Last Will and Testament of Philip Dreisbach

The last will and Testament of Philip Dresisbach of the Town and County of Schoharie. I Philip Dreisbach in view of the uncertainty of life, and being of sound mind and memory, do make and publish this my last will and Testament, in the manner following that is to say.

First. I give and bequeath to my daughter Betsy, the wife of Jacob L. Lawyer and to her heirs and assigns, the sum of one Hundred Dollars, to be paid within three month after my decease, and I hereby order that the payment thereof shall be a charge on the real estate hereinafter devised to my Grand Son, Jacob Lawyer Dreisbach.

Second. I give, devise and bequeath to my Grand Daughter Rebecca Dreisbach, the Daughter of my son, Adam Dreisbach, and to her heirs and assigns Forever, one acre of land, on the south side of the Schoharie road, on which the House and stable stand, where Abraham Ellis now lives, and to be bounded as follows, Northerly by the old Schoharie road, Easterly by the land of Peter Mann, Westerly by the land and so far Southerly, as to make an acre of land.

Third. To my Grand son, Jacob Lawyer Dreisbach, and to his heirs and assigns I give devise and bequeath, all my real and personal estate (Except as herein before devised to my Grand Daughter Rebecca) whereso, the same may be. Subject however to the legacy hereinbefore bequeathed and the payment, of all my just debts, and subject however to the comfortable support, and maintainance of my son Adam Dreisbach, and his wife Rebeca, for and during their natural lives, such support and maintainence, to be furnished and provided by, for them, out of my said Estate, as shall or may be required for their comfortable subsistence, wich said support and maintainence, together with all proper care, and Medical attendance for them, I hereby expressly order and declare, shall be a charge and lien, on the Real estate, herein devised to my Grand son Jacob Lawyer Dreisbach, but in case the said Rebeca, the wife of my son Adam, shall survive her, said husband then, and in such case, the provision herein made for her support and maintainance is to continue no longer as she shall remain his widdow; and no longer, and in case of her mariage then and in such case the said provision is to cease.

Fourth. It is my will and order, that if my Grand daughter Rebecca, should get married, then she is to have a decent out set, of House furniture, and if in case, she should remain single, then she is to have her maintainance and support out of my said Estate, as long as she remains unmarried and no longer.

Fifth. I hereby constitute and appoint my said Grand son, Jacob Lawyer Dreisbach, Executor of this my last will and Testament hereby Revoking all former wills and Testaments by me heretofore made, in witness whereof I have hereunto set my hand and seal, this twenty-third day of June one thousand Eight-Hundred and forty-nine.

Surrogate Court In the matter of proving the will of

Philip Dreisbach deceased.

Schoharie County [ss.?] John Enders of Schoharie in the county of Schoharie, being first duly sworn in open court doth depose and say, that he is a subscribing witness to the last will and testament of Philip Dreisbach of the town of Schoharie in the county of Schoharie deceased. That the said Philip Dreisbach did in the presence of this deponent subscribe his name at the end of the instrument which is now shown and exhibited to this deponant and which purports to be the last will and testament of the said Philip Dreisbach and which bears date on the 23 day of June in the year of our Lord one thousand eight-hundred and forty nine. Deponent further says that the said Philip Dreisbach, the said testator did at the said time of subscribing his name as aforesaid at the end of the said will, declare the said instrument so subscribed and now exhibited, to be his last will and testament, and this deponent did thereupon subscribe his name at the end of the said will, as attesting witness thereto, at the request and in the presence of the said testator, and of each other and of the other subscribing witness thereto. Deponent further says that at the said time when the said testator subscribed his name to the said last will as aforesaid and at the time of this deponent subscribed his name as attesting witness thereto as aforesaid, the said Philip Dreisbach was of sound mind and memory, of full age to execute a will of real estate and was not under any restraint to the knowledge, information or belief of this deponent. And this deponent says that he saw Harmanus Vroman now deceased sign his name as a witness to said will,

Schoharie County [ss.?] Alexander H. Marselus of the town of Middleburgh, Schoharie County, being duly sworn in open court, says I was well acquainted with Harmanus Vroman deceased and am acquainted with his hand writing, have seen him write frequently--I have no hesitation, in swearing that the signature of the said Harmanus Vroman, as a witness, to the will of Philip Dreisbach deceased, is the proper Signature of said Harmanus--Deponent further says that the will was in the opinion of Deponent in the hand writing of said Harmanus Vroman

Surrogate Court In the matter of the last will of Philip

Dreisbach deceased.

Schoharie County [ss.?] Peter Mann of the town and County of Schoharie, being first duly sworn in open Court says, that he was well acquainted with Philip Dreisbach deceased the testator, and has known him sixty years. he lived & died at Schoharie. I was acquainted with his hand writing and have seen him write his name; the signature to the will of said Philip Dreisbach, now shown me, is the proper hand writing of said Philip Dreisbach deceased, I have seen Hermanus Vroman write, and I should think this signature to the said will as a subscribing witness, was the proper hand writing of the said Hermanus Vroman deceased.

Surrogate Court I Lyman Sanford county Judge of said county do hereby certify that the preceding is a true and perfect record of the last will and testament of Philip Dreisbach late of the town of Schoharie Schoharie county deceased and if the proofs and examinations taken in relation to the validity and execution [ ] of at the time said will was duly proven in open court pursuant to [ ] and the same is hereby recorded as a will of both real and personal estate.
