To all to whom these presents shall come Greeting. Whereas
at the November Term of the Court of common pleas within and for the
County of Warren and State of Ohio A.D. Eighteen hundred and forty three,
in a certain petition for the sale of real estate wherein William B. Strout
as administrator of Cyrus Simonton, late of Warren County aforesaid, de-
ceased, was petititioner, and Elizabeth Simonton, David L. Simonton, Phebe
McCurdy and Jonas McCurdy, Elizabeth Hutch, Joseph V. M. Hutch, John
S. Simonton, Mary Simonton, James Simonton, Sarah Jane Simonton,
Martha Simonton, Rachel Simonton, Richard Simonton, Susan Si-
monton, Eliza E. Simonton & Rebecca Simonton, Respondents, the said
William B. Strout, as administrator of said Cyrus Simonton was ordered
to sell at public auction certain real estate of said intestate hereinafter
descri-
bed, And Whereas the said Administrator having duly advertised said
real estate did on the Eighth day of April Eighteen hundred and forty four
sell the same at public auction to Elizabeth Simonton, of the County a-
foresaid for the sum of two hundred and twenty four dollars, which sale was
afterwards at the April Term of said Court confirmed and said admin-
istrator ordered to execute and deliver a deed in fee simple to the said Eliza-
beth Simonton for the premises so sold all which will more fully appear
reference being had to the records of said Court. Now therefore, I, the said
William B. Strout as administrator of the said Cyrus Simonton in consid-
eration of the premises and by virtue of the powers in me vested by law do
by these presents grant bargain alien and convey to the said Elizabeth
Simonton & to her heirs and assigns forever the said tenements so sold as
aforesaid, and which are bounded and described as follows, to wit, situated
in the county of Warren, Ohio, all that tract or parcel of land lying and
being on the waters of the Little Miami being part of Survey No. 3797,
containing fifty six acres be the same more or less bounded as follows, to wit:
Beginning at William H. Roberson’s North West corner at two beeches &
a
Hickory & an Elm, thence – 39º-24’ E. 67 poles to a stake
& two beeches, thence
N. 47º E 134 poles to a stake, two hickories & an oak, thence N. 39º.W.
67 poles
to four beeches, thence South 49º W. 134 poles to the beginning –
subject to
the dower estate of the said Elizabeth Simonton heretofore set off & described
as
follows to wit. “Beginning at a stake at the S.W. corner of said tract
of land thence
N. 27 ½ º W on the line between said tract and land
owned by William H. Robertson 22 66/100 poles to a stake, thence N. 18 ½º
E. 134 poles
to a state, thence S. 37 ½º E. 22 66/100 poles to the South East
corner of said lot
two hickories and an ash thence S. 48 ½ºW. 134 poles to the place
of beginning
containing 18 acres & 156 square poles.” With all and singular the
appurten-
ances. To have and to hold the said premises, first above des-
cribed, subject to the dower above described, to her the said Elizabeth
Simonton and to her heirs and assigns forever. In testmony Where of
I as administrator of the said Cyrus Simonton do hereto set my hand & Seal
this Tenth day of June Eighteen hundred and forty four.
