THE WILL OF MILO HENRY MAYHAM

THE WILL OF MILO HENRY MAYHAM � Last Will and Testament

I, MILO H. MAYHAM, of the village of Middleburgh, County of Schoharie and State of New York, being of sound and disposing mind and memory, do hereby make, publish and declare this my Last Will and Testament in form and manner following:

First � I direct the payment of all my just debts and funeral expenses.

Second � I do give and bequeath to the Trustees of the Methodist Episcopal Church of Jefferson, New York, the sum of FIVE HUNDRED ($500.00) DOLLARS, in trust to invest and re-invest the same and to use the income and proceeds thereof for general purposes of the church.

Third � All of the rest, residue and remainder of my estate of whatsoever kind or nature I do give, bequeath and devise to WARNER M. BOUCK.

Fourth � I hereby nominate, constitute and appoint WARNER M. BOUCK the Executor of this my Last Will and Testament giving and granting unto my said executor full power and authority to sell all or any part of my estate upon such terms as to credit or otherwise as he shall deem expedient.

Fifth � I hereby revoke all former wills made by me made.

In testimony whereof, I have hereunto set my hand and seal this 22 day of December 1939.

On this 22nd day of December, 1939, the foregoing Will was subscribed, published and declared by MILO H. MAYHAM, as and for his Last Will and Testament in our presence and in the presence of each other, and we, at his request, in his presence and in the presence of each other have subscribed our names and residences as attesting witnesses.

STATE OF NEW YORK, County of Schoharie

I, T. Paul Kane, Dist. Atty. & Acting Surrogate of the County Schoharie, do hereby certify that the annexed last Will and Testament of Milo H. Mayham lat of the Town of Middleburgh in the County of Schoharie, and State of New York, deceased, was duly proved before me, on the 3rd day of April in the year of our Lord one thousand nine hundred and fifty-nine as a Will relating to both real and personal estate, pursuant to the provisions of the Statute of New York in such case made and provided, and I further certify, that the said Will and the Proof�s taken in relation to the execution thereof, are recorded in the Surrogate�s Office of the County of Schoharie, in book of Wills, Vol. 31, Page 102 kept in said office for such purpose.

In testimony whereof, I, the said Surrogate, have hereunto set my hand and affixed the Surrogate�s Seal of the County of Schoharie, this 3rd day of April, 1959
