The last will and testament of Simon Flagler
Probate dated 11 April,1775

In the name of God Amen. I Simon Flagler of Charlotte
Precinct in Dutchess County in the province of New
York, being weak in body but of sound mind and memory
(blessed be God for the same) do make and publish this
my last will and testament in manner following (that
is to say)
First I give my soul to God who gave it to me and my
body to the dust, in hope of a glorious and immortal
Resurrection.
                      Also, I will that all my just debts and
funeral charges be paid by my Executor herein after
named out of my moveable estate.
  Also, I give and bequeath to my oldest son Zachariah
Flagler the sum of six pounds current money of New
York for his birthright.
  Also I give and bequeath to my daughter Sarah Flagler
one bed and bedding, one suit of curtains, two cows,
two pewter platters, two pewter basins, six pewter
plates, six spoons, one set of knives and forks, one
iron pot and one iron kettle.
  Also I give and bequeath to my daughter Jane Flagler
one bed and bedding, one suit of curtains, two cows,
two pewter platters, two pewter basins, six pewter
plates, six spoons, one set of knives and forks, one
iron pot and one iron kettle.
  Also I give and bequeath to my son John Flagler fifty
pounds current money of New York, two horses, one set
of horse tackling, one plow and irons, and one gun to
be paid and delivered to him at the age of twenty one
years, or day of his marriage which shall first
happen.
  Also I give and bequeath to my daughter Halanah
Flagler one bed and bedding, one suit of curtains, two
cows, two pewter platters, two pewter basins, six
pewter plates, six spoons, one set of knives and
forks, one iron pot and one iron kettle to be
delivered to her at the age of eighteen years or the
day of her marriage which shall first happen.
  Also I give and bequeath to my beloved wife Hester
Flagler the use of my house and all my lands and
premises in Charlotte Precinct aforesaid whereon I now
live. During the time she shall remain my widow, she
taking a prudent care thereof and making or suffering
no waste or destruction thereupon, but only to get and
provide a comfortable maintenance thereon, also my
Negro man named Tom, together with all my household
goods, farming utensils and other moveable estate that
shall be on the land and premises aforesaid at the
time of my death (except what is herein before given
and bequeathed to my said children). During the time
she shall remain and continue my widow as aforesaid,
and after the death or marriage of my said wife Hester
Flagler then I give and devise the same to my nine
children here after named Zachariah Flagler, Peter
Flagler, Simon Flagler, Joanna the wife of Henry Van
Voorhis, Elizabeth the wife of Jacob Lester, Sarah
Flagler, Jane Flagler, John Flagler, and Halanah
Flagler and to their heirs and assigns forever to be
equally divided between them share and share alike,
but if either or any of my said children shall die
unmarried and without heirs than his, her or their
part and proportion so dying to be equally divided
between the survivors of him, her or them their heirs
and assigns forever.
  And lastly I do make ordain and appoint John
Carpenter, Reuben Hopkins and Jacob Smith of Charlotte
Precinct aforesaid Executors of this my last will and
testament hereby revoking all former wills by me made.
In witness whereof I have hereunto set my hand and
seal the twenty ninth day of November in the year of
our Lord one thousand and seven hundred and seventy
four.

  Signed, sealed, published and declared by the above
named Simon Flagler to be his last will and testament
in the presence of us who have hereunto subscribed our
names as witnesses in the presence of the testator.

Dutchess County. Be it remembered that on the third
day of January in the year of our Lord one thousand
seven hundred and seventy five personally came and
appeared before me David Carpenter of Charlotte
Precinct in Dutchess County Yeoman.
Bartholomew Grannett Surrogate of Dutchess County and
being sworn on his oath declared that he saw Simon
Flagler sign and seal the foregoing instrument
purporting to be the will of the said Simon Flagler
bearing date the Twenty Ninth day of November last and
heard him publish and declare the same to be and
contain his last will and testament that at the time
thereof he the said Simon Flagler was of sound
disproving mind and memory to the best of the
knowledge and belief of him the said David Carpenter
and that his name subscribed thereto is of his proper
hand writing which he subscribed as a witness to the
said will in the presence of the testator and that he
the deponent saw Adrian Vanander sign his mark and
Peter Comby sign his name as other witness to the said
will in the testators presence.

Dutchess County-Be it also remembered that on the
sixteenth day of March in the year 1775 John
Carpenter, Reuben Hopkins and Jacob Smith the
Executors of the within written will of Simon Flagler
likewise appeared before me the said Bartholomew
Grannett and were duly sworn to the true execution and
performance of the said will by severally taking the
oath of an executor as by law appointed before.
