit for
duty and was discharged on 15 Sep 1862. In his statement, he said,
"I know moreover that my said brother never was as well
afterwards or before . . ." John Kurfiss returned to his
home in Louisville, Ky but never recovered from his illness and
subsequently died there on 11 Apr 1865.
John Kurfiss and Caroline E. Weisenberger/Wisenberger
were married in Warren
County, Ohio on 2 Oct 1851 by Joel A. Stokes, J.P.
They had one child, John Frederick Kurfiss, born
29 Jun 1855.
Caroline Kurfiss first filed for a pension in Louisville,
Kentucky on 7 Sep 1865. Due to neglect of her Kentucky attorney,
she refiled for a widow's pension in Lebanon, Ohio on 28 Sep 1868
at the age of 40 (Application #149698), naming D. Allen
her new attorney. Testimony to support her claim was provided by
Robert A. Small, Isaac R. Greene, Louis Rehms, Elizabeth
Kurfiss, Auguta Gunkel. Lizzie M. Dynes and Mattie Wisenberger.
She was awarded a pension of $20/month (Certificate #126736 dated
27 Mar 1869) commencing 12 Apr 1865 plus $2/month for her son John
until he reached the age of 16 on 28 Jun 1872. She was last paid
at $20 to 4 Dec 1889 after which she died and was dropped from the
rolls.
