Summary: |
While serving as a Private in Capt. Shaw's company of Ohio Militia during the War of 1812, Frederick Briney made out his will on 14 Jul 1813 at Camp Meigs which was located near Dayton on the west bank of the Mad River. Briney contracted a disease while in the service and would die 15 days later while on leave at Lebanon on 29 Jul 1813. His will was proven and filed in Warren County, Ohio on 17 Oct 1813. In 1825, Mason Seward was appointed guardian of Mary Briney (age 16) and Daniel Briney (age 14), children of Frederick Briney, deceased. |

In the name of God, amen – I Frederick
Briney of Warren County State of Ohio and now a private in
Captain
Shaws company of Ohio Militia being weak in body of sound mind
and memory do hereby make this my last will and testimony viz: it is my
will and desire that Capt.
Patrick Shaw take possession of all my property at this place
dispose of it as he may think proper and deliver the proceeds thereof ,
together with sixteen dollars and twenty five cents of my money now put
into his hands to my well beloved wife Anne Briney; it
is also my will and desire the whole of my personal property except as above
be sold by publick auction and that the proceeds thereof be applied to the
use and benefit of my surviving children at the discretion of my executors
herein after mentioned and lastly it my will and I do hereby bequeath to
my well loved wife Anne Briney, all the benefits and advantages
that may or shall arise from my lease of part of a ministerial section,
whereon she now resides and that it be entirely under her control or disposal,
the better to enable her to raise my surviving children with becoming decency. For the purpose of carrying this my last will and testimony into effect, I do hereby appoint my beloved wife Anne Briney my executrix and my worthy friend Edward Ross my executor, in conjunction to execute these my last wishes. Know all men by these presents, That we Mason Seward & Henry Houk of the county of Warren, and state of Ohio, are held and firmly bound to the State of Ohio in two hundred dollars, to be paid to the said Sate of Ohio, or his certain attorney - to which payment well and truly to be made, we bind ourselves and each of us jointly and severally, our, and each of our heris, executors and administrators, firmly by these presents. Sealed with our seals, at Lebanon, the 20th day of May in the year of our Lord one thousand eight hundred and twenty five. The condition of this obligation is such that whereas the Court of Common Pleas for the county of Warren aforesaid, did, on the 19th day of May in the year of our Lord one thousand eight hundred and twenty five appoint the said Mason Seward of the county of Warren aforesaid guardian for Mary Briney aged sixteen years, of the said county of Warren, and child of Frederick Briney of Warren county, deceased, NOW, if the said Mason Seward shall well and truly execute and discharge with fidelity the duties enjoined on him as Guardian, render an accurate statement of his transactions, with a just account of the profits arising, and deliver up the same to the said court of Common Pleas, at such time as the court may require, agreeable to the true intent and meaning of the laws of the state of Ohio, in such case, made and provided, then this obligation to be void, otherwise to remain in full force and virtue.
