This Indenture made this twenty eighth day of September in the year of our Lord one Thousand eight hundred and nine by and between Thomas Paxton and Martha Paxton his wife of the County of Clermont and State of Ohio of the one part and Theophilus Simonton of the County of Clermont and State aforesaid of the other part witnesseth that the said Thomas Paxton and Martha his wife for and in consideration of the sum of three hundred dollars to them in hand well and duly paid by the said Theophilus Simonton before the sealing and delivery of these presents the receipt and payment of which the said Thomas Paxton and Martha Paxton his wife doth hereby acknowledge and thereof and therefrom doth acquit release exonerate and forever discharge the said Theophilus Simonton his Heirs Executors and Administrators by these presents hath and doth hereby grant bargain sell alien enfoeff convey and confirm unto the said Theophilus Simonton his Heirs and Assigns forever all that Tract or parcel of land lying and being on the waters of Obannons Creek viz: beginning at a certain white oak and two sugar trees on a line of Joshua Coxs survey thence along his line East 40 poles to a Hickore [sic] and Ash on a line of ?Richard? Cauls survey thence with his line North 45° East 50 (or 80: DNR) poles to three Hickories thence N60W 196 poles to an Elm Ash and Maples thence South 70° West 167 poles to a crooked white oak thence South 68° East 240 poles to the place of beginning containing 165 Acres by estimation.

To have and to hold the said premises with all and singular the appurtenances thereunto belonging or in anywise appertaining to the only proper use benefit and behoof of the said Theophilus Simonton and his Heirs and Assigns forever and the said Thomas Paxton & Martha Paxton his wife for themselves their Heirs Executors and Administrators and Assigns Covenant and grant unto and with the said Theophilus Simonton and his Heirs Executors and Administrators and Assigns that they the said Thomas Paxton and Martha his wife are by Pattent [sic] lawfully and rightfully seized of the beforementioned premises and of ever [sic] part and parcel thereof and also that they the said Thomas Paxton and Martha Paxton hath good right full power and lawful authority in their own right to grant bargain sell and convey the same in manner and form aforesaid and the said Thomas Paxton and Martha Paxton for themselves their Heirs Executors and Administrators further covenant and grant unto and with the said Theophilus Simonton his Heirs Executors Administrators and Assigns that the beforementioned premises with all and singular the appurtenances thereunto belonging or in any wise appertaining unto the said Theophilus Simonton and his Heirs and Assigns against the said Thomas Paxton and Martha Paxton his wife and their Heirs Executors and Administrators and every other person or persons whatsoever shall and will warrant and by these presents forever defend.

In Witness whereof the said Thomas Paxton and Martha Paxton have hereunto set their hands and Seals at their own dwelling house the day and year above written.

State of Ohio, Clermont County, SS// Be it remembered that on the twenty eighth day of Sep. Anno Domini Eighteen hundred and nine personally appeared before me the subscriber as Justice of the Peace in and for the County aforesaid Thomas Paxton and Martha Paxton his wife severly [sic] acknowledged the within signature for every purpose therein expressed and requested the same to be record as such at the same time Martha Paxton being [privately examined apart from her Husband and declared the same to be her voluntary act not through fear or compulsion from her husband --
