TRYON COUNTY
PROVINCE OF NEW YORK

1772 On March 12, an Act passed by the Colonial Legislature "to divide the County of Albany into three Counties". Said Act recites " --- The Number Inhabitants and their great Distance from each other rendering the Administration of Justice extremely Difficult and Burdensome; many People as County Officers, Jury-Men, Suitors and Witnesses being obliged to travel near two hundred Miles to the City of Albany where the County Goal is, and where the Courts of Common Pleas, Sessions of the Peace, Oyer and Terminer and General Goal Dilivery are held, so the Inhabitants instead of having Justice distributed according to our excellent Constitution as it were at their Doors, are from the enormous Extent of the said County of Albany, exposed to great Hardships, and lesser Crimes pass unnoticed, and Crimes of the most atrocious Nature frequently go unpunished for the Want of the Attendance of Witnesses upon Grand Juries sitting, and coming from places remote from those where the Offences were committed, and Sherriffs and Coroners are discouraged from executing both Civil and Criminal process and the Expence of attending the Courts often exceeds the value of the Thing in demand and great default of Justice is occasioned, and as the Power of the Justices of the Peace in the Determination of small Causes to two Pounds and under is commensurate with the County, the people either as Parties or Witnesses are sometimes compelled to such remote Attendance, and to such a waste of Time as Discourages the Settlement of the country. Wherefore that an adequate Remedy may be applied to these and many other Evils too Tedious to be particularly enumerated.

BE IT ENACTED ---That the County of Albany shall be henceforth restricted to the Bounds and Limits following to wit, On the South, and on the West Side of Hudson's River by the County of Ulster as Ascertained by the first before - mentioned Act intitled, 'An Act to divide the Province and Dependencies into 'shires and Counties'. and on the West by Delaware River and the West Branch thereof as far up as a certain Lake called Utsayantho, and thence by a Line North twenty-five Degrees East until it be intersected by a West Line drawn from the North West Corner of the old Schoharie Patent, thence East to the North West Corner of the Township of Duanesburgh, thence along the North Bounds thereof to the North East Corner of the same thence on the same Course with the said North Bounds of Duanesburgh to the Mohawk River, thence North until it intersects a West Line drawn from Fort George near Lake George, thence East until it intersects a North Line drawn from that high Falls on Hudson's River which lays next above Fort Edward, thence South to the said Falls thence along the East Bank of Hudson's River to a certain Creek called Stoney Creek thence East five hundred and ten chains, thence South to the North Bank of Batten Creek thence up along the North Bank of said Creek until the said Creek intersects the South Bounds of Princetown, thence along the same to the South East Corner thereof, thence East to the West Bounds of the County of Cumberland, thence Southerly and Easterly along the West and South Bounds thereof to Connecticut River, thence along the said River to the North Bounds of the Colony of Connecticut, thence along the North and West Bounds of the same to the County of Dutchess, thence along the North Bounds of the said County of Dutchess to Hudson's River, and thence by a Straight Line to the North East Corner of the County of Ulster on Hudson's River.

AND BE IT FURTHER ENACTED by the same Authority. That all the Lands lying within this Colony to the West ward of the County of Albany as restricted by this Act, and to the Westward of the North Line from the Mohawk River above mentioned continued to the North Bounds of this Province, shall be one Separate and distinct County, and be called and known by the Name of the County of Tryon.

AND BE IT ENACTED by the same Authority. That all the Lands lying within this Colony to the Northward of the County of Albany as restricted by this Act, and Eastward of the County of Tryon, and to the Westward and Northward of the Counties of Cumberland and Gloucester shall be one separate and distinct County, and be called and known by the Name of the County of Charlotte. ---- nor shall any of the Lines so assigned for the Limits of either of the said Counties be deemed to take away abridge destroy or Affect the Right and Title of Any Bodies Politic or Corporate or of any Patentee or others holding under any Patentee or Patentees in any Manner or by any ways or means whatsoever. ----" Laws of the Colony of New York 1772, Chapter 1534. (The County Seat of Tryon County was at Johnstown in the Mohawk District.)

1772 On March 22, an Act of the Colonial Legislature passed "An Act to divide the Counties of Albany and Tryon into Districts". (The Act divided Albany County into 15 Districts and Tryon County into 5 Districts - the Mohawk District, the Stone Arabia District, the Canajoxharie District, the German Flatts District and the Kingsland District. Of these Districts, two affected land which became Delaware County. They were established as follows:)

"That all that Part of the said County of Tryon which is comprehended by the following Bounds to wit, on the East by the Mohawk District, on the West by a south Line from the Little Falls, on the South by the South Bounds

of this Colony on the North by the Mohawk River shall be one separate and distinct District and be henceforth called and known by the Name of Canajoxharie District.---

That all that Part of the said County of Tryon which is comprehended within the following Bounds to wit, on the East by the Canajoxharie District on the North by the Mohawk River, southerly and Westerly by the Limits of this Colony shall be one separate and Distinct District, and be henceforth called and known by the Name of Kingsland District.---

BE IT ALSO ENACTED by the same Authority, That the Freeholders and Inhabitants of every District in the said Counties as by this Act ascertained are hereby required and authorized yearly and every year upon the first Tuesday in May to elect and appoint one Freeholder to be a Supervisor, two Freeholders to be assessors, one Freeholder to be Collector, two Freeholders to be Overseers of the Poor, two Constables, two Fence Viewers and one Clerk, which Supervisors Assessors and Collectors for the said Districts respectively shall have the same Power and Authority to perform execute and serve, and be liable to the same Pains and Penalties as the Supervisors Assessors and Collectors of the several Counties within this Colony have or intended to have, or ought to have, or ought to do, or be liable to, by an Act passed in the Year one thousand seven hundred and three entitled 'An Act for the better explaining and more effectual putting in Execution an Act of general Assembly made in the third Year of the Reign of their late Majesties King William and Queen Mary entitled An Act for defraying the Public and necessary Charge throughout this Province, and for maintaining the Poor and preventing Vagabonds.'----". Laws of the Colony of New York 1772, Chapter 1552.

1773 On March 8, Stone Arabia was renamed Palatine, Kingsland was renamed German Flats and German Flats was renamed Kingsland. (Gazateer, Page 470)

1775 On April 3, an Act of the Colonial Legislature passed, which among other actions, provided for the erection of the Old England District in Tryon County. This District ran to and along the west, south and east lines of the Wallace Patent and included land which became Delaware County in 1797. This Act was the last published Act of the Colonial Legislature. (Monroe, 37)

1777 On April 20, after the Revolutionary War, the Colony of New York adopted the Constitution of 1777 and became the State of New York in the United States.

1784 On April 2, Tryon County was renamed Montgomery County.
