Will of Truman Dings

In the name of God Amen. I Truman Dings of the town of Middleburgh, County of Schoharie, N.Y. being in good bodily health and of sound and disposing mind and memory. Calling to mind the frailty and uncertainty of human life and being desirous of settling my worldly affairs and directing how the estate with which it has pleased God to bless me, shall be disposed of after my decease, while I have strength and capacity so to do, do make publish and declare this my last will and Testament hereby revoking and making null and void all former wills by me heretofore made.
As to all my worldly estate I give devise and dispose thereof as follows, viz.
First. It is my will that all my just debts and funeral expenses shall be paid out of my estate (by my Executor hereinafter named) as soon after my decease as may be convenient.
Second. All the rest of my estate whether real personal or mixed of whatever kind or kinds or wherever found, of which I shale die seized or possessed or be entitled to at the time of my decease I give devise and bequest to my beloved wife Mary Elizabeth Dings to have and to hold the same to her sole use and benefit heirs and assigns forever.
Lastly, I do hereby nominate and appoint my friend Adam Snyder Jr. of the town of Middleburgh, County of Schoharie N.Y. to be sole executor of this my last will and testament.
On testimony whereof I Truman Dings have hereunto set my hand and seal and do publish and declare this to be my last will and testament in the presence of the witnesses named below this 10th day of February in the year One Thousand eight hundred and seventy seven.

The above instrument consisting of one sheet was now here subscribed by Truman Dings the testator in the presence of each of us, and was at the same time declared by him to be his last will and testament, and we at his request sign our names hereto as attesting witnesses.

Codicil

Whereas I Truman Dings of the Town of Middleburgh County of Schoharie N.Y. have made my last will and Testament in writing bearing date February 10, 1877 and have thereby appointed Adam Snyder Jr. sole Executor of my said will now I do by this my writing which I hereby declare to be a codicil to my said will, to be taken as a part thereof, revoke said appointment and do constitute and appoint my wife Elizabeth M. Dings sole executor of my said will.
In witness whereof I have hereunto set my hand and seal this 12 day of December in the year of our Lord One thousand eight hundred and seventy seven.

The above instrument of one sheet was at the date thereof, declared to us by the testator, and he acknowledged to each of us that he had subscribed the same and we at his request sign our names hereto as attesting witnesses.

& codicil of Truman Dings late }
of the town of Middleburgh deceased} Schoharie County Ss.

Albert Becker of Huntersland in the County of Schoharie and Nicholas Rosen of Huntersland in the County of Schoharie being duly sworn in open Court, do depose and say that they are the subscribing witnesses to the last will and Testament and Codicil thereto of Truman Dings, late of the town of Middleburgh in the County of Schoharie, deceased. That the said Truman Dings did in the presence of these deponents subscribe his name at the end of the instrument which is now shown and exhibited to these deponents and which purports to be the last will and Testament and Codicil thereto, of the said Truman Dings deceased, and which will bears date on the 10th day of February in the year of our Lord One thousand eight hundred and seventy seven and to the said Codicil on the 12th day of December in the year of our Lord one thousand eight hundred and seventy seven. Deponents further say that the said Truman dings the said testator did, at the same time as subscribing his name as aforesaid at the end of the said instrument declare the said instruments so subscribed and now exhibited to be his last will and testament and Codicil thereto, and these deponents did thereupon subscribe their names at the end of the said Will and Codicil, as attesting witnesses thereto, at the request and in the presence of the said testator and of each other. Deponents further say that at the said time when the said testator subscribed his name to the said last will and Codicil thereto, as aforesaid, and at the time of these deponents subscribed their names as attesting witnesses thereto, as aforesaid, the said Truman dings was of sound mind and memory, of full age to execute a will of real estate, and was not under any restraint, to the knowledge, information and belief of these deponents and further these deponents say not.

I Charles Holmes Surrogate of Schoharie County, do hereby certify that the last will and Testament and Codicil thereto of Truman dings late of the town of Middleburgh in the County of Schoharie deceased, of which the foregoing record is a true copy was by me duly admitted to probate and recorded as a will relating to both real and personal estate. On the nineteenth day of September One thousand eight hundred and eighty one which record together with the foregoing record of the proofs and examinations taken before me in relation to the execution and validity thereof, is hereby signed and certified by me pursuant to the provisions of the Revised Statutes of this State==
