Last Will and Testiment of John Albert Korte

I, John (crossed out) Albert Korte, of the City of Cincinnati, County of Hamilton & State of Ohio, being in good health of body, and of sound and disposing mind and memory, and being desirous to settle my worldly affairs whilst I have strength and capacity so to do, do make and publish this my last will and testament, hereby revoking and making void all former wills by me at any time heretofore made.

    First: I desire that all my just debts and the expenses of my funeral shall be fully paid.

    Secondly: The shares which my daughters shall inherit in my real estate shall go to them for life only, remainder over to their respective children, if they have any. In case of the death of any one or more of my daughters without leaving issue alive, then the share of such daughter shall go to her brothers and sisters then living and the children of such as may have died, in such proportions that, said children shall receive the same share that their parent would receive if living.

    Thirdly: My real estate shall not be sold or divided until after the expiration of five years from the date of my decease, unless my executor shall elect sooner to sell or divide the same and, for the purpose of carrying on this my last will & testament. I do empower my executor to sell or divide my real estate at any time within five years from the date of my decease, upon such terms as to him may appear most advantageous; the said real estate, as long as it remains unsold & undivided to be controlled and managed by my executor, the rents of the same to be applied first to the payment of taxes and other charges 7 the keeping of the property in repair: One third of the residue to be paid over to my widow –while living in lieu of Dower, an after her death to my children in equal proportions.

    Fourthly: I nominate & appoint my son Alfred Korte Executor of this my last will and testament.
Fifthly: When my Real Estate shall come to be sold I desire that the portions of my daughters shall be invested in other real estate to be held by them for life and remainder over as herein before provided.

In witness whereof I John Albert Korte, have to this my last will & testament, set my hand and seal this Eighth day of June Eighteen Hundred and Sixty Eight

The will was probated in Hamilton County and reads:
The State of Ohio, Hamilton County
Hamilton Probate Court
Probate of the last Will of Albert Korte deceased, presented on the 19th day of October A.D. 1870. Personally appeared in open court Robert C. Rogers & A.K. Brookbank the subscribing witnesses of the last Will and Testament of Albert Korte deceased, who being duly sworn, according to law, to speak the truth, the whole truth, and nothing but the truth, in relation to the execution of said will depose and say that they were present at the making of said Will, and, at the request of the deceased, subscribed their names to said Will as witnesses, in the presence of the deceased, and of each other; that they saw the said Albert Korte deceased, sign and seal said Will, and heard him acknowledge the same to be his last Will and Testament; that the said Albert Korte was, at the time of making, signing and sealing said Will, of legal age and of sound and disposing mind and memory, and under no undue or unlawful restraint whatsoever.
Sworn to and subscribed in open Court, this 19th day of October A.D. 1870.
